FAA NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES March 31, 2000 Durham County DWQ Project # 000367 APPROVAL of 401 Water Quality Certification and Neuse Buffer Rules Durham Memorial Baptist Church 2703 Holloway Street Durham, NC 27703 Dear Sirs: You have our approval, in accordance with the attached conditions, to excavate 0.10 acres of wetlands and temporarily impact an unnamed tributary to Little Lick Creek in Durham County for the purpose of water and sewer line installation as you described in your application received by the Division of Water Quality on March 3, 2000. After reviewing your application, we have determined that this action is covered by General Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit Number 12 when issued by the U.S. Army Corps of Engineers. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27 6 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. Also enclosed is a copy of the USGS Southeast Durham Quad showing the project location, a set of design drawings and a check for $200 payable to DWQ. All work is in the Neuse River Basin. The project consists of extending City of Durham 12" and 8" waterlines a distance of 2980 linear feet and 8" sanitary sewer lines 1530 linear feet to serve the proposed Durham Memorial Baptist Church on Robbins Road (SR 1910). The utility lines will be constructed b_v the church and turned over to the City of Durham for operation and ownership. The waterline is being constructed in the NCDOT rights of way for Wake Forest Highway (NC98) and Robbins Road (SR 1910). There is one crossing of an unnamed tributary of Little Lick Creek. The sanitary sewer line is being constructed in both NCDOT rights of way for NC 98 and SR 1910, and in sanitary sewer easements to be dedicated to the City. There arc two crossings of riparian buffers in the southwest quadrant of the NC 98 and SR 1910 intersection. To the east of SR 1910 the sanitary sewer line parallels another unnamed tributary to the church site. No clearing is shown in the 30' Zone 1 buffer. while some clearing is shown in the Zone 2 buffer. Side slopes of 16% are resulting in cuts of up to 11' in order to stay out of Zone 1. Additional cuts of 6-8' would be necessary to stay out of Zone 2 and would result in horizontal disturbances exceeding the width of the casement.
