PROJECT SUMMARY: The applicants propose to remove the existing floating dock, install a shared "U"shaped floating dock to provide mooring for 4 vessels, and excavate an area approximately 1,575 square feet of previously dredged shallow water bottom surrounding the floating docking facility. Shuford-Kiser Page 2 9. PROJECT DESCRIPTION: The project is located at 63 Beach Road South on Figure Eight Island, adjacent to Banks Channel and Middle Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and the property will be located approximately 1.75 miles on the right. The project site is located at 173 and 175 Beach Road South, adjacent to Banks Channel, on Figure Eight Island, New Hanover County. The properties are adjacent to residential properties on the south and north sides. The properties are bordered on the east side by Beach Road South and a man-made cove to the west. The current elevation of the properties is approximately 6 feet above mean sea level (MSL). Both tracts are developed and include single-family residences located on the highground. The size of the Shuford tract located at 173 Beach Road South is approximately 0.41 acres with approximately 43 linear feet of shoreline. The size of the Kiser tract located at 175 Beach Road South is approximately 0.74 acres and has approximately 77 linear feet of shoreline frontage. The vegetation on the highground consists primarily of Red Cedar, Wax Myrtle, Yaupon, Pennywort, Seaside Golden Rod, Eastern Baccharis, Catbrier, Indian Blanket, Salt Meadow Hay and Sea-Ox Eye. The highground vegetation extends to a natural bank along the shoreline that is naturally stabilized with vegetation. The bank is approximately four feet in height and transitions to low marsh approximately 25 feet wide that is vegetated with Salt Meadow Hay (Spartina patens), Salt Marsh Cord Grass (Spartina alternaflora), Sea Lavender (Limonium spp.) and Glasswort (Salicornia spp.). A wooden walkway extends from the residence located at 173 Beach Road South and connects to the existing pier. The property located at 175 Beach Road South also has a short walkway connecting to the existing pier. The existing pier originates at a point located along the property line of 173 Beach Road South and 175 Beach Road South and extends into the riparian access area of 175 Beach Road South. The existing pier measures approximately 87 feet in length by 6 feet in width. Approximately 30 feet waterward of Normal High Water (NHW) are two 6 feet in length by 5 feet in width seating areas adjacent to the access pier. The access pier is connected via ramp to an existing 8 feet wide by 16 feet long floating dock that provides mooring for two (2) vessels. Existing water depths adjacent to the floating dock range from -0.0 feet to -1.2 feet at Normal Low Water (NLW). The southernmost cove located on the west side of Figure Eight Island is man-made and has been historically dredged. Several property owners along the cove have received individual permits for dredging. No known archaeological sites have been documented within close proximity of the project site. The presence of submerged aquatic vegetation and shellfish beds has not been observed in cove and waters adjacent to the existing docking facility. The New Hanover County Land Use Plan classifies the adjacent waters and high ground portion of the project site as Conservation. The waters of Banks Channel and Middle Sound are classified as SA- ORW, by the NC Division of Water Quality. The cove terminates along the shoreline adjacent to the existing docking facility and the existing floating dock is located approximately 25 feet from the adjacent pier to the north. These waters are NOT designated as PNA by the NC Division of Marine Fisheries and are open to the harvest of shellfish. Shuford-Kiser Page 3 10. PROPOSED PROJECT: The applicants propose to remove the existing floating dock, install a shared "U"shaped floating dock to provide mooring for 4 vessels, and excavate an area approximately 1,575 square feet of previously dredged shallow water bottom surrounding the floating docking facility. The applicants propose to remove the existing 8 feet wide by 16 feet long floating dock and replace it with a 16 feet long by 5 feet wide floating dock. A proposed 10 feet long by 4 feet wide floating dock would extend to the southwest and would be joined to a 16 feet long by 5 feet wide floating dock positioned north to south. The three (3) proposed floating docks would be arranged in a "u" shaped configuration and would provide mooring for four (4) vessels. The applicant is not proposing any changes to the existing fixed pier and the proposed new "u"shaped configuration would be located entirely within the riparian access of 175 Beach Road South. The proposed private docking facility would provide mooring for (4) four vessels. The applicant is also proposing to excavate an area adjacent to the proposed docking facility measuring approximately 35 feet in length by 45 feet in width to a final depth of -4 feet at NLW. The applicants are proposing to excavate approximately 200 cubic yards of material from the previously dredged shallow water bottom. The applicant is proposing a bucket-to-barge method of excavation with the resulting spoil material to be deposited on a spoil island adjacent to Nixon Channel. The proposed spoil disposal area measures approximately 200 feet in length by 300 feet in width. 11. ANTICIPATED IMPACTS: The proposed structures would incorporate approximately 644 square feet of Estuarine Waters and Public Trust Area, however much of this area is currently usurped by the existing docking facility. The proposed structure would extend approximately 90 feet into the waterbody and would not extend beyond the established pier length. The docking facility would not encroach into the 15' riparian corridor setback requirement and would be located within the riparian access area of the co-applicants. The proposed docking facility would provide mooring for four (4) vessels. The proposed excavation of the bottom surrounding the docking facility would result in the removal of approximately 1,575 sq. feet of shallow bottom within the Outstanding Resource Waters, Estuarine Waters and Public Trust Areas. Approximately 60,000 sq. ft. of highground area could potentially be disturbed (based on submitted dimensions) for the spoil site area preparation, which would contain approximately 200 cubic yards of excavated material. Minor increases in turbidity should be expected during construction, but if construction is timed to avoid periods of peak biological activity impacts should be minimal. Also, we propose to perform maintenance dredging around the new docks Because of the close proximity of adjacent piers and the limited riparian area in this 'end of the basin"' situation, the two applicants are proposing to share the dockage area using the existing fixed pier which crosses from Shuford's riparian area to Kiser's riparian area. Also, this new layout will slightly move the dock further away from the dock to the north owned by Mr. Nat Harris at #1 Little Neck.
