Dear Mr. Creech:
This office has reviewed the information based on the site visit for the above referenced project on
March 16, 2000. This project is referenced by the Raleigh Regional Office as NBRRO 99-073. It
was determined that the feature depicted on the USGS and Wake County Soils is at least an
intermittent stream and therefore subject to the Neuse River Basin: Nutrient Sensitive Waters
Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative
Code T15A:02B.0233 (NCAC 0233).
As we discussed a road crossing parallel to US 70 across this stream would be approved since
there is no practical alternative to this impact. Accordingly I have enclosed a Pre-Construction
Notice for your use. Also be aware that a $200 fee for the required 401 Certification will be
needed along with seven copies of the completed application.
