After reviewing your application, we have determined that this action is covered by General Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit Number 12 when issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitiation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. On January 1, 1994, we renewed general permit No. 198100049, (copy enclosed) that authorizes the maintenance, repair and installation of aerial and subaqueous utility lines with attendant structures and the discharge of excavated or fill materials, within construction/access corridors, associated with utility line maintenance, repair and installation in navigable waters and waters of the United States in the State of North Carolina. Your proposed work is authorized if you can comply with all general permit conditions, and those outlined in the attached February 18, 1997 WRC letter. Bridges, P.E., of McGill Associates, P.A., on behalf of the City of Asheville, is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. I have reviewed the information provided by the applicant, and I am fanuliar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The applicant proposes to construct a new 12-inch sewer line across Hominy Creek to provide service to the surrounding area, which was recently annexed by the City of Asheville. Direct project impacts to fish and wildlife resources involve the subject stream and associated wetlands. The NCWRC does not object to the issuance of a 404 permit, provided the following conditions are met by the applicant: 1. Sewer lines should cross streams at right angles to minimize impacts to riparian areas. 2. Under no circumstances should rock, sand, or other materials be dredged from the stream channel under authorization of this permit, except in the immediate vicinity of pier construction. Channel relocations have catastrophic effects on aquatic life, and disturbance of the natural form of the stream channel will likely cause downstream erosion problems, possibly affecting adjacent landowners. 3. Excavation of the pier sites should be conducted in the dry, if possible. Sand bags, cofferdams, flexible pipe, or other diversion strictures should be used to minimize excavation in flowing water. 4. Adequate precautions should be taken to prevent direct contact between wet concrete and stream water. Uncured concrete affects water quality and is toxic to fish and other aquatic organisms. 5. Adequate sedimentation and erosion control measures should be implemented and maintained on the project site to avoid impacts to downstream aquatic resources. Permanent herbaceous vegetation should be established within 15 working days of ground disturbing activities to provide long term erosion control. City of Asheville sewer permit February 18, 1997 6. An undisturbed buffer zone should be left between streams and all construction if possible. We prefer buffer zones of at least 50 feet to control sedimentation into streams, provide shade, and maintain a travel corridor for wildlife. 7. Riparian vegetation, especially trees, should be preserved as much as possible at stream crossings. Trees that must be removed should be cut near ground level, leaving the stump and roots in the bank for stability and to possibly sprout. 8. Natural materials should be used as much as possible to restore stream banks at crossings. Riprap should be limited to the stream bank below the high water mark, and vegetation, should be used for stabilization above high water. 9. If necessary, ROW areas should be mowed not more than once every 2-3 years. Mowing should be done only in February and March to protect small game nesting sites later in the year.
