Staff report completed.
FYI, the last I heard was that the Corps may not issue this project
under the NWP 39 (because of the size of the drainage area). The
consultant told me that they would not re-apply for an IP, but a NWP 14
(for the two road crossings). Why they didn't do that to begin with is
beyond me.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Sits:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.15 acres of wetlands
and 276 linear feet of streams for the purpose of developing the Quail Ridge subdivision at Hwy 62 between Anderson and Jericho as described
in your application dated March 24, 2000 and revised on June 6, 2000. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3287. This certification allows you to use Nationwide Permit Number 39 when the
Corps of Engineers issues it. In addition, you should get any other federal, state or local pemtits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations.
This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If you change
your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a
copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project
(now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below.
I . Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order
to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this
letter or the issuance of the 404 Permit (whichever is later).
2. A final site plan depicting all proposed stream and wetland impacts must be submitted to the Central and Winston-Salem office of DWQ
before impacts occur.
3. A 30 foot wide, vegetated buffer must be maintained along all perennial streams.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of
the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh. N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions,

This project contains 5439 linear feet of channels throughout the property. Our
proposed project will impact 0.15 Acres of delineated wetlands. Our nelayout

serve as septic fields for individual lots. This configuration allows for the least arnount

our roadway in conjunction with our Erosion and Sedimentation control plan, and found
this location to best serve the property.
Based on our site plan we prvpased to Impact approximately 0.15 Acres of wetlands
with our proposed roadway construction. The roadway construction will impact 276
linear feet of stream channel. Of the proposed channel impacts 149 linear feat are
proposed for channels that contain significant aquatic function. Furthermore, impact "A°
occurs in low quality wetlands according to SUC.

Impact "C" involves 149 linear feet of channel on Tom's Creek. The proposed impact 19

The Division of Water Quality has reviewed your plans for the discharge of fill
material into 276 linear feet of surface waters and 0.15 acres of wetlands in Caswell
County for the purpose of residential development. Insufficient evidence is present in
our files to conclude that your project must be built as planned in waters and/or
wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications
of the proposal are made as described below, we will have to move toward denial of
your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this
project on hold as incomplete until we receive this additional information. We are
requesting (by copy of this letter) that the U. S. Army Corps of Engineers place your
project on administrative hold.
(1) Please provide us with information supporting your position that states
your project must be constructed as planned and that you have no
practicable alternative to placing fill in these waters and/or wetlands.
Documentation such as maps, narratives, economic analyses, that you
can supply to address alternative designs for your project may be
helpful in our review of your 401 Certification request.
(2) Please provide documentation detailing you position that the project
has been designed such that adverse impacts to surface waters have
been minimized and existing uses have been protected to the best of
your ability.

(3) On April 18, 2000, Mrs. Jennifer Frye (DWQ-WSRO) and Mr.
Wendell Overby (S&EC) performed a site visit and noted the presence
of additional waters on the subject property. In order for us to provide
a proper review of your 401 WQ Certification Application, please
submit the total acreage and linear footage of surface waters for the
entire project area. If future impacts (i.e. driveway crossings) are
known they must be included with the total amount of impact. Please
keep in mind that the waters on this property are classified as WS-II,
NSW; therefore, vegetative buffers may be required, per 15A NCAC
2B .0214.
Please respond within three weeks of the date of this letter by sending one
copy of this information to me and one copy to John R. Dorney, 4401 Reedy
Creek Road, Raleigh, NC 27607. If we do not hear from you in three weeks, we will
assume that you no longer want to pursue this project and we will consider the project
as withdrawn. If you have any questions regarding this matter, please contact Mrs.

The purpose of this letter is to request the use of Nationwide Permit 39 for construction of the proposed
project Quail Ridge Subdivision. The proposed Quail Ridge Subdivision is located south of NC 62 near
Anderson in Caswell County (NC Grid X-1892467, Y-918379). The site is shown on the attached plans
and USGS Topo Quad vicinity map. Proposed impacts to jurisdictional waters will total 0.15 acres for 3
road crossings. Construction of the subdivision will comply with all of the general conditions stated within
Nationwide Permit 39.
Impacts to stream channels total 276 linear feet. All impacts are perpendicular crossings (see construction
plans). Although not confirmed by NC DWQ or USACE, S&EC believes that no stream mitigation
will be required for this project because impacts to significant channels involve less than 150 linear
feet. S&EC can meet with either agency on-site if needed for confirmation. Please allow a couple of days
for scheduling. If for some reason mitigation is required, our client proposes payment into the North
Carolina Wetland Restoration Fund.
Included are: (1) a completed Pre-Construction Notification application, (2) Agent Authorization Form, (3)
USGS Site Vicinity Map, (4) Site Plans, (5) Wetland Delineation Forms.
