The EPA Region 4 Ocean, Wetlands and Streams Protection Branch has reviewed the subject CAMA GP 291 Major
Permit request under DA Action ID SAW-2019-02418 dated January 24, 2020. It is our understanding that the applicant,
Cyrus Sloan, proposes to construct a new 70' long bulkhead approximately 12' waterward of the existing bulkhead, in
order to reduce 'backslpash' and tie into adjacent bulkheads on neighboring properties adjacent to Bogue Sound, in
Atlantic Beach, Carteret County, North Carolina.
According to the Project Description, the applicant is proposing to construct a 1' X 70' long vinyl bulkhead waterward of
the existing bulkhead. It would be at an average distance of 12.5' waterward of NHW and not exceed a maximum distance
of 15' beyond NEW. A total of 875 sf of shallow bottom habitat would be filled with the bulkhead and backfilled with
clean fill dirt.
The proposed bulkhead would fill 875 sf of shallow bottom habitat, however no SAV or shellfish were observed within
the proposed location. Temporary increases in local turbidity are expected during construction.
At this time the EPA has no comments or concerns with the project put forth by the applicant.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit request for the subject project. The attached notice
requests federal agency comments on this project by February 24, 2020.
The applicant proposes to replace an existing bulkhead within waters adjacent to Bogue Sound, at 228 Bayview
Boulevard, in Atlantic Beach, Carteret County, North Carolina. Coordinates in Decimal Degrees are: 34.707175 N, -
76.734389 W
As currently proposed, the project would be to construct the new bulkhead an average distance of 12.5' waterward of
NHW, and not exceed a maximum distance of 15' beyond NHW, at any point. A total of 875 sf of shallow bottom habitat
would be filled with the bulkhead. The proposed bulkhead would not exceed existing ground level height ( 4' above
NHW). The bulkhead would be backfilled with clean sand fill dirt. Per the applicant due to "backsplash" issue with the
current in -set bulkhead, the new alignment that would tie into the adjacent bulkheads would help alleviate this issue. The
backsplash is caused by wave action in the area (boat traffic, wind) which is causing washout behind the existing
bulkhead. In further coordination with DCM and the applicant, they have indicated that they may be able to reduce the
footprint to 10 feet waterward of NHW, and still achieve the goal to reduce the backsplash.
Please see the attached application request, plans, bioreport dated December 10, 2019, and location map for more detailed
information concerning the proposed project.
EFH:
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but is not
likely to adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service.
The waters within the project area designated HQW by the Division of Water Resources. Waters within the project area
are NOT designated as PNA by the NC Division of Marine Fisheries and according to the application are closed relative
to the taking of shellfish. According to the application no SAVs or shellfish were observed within the project area. Current
water depths within the project area are -0' to-4' at NLW.
ESA:
The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest
North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project may
affect but is not likely to adversely affect the West Indian manatee. The use of the Manatee Guidelines would be required
as a condition of this proposed action.
The project will not affect any other species listed as threatened or endangered or their critical habitat formally designated
pursuant to the Endangered Species Act of 1973 (ESA) within the project area.
NHPA 106:
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and
the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and
records and the latest published version of the National Register of Historic Places, the Corps has preliminarily
determined that the proposed project will have no effect on cultural resources and requests concurrence from the State
Historic Preservation Office.
