Turnage Route 1, Box 473 La Orange, NC 28551 Dear Mr. Turnage: You have our approval, in accordance with the attached conditions and those listed below, to conduct repairs on On existing dam on Tyson Marsh in Greene County, as you described in your application received by the Division of Water Quality on March 27, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3127. This certification allows you to use Nationwide Permit Number 3 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. Hunt, Jr., Governor CERTIFIED MAIL RETURN RECEIPT REQUESTED Z365067512 Bill Holman, Secretary DMSION OF LAND RESOURCES LAND QUALITY SECTION October 27, 1999 Mr. Jacob Turnage Lake View Packing Company Route 1, Box 473 LaGrange, NC 28551 RE: Notice of Inspection (Post - Hurricane Floyd) Tumage Millpond Dam Greene County Greene - 002-H Dear Mr. Turnage: The "Dam Safety Law of 1967" provides for the certification and inspection of dams in the interest of public health, safety, and welfare, in order to reduce the risk of failure of such dams; to prevent injuries to persons, damage to downstream property; and to ensure the maintenance of stream flows. This dam is classified as High Hazard due to Highway 903 being located approximately 1500 feet downstream. Last month (September, 1999) much of eastern North Carolina was affected by heavy rains from several large storms including Hurricanes Dennis and Floyd. During the weeks that followed, representatives from the Division of Land Resources performed emergency inspections on many dams in the region. Please note that inspections during this period were not intended to be comprehensive. The basis of these visits was to evaluate for situations of immediate danger and to provide emergency assistance if required. The purpose of this letter is to now report observations from these inspections and to request action from owners of dams which suffered damage. An inspection of the referenced dam was conducted on October 21, 1999, by staff of the Land Quality Section's Washington Regional Office. The lake was draining through a breach in the dam embankment along an approximately 150 foot section near the concrete principal spillway. From a distance, it appeared that the concrete lined emergency spillway section near the left abutment had been filled with a culvert placed through the filled area. Access to the emergency spillway area was not available. 4. Trees and bushes exist along the entire downstream and upstream slope of the dam. If the lake has already been drained because of the damage incurred by the dam, it will be necessary to stabilize exposed areas of the lake bottom and breach side-slopes and take other appropriate measures to restrain further erosion and prevent off-site sedimentation. In order to ensure the safety of this dam, you must retain the services of a registered professional engineer or an experienced engineering firm to make a study of the conditions outlined in this letter. Plans and specifications for repair or permanent breach (based on the results of the study) must be filed with the Division of Land Resources for approval pursuant to the North Carolina Administrative Code, Title 15A, Subchapter 2K - Dam Safety (15C NCAC 2K). Also, if the lake is not completely drained, you are directed. to immediately begin draining the lake at a rate of approximately one foot per day until the lake is completely drained, and the lake is to be maintained in a completely drained condition. We regret that your dam was damaged during the storms last month but appreciate your efforts and cooperation toward bringing the dam in compliance with North Carolina's Dam Safety Program. Please advise us with a written notification on or before November 25, 1999, of your intended action in this matter. In the event that no action is taken, it may become necessary to present case information to our Enforcement Section for appropriate action. Enforcement action could include penalty of up to $500.00 per day of violation, and/or issuance of a Dam Safety Order requiring the repair or removal of this dam, and/or injunctive relief to gain compliance.
