The applicant is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 Permit and 401 Certification. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended, 16 U.S.C. 661-667d. The applicant proposes to construct a new road to Jefferson Elementary School to eliminate traffic problems on a small residential street. The project will impact James Branch. Approximately 1401f feet of stream will be filled by a 138'x 8x 5' concrete box culvert. Based on our review of the project, we have the following recommendations: 1. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. 2. Disturbance of the stream channel should be limited to only what is required for box culvert construction. Disturbed stream banks should be restored to original contours and revegetated with native shrub and tree vegetation to reduce thermal impacts and provide habitat. 3. The dimension, pattern, and profile of the floodplain and streams above and below the culverts should not be modified by widening the stream channel or reducing the depth of the stream. Culverts should be buried a minimum of one foot into the streambed to facilitate aquatic migration. Riprap should be minimized and placed in a manner that will not impede aquatic life migration during low flows. Riprap should be limited at the inlet and outlet of the culvert. 5. Concrete will be used, work must be accomplished so that wet concrete does not contact stream water. 6. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 7. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. We encourage NCDOT to utilize onsite and natural vegetation and materials for streambank stabilization when practicable. Additionally, instead of using the typical fescue or grasses along the road way, disturbed areas should be planted to enhance wildlife food and cover with the following mix: Spring/Summer Mixture, May 1- Sept. 15 Browntop millet 20 lbs/a Korean lespedeza* 20 lbs/a Shrub lespedeza 1 lb/a Switchgrass 10lb/a * On slopes less than 3:1 use Korean lespedeza On slopes greater than 3:1 use Crown Vetch Fall/Winter Mixture, Sept. 15 - April 30 Rye grain 120 lbs/a Korean lespedeza* 20 lbs/a Shrub lespedeza 1 lb/a Partridge pea 10 lb/a Add one of the following to the above mixture Crown Vetch S lbs/acre Ladino Clover 51bs/acre Lime & fertilize disturbed areas according Alfalfa 5 lbs/acre to NCRS soil test and recommendations. (Note: Mowing should be limited to early spring and should only occur as needed to prevent tree growth on the dam or other areas. Mowing on a 2-3 year schedule should suffice.) Trees and shrubs (1 year bare root seedlings) should be planted randomly at a minimal rate of 100 trees per acre on the top and upper portions of the structure and at a minimal rate of 150 per acre around the normal water elevation and littoral shelf area. The following list of tree species may assist in providing habitat benefits: Loblolly Pine* Red Cedar Black Gum American Holly Dogwood Hickory Sumac White Oak Willow Oak Red Maple* Swamp Chestnut Oak Viburnum Green Ash Ironwood Black Cherry Persimmon Water Oak Spice Bush Silky Dogwood Willow (sp) Other species may be utilized depending on site requirements and availability. Pines* should not exceed 15% of the reforestation. No more than 20% of the tree species will be of a single species. An 801/o success rate is acceptable over five years. Large or fast growing trees like Sycamore and Maple** may not be appropriate around detention facilities. The above recommendations should be considered for the multiple benefits that they can provide to the community and to the environment. Initial costs should not be prohibitive and the DWQ ID # 000444 3 06/15/00 long-term costs should be reduced, as constant mowing would not be necessary in the naturalized areas. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for these impacts to wetlands and/or -streams. In accordance with 15A NCAC 2R .0402, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H.0506(h). According to 15A NCAC 2H .0506(h), feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check (made payable to: DENR - Wetland Restoration Program), wetland or stream fill shall not occur. This Certification replaces Water Quality Certification Number 2177 issued on November 5, 1987, Water Quality Certification Number 2666 issued on January 21, 1992 and Water Quality Certification Number 2732 issued on May 1, 1992. This WQC is rescinded when the Corps of Engineers reauthorize Nationwide Permit 14 or when deemed appropriate by the Director of the DWQ. The State of North Carolina certifies that the specified category of activity will not violate applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with the conditions hereinafter set forth. Conditions of Certification: 1. Proposed fill or substantial modification of wetlands or waters under this General Certification requires written concurrence from the Division of Water Quality; 2. The width of the fill is limited to the minimum needed for the actual crossing; 3. The roadway width shall be minimized as much as practicable and that no practicable alternative exists; 4. Pipes shall be installed under the road in all streams so as to carry at least the 25 year storm event as outlined in the most recent edition of the "North Carolina Erosion and Sediment Control Planning and Design Manual" or "North Carolina Surface Mining Manual" in order not to impede flow. Pipes shall be placed at or below the elevation of the streambed so as not to impede aquatic life movement; 5. That appropriate sediment and erosion control practices which equal or exceed those outlined in the "North Carolina Erosion and Sediment Control Planning and Design Manual" or "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional and Central Offices) are utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in streams and rivers not designated as trout waters by DWQ; 25 NTUs in all saltwater classes, and all lakes and reservoirs; and 10 NTUs in trout waters); 6. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 7. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 8. If this Certification is used to access building sites, all lots must be buildable without additional fill beyond that allowed under other General Certifications. Deed restrictions must be placed on the remaining wetlands on these lots to restrict future fill. DWQ shall be sent copies of all deed restrictions applied to these lots; 9. This Certification shall be utilized for roads from natural high ground to natural high ground. The Certification for Nationwide Permit 18 may not be used in conjunction with this Certification to create high ground for road access; 10. If an environmental document is required, this Certification is not valid until a FONSI or ROD is issued by the State Clearinghouse; 11. That additional site-specific conditions may be added to projects proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 12. Concurrence from DWQ that this Certification applies to an individual project shall expire three years from the date of the cover letter from DWQ Non-compliance with or violation of the conditions herein set forth by a specific fill project shall result in revocation of this Certification for the project and may also result in criminal and/or civil penalties. The Director of the North Carolina Division of Water Quality may require submission of a formal application for individual certification for any project in this category of activity, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the wetland or downstream waters are precluded. Public hearings may be held for specific applications or group of applications prior to a Certification decision if deemed in the public's best interest by the Director of the North Carolina Division of Water Quality. Thank you for providing the additional project details in response to our April 6, 2000 information request. This project has been reviewed by staff of the DWQ Winston-Salem Regional Office, and our concerns with respect to the project design have been addressed. The only unresolved issue for this project is stream mitigation. As we noted in our April 6, 2000 letter, since you propose to impact greater than 150 linear feet of perennial streams, compensatory stream mitigation will be required in accordance with 15A NCAC 211 .0506(h). You have the following options for satisfying the mitigation requirement associated with this project: 1. Payment into the North Carolina Wetland Restoration Program, if the WRP will accept the responsibility for conducting this mitigation work, or 2. Preparing and implementing a stream mitigation plan. Ms. Jennifer Frye of the Winston-Salem Regional Office has noted that no opportunities exist for stream mitigation on the school property, although you may choose to contract an offsite stream mitigation site with a private consultant. If you elect to pay into the WRP, a letter of acceptance from the WRP will be required before we can issue the 401 Water Quality Certification. Please contact Ron Ferrell, supervisor of the Wetland Restoration Program, at (919) 733-5219 to discuss this issue. Your application will remain on hold until a mitigation plan is forwarded to this office. Wetland Impacts are described as follows: • Roadway Station 8+20 - James Branch (Perennial Stream) 240 LF of stream impacts including the rip-rap inlet and outlet protection. Approximately 35' feet of the 240' includes and existing 54" Pipe and a bridge. • Roadway Station 16+60 - Drainage Ditch(Possible Intermittent Stream) 3' Wide x 80' Long Impact area(0.005 Acres) • Roadway Station -19+00 to 20+60 Impact area 160'x 60' = 0.22 acres. This appears to be an isolated wetland pocket created from drainage from the adjacent upland area. 4. Alternate routes were examined for the route of the roadway. The initial route selected placed the roadway approximately 100' west from the present location. More extensive wetland impacts were noted and the roadway was shifted into the flood plain. Headwalls are also indicated at the James Branch crossing to minimize stream channel impacts. 5. At the present time no mitigation is proposed. The remaining portions of James Branch on our site contain an existing vegetated buffer, which in our opinion should remain undisturbed. Along Muddy Creek existing utilities(Sewer and Gas) will limit improvements. _ 6. Where possible stormwater will discharge at existing grade and will dissipate over the flood plain area. Vegetated channels with minimal slope are also proposed. We appreciate your assistance on this project. Should you have any questions or need additional information please give us a call. Box 2513 Winston-Salem, NC, 27102-2513 Dear Mr. Teague: On April 3, 2000, the NC Division of Water Quality received your application for a 401 Water Quality Certification to impact wetlands and streams for the Jefferson Elementary School site in Forsyth County County. Your application is not complete since we cannot discern the precise location or extent of wetland and stream impacts from the material provided. Please provide the following information so that we can complete our review of your proposal: 1. A vicinity map clearly illustrating the location of this property with respect to surrounding roads and landmarks. This is also needed so that we can determine the classification of any streams occurring on your property; 2. Most of the engineering plan and profile drawings included with the application do not include scales or north arrows. We suggest that you include these items on all maps included with your application; 3. Please provide a narrative discussing all wetland and stream impacts proposed within the scope of this project. Wetland boundaries and impact areas should be clearly identifiable on your site plan. Where stream impacts are proposed, please provide a breakdown of perennial and intermittent stream impacts. You should also note that rip-rap placed along banks at either end of a culvert will be counted as stream impacts; - 4. Were any steps taken to avoid and minimize wetland and stream impacts? If so, please describe these measures; 5. If stream impacts equal or exceed 150 linear feet of perennial streams, compensatory stream mitigation may be required in accordance with 15A NCAC 2H .0506(h). It appears that impacts may exceed 150 linear feet for this project. If so, how do you propose to mitigate these impacts? 6. Please describe how stormwater will be treated on this site. Until this information is received, I will request (by copy of this letter) that the Corps of Engineers place this project on hold. We offer the following additional supporting information to enable your office to complete your review of our project: 1. A vicinity map is attached along with partial copies of the Rural Hall and Winston-Salem West USGS topographic maps with the location of our project indicated. 2. We have enclosed partial copies of the project plan and profiles with a scale and north arrow indicated on each sheet. 3. Wetland Impacts are described as follows: • Roadway Station 8+20 - James Branch (Perennial Stream) 240 LF of stream impacts including the rip-rap inlet and outlet protection. Approximately 35' feet of the 240' includes and existing 54" Pipe and a bridge. • Roadway Station 16+60 - Drainage Ditch(Possible Intermittent Stream) 3' Wide x 80' Long Impact area(0.005 Acres) • Roadway Station ---19+00 to 20+60 Impact area 160'x 60' = 0.22 acres. This appears to be an Isolated wetland pocket created from drainage from the adjacent upland area. 4. Alternate routes were examined for the route of the roadway. The initial route selected placed the roadway approximately 100' west from the present location. More extensive wetland impacts were noted and the roadway was shifted into the flood plain. Headwalls are also indicated at the James Branch crossing to minimize stream channel impacts. S. At the present time no mitigation is proposed. The remaining portions of James Branch on \ our site contain an existing vegetated buffer, which in our opinion should remain undisturbed. Along Muddy Creek existing utilities(Sewer and Gas) will limit improvements. t?4 6. Where possible stormwater will discharge at existing grade and will dissipate over the flood ?y ?cr plain area. Approximately 35' feet of the 240' includes and existing 54" Pipe and a bridge. • Roadway Station 16+60 - Drainage Ditch(Possible Intermittent Stream) 3' Wide x 80' Long Impact area(0.005 Acres) • Roadway Station --19+00 to 20+60 Impact area 160' x 60' = 0.22 acres. This appears to be an Isolated wetland pocket created from drainage from the adjacent upland area. 4. Alternate routes were examined for the route of the roadway. The initial route selected placed the roadway approximately 100' west from the present location. More extensive wetland impacts were noted and the roadway was shifted into the flood plain. Headwalls are also indicated at the James Branch crossing to minimize stream channel impacts. 5. At the present time no mitigation is proposed. The remaining portions of James Branch on our site contain an existing vegetated buffer, which in our opinion should remain undisturbed. Along Muddy Creek existing utilities(Sewer and Gas) will limit improvements. 6. Where possible stormwater will discharge at existing grade and will dissipate over the flood plain area.
