After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103 and 3108. This certification corresponds to the Nationwide Permit Numbers 14 and 26 issued by the Corps of Engineers. This approval is also valid for the Neuse River buffer rules (15A NCAC 213 .033). In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be liven a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). ). This approval shall expire with the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Stormwater shall be directed to sheetflow at nonerosive velocities through the protected stream buffers. 2. Prior beginning construction, a stormwater management plan shall be submitted to, and approved by, the NCDWQ. The Stormwater management plan must include plans and specifications for stormwater management facilities designed to remove 85% TSS according to the most recent version of the NC DFNR Stormwater Best Management Practices Manual. Also, before any permanent building is occupied at the subject site, the stormwater management facilities, as approved by this Office, must be constructed and operational, and the stormwater management plan, as approved by this Office, shall be implemented. The attached USGS Topo Quad shows the location of the site. The site is slated for development as an office park. In its current state the site contains some 0.934 acres of jurisdictional wetlands and waters. The Nuese River buffer on the site has been identified and is platted on the attached site plan. Site development will leave 0.284 acres of jurisdictional wetlands intact. An additional 0.130 acres of surface waters will be created for a storm water detention facility. The net area of surface waters after construction will total approximately 0.414 acres. Impacts to 0.196 acre of vegetated wetland located at the northeast portion of the property are proposed under a combination of Nationwide 14 and Nationwide 26 for the purposed of constructing a road crossing and attendant parking. The impacts associated with the road and parking facilities are based on the vertical separation between the two fills thus assigning a larger portion of the fill to Nationwide 26. As calculated, the road crossing commits approximately 0.098 acres of the impact and the parking the commits the balance. If constructed without the parking the proposed access road would commit the bulk of the proposed impacts based on the topography and filling requirements for safe construction. If the road were constructed without the parking it would commit approximately 0.179 acres. Impacts to 0.454 acre of wetland are proposed under Nationwide 26 for the construction of building pads and for a detention facility. Impacts under NW 26 are necessary for site development that allows for the utilization of detention ponds on the central drain. Site constraints resulting from topography and building set-backs dictate the development illustrated on the site plan. The current development plan utilizes existing topography to drain storm water flow to the detention ponds. The western most portion of the site illustrates no clearing or disturbance because this area is encumbered by topography, buffers and geometric constraints. A revised plan utilizing westernmost corner site would require an additional detention pond to be constructed within the bottom half of the "hourglass" shaped wetland. It has been determined that the placement of an additional pond on the site would result in the same net impact and increases liabilities and costs for site development.
