APPROVAL of 401 Water Quality Certification
Dear Mr. Hodges:
You have our approval, in accordance with the attached conditions and the conditions listed below, to place
fill in 0.014 acre of wetlands in order to construct a bulkhead on your property in Dare County, as you described in
your application dated 23 March 2000. After reviewing your application, we have determined that this fill is
covered by General Water Quality Certification Number 3112. This Certification allows to use your CAMA Permit
when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when
the accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application for. a new certification. If
the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby
responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed
one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to
be valid, you must follow the conditions listed in the attached certification:
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.
Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask
for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.

PROJECT SETTING
The property is in Colington Harbour, a gated residential subdivision on Colington Island, Dare
County. The project site is a 6,935 sf undeveloped lot, on Harbour View Drive, 65' east of Jester
Court, along the Albemarle Sound. Elevation of the property is approximately four feet above Normal
Water Level (NWL). A small 65 sf Coastal Wetland fringe is located along the shoreline in the
southeast corner of the lot. Wetland vegetation includes salt meadow grass (Spartina patens) and black
needlerush (Juncus roemeriantis). High ground vegetation is primarily bermudagrass (Cvnodon dactvlon).
The adjacent lots,•to the east and west, are vacant and have severe erosion due to the collapsed
concrete bulkhead system waterward of the applicant's property. Erosion of the site is estimated at a
rate of two feet per year, which has created a sandy beach. There is no evidence of Submerged
Aquatic Vegetation within the project area.
Albemarle Sound is classified as joint waters by agreement between the Marine Fisheries
Commission and Wildlife Resource Commission. The Division of Environmental Management's water
quality classification for the Albemarle Sound is SB (Swimming). Review of available information
suggests that there are no known archeological sites or geological formations associated with the
applicant's property.
PROJECT DESCRIPTION
The applicant would like to construct a 39' bulkhead a maximum of 24'. and an average of 15'.
waterward of NWL. The proposed bulkhead will be constructed two feet landward of the existing
collapsed concrete bulkhead, and will result in the tilling of approximately 65 sf (3.9' x 16.65') of
Coastal Wetlands and 555 sf (15' x 37') of Estuarine Water and Shallow Water Bottom. Staff
calculations indicate that approximately 10 cubic yards of fill material will be placed below NWL.
The application and plans submitted do not indicate whether the applicant intends to remove the
existing remnant bulkhead. High ground fill associated with the project will extend an average of 36'
landward of the proposed bulkhead and resulting in the fill of approximately 839 sf.
ANTICIPATED IMPACTS
• The loss of 555 sf of Shallow Water Bottom and Estuarine Water.
• Loss of 65 sf of Coastal Wetlands.
• Stabilization of 37' of Estuarine Shoreline.
• Enhance the value of a residential lot.

PROJECT SETTING
The property is in Colington Harbour, a gated residential subdivision on Colington Island, Dare
County. The project site is a 6,935 sf undeveloped lot, on Harbour View Drive, 65' east of Jester
Court, along the Albemarle Sound. Elevation of the property is approximately four feet above Normal
Water Level (NWL). A small 65 sf Coastal Wetland fringe is located along the shoreline in the
southeast comer of the lot. Wetland vegetation includes salt meadow grass (Spartina patens) and black
needlerush (Juncos roemerianus). High ground vegetation is primarily bermudagrass (Cvnodon dactvlon).
The adjacent lots,-to the east and west, are vacant and have severe erosion due to the collapsed
concrete bulkhead system waterward of the applicant's property. Erosion of the site is estimated at a
rate of two feet per year, which has created a sandy beach. There is no evidence of Submerged
Aquatic Vegetation within the project area.
Albemarle Sound is classified as joint waters by agreement between the Marine Fisheries
Commission and Wildlife Resource Commission. The Division of Environmental Management's water
quality classification for the Albemarle Sound is SB (Swimming). Review of available information
suggests that there are no known archeological sites or geological formations associated with the
applicant's property.
PROJECT DESCRIPTION
The applicant would like to construct a 39' bulkhead a maximum of 24'. and an average of 15'.
waterward of NWL. The proposed bulkhead will be constructed two feet landward of the existing
collapsed concrete bulkhead, and will result in the filling of approximately 65 sf (3.9' x 16.65') of
Coastal Wetlands and 555 sf (15' x 37') of Estuarine Water and Shallow Water Bottom. Staff
calculations indicate that approximately 10 cubic yards of fill material will be placed below NWL.
The application and plans submitted do not indicate whether the applicant intends to remove the
existing remnant bulkhead. High ground fill associated with the project will extend an average of 36'
landward of the proposed bulkhead and resulting in the fill of approximately 839 sf.
ANTICIPATED FWPACTS
• The loss of 555 sf of Shallow Water Bottom and Estuarine Water.
• Loss of 65 sf of Coastal Wetlands.
• Stabilization of 37' of Estuarine Shoreline.
• Enhance the value of a residential lot.
