PROJECT SUMMARY: Earth Resources proposes to install (3) 10,000 gallon fuel tanks with five dispensers, construct a 6' x 100' floating dock (paralleling a man-made canal), construct a 30' x 50' ships store with a 54' x 8' walkway and associated drain field, at the end of Bob Perry Road in Kitty Hawk, Dare County. PROJECT SETTING Earth Resources' property is located at the end of Bob Perry Road (SR 1210), along a man-made canal, off Kitty Hawk Bay, in Kitty Hawk, Dare County. The tract consists of 141.4 acres, with approximately 12.5 acres of high ground abutting a man-made canal (Loving Canal). The remainder of the property consists of a mix of 404 and coastal wetlands. Wetland vegetation on the property includes, but is not limited to, black needlerush (Juncos roemerianus), giant cord grass (Spartina cvnosuroides) and salt marsh cordgrass (Spartina alternaflora). Approximately 31.7 acres of the property is located within the Estuarine Shoreline Area of Environmental Concern (AEC), and of that approximately 4.6 acres is high ground. The high ground area on the tract forms a long narrow ridge approximately 4,400' long that begins at the end of Bob Perry Road (SR 1210), and runs in a southerly direction to Kittv Hawk Bay. Beginning on the south end, along Kitty Hawk Bay. an existing man-made canal parallels the high ground ridge on the west side for approximately 2,600'. On the north end of the high ground ridge is a stone, sand and soil distribution yard with associated offices, scales and access drives. Vehicular access to the site extends from Bob Perry Road (SR 1210) along the east side of the high ground ridge, and follows along the canal toward Kitty Hawk Bay. Barge traffic accesses the site via the canal, delivering raw material for the distribution yard. A rusting steel sheet pile bulkhead runs the length of the canal on the east side and a grounded barge is located at the end of the canal. The elevation of the high ground immediately adjacent to the canal is approximately six feet above normal water level measured at the bulkhead. Water depths in the canal average approximately nine-feet below normal water level. The property is in an AE Flood Zone with a Base Flood Elevation (BFE) of nine feet. In 1990, a CAMA Major Permit was issued to Alvis Beach and Outer Banks Contractors to maintenance dredge the man-made canal. On November 20, 1999, the permit was renewed and transferred to Earth Resources, Inc. Kitty Hawk Bay and its man-made tributaries, in this area, are classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Kitty Hawk Bay is SC (Fish Propagation). Review of available information suggests that there are no known archeological sites or geological formations associated with the applicant's property. Earth Resources Field Report March 6, 2000 Page 3 PROJECT DESCRIPTION All proposed development will be in areas with graveled surfaces currently being used to access the barge landing and stockpiled raw materials. Gravel drives are considered an impervious surface by the Division of Coastal Management. Therefore, the proposed development will result in no increases in impervious surfaces within the Estuarine Shoreline AEC. The applicant, Earth Resources, Inc., requests a CAMA Major Permit for the following improvements to their property: 1) to construct a one story ships store, eight feet from the adjacent man-made canal, with an open wooden deck and handicap access ramp adjacent to the canal, 2) a floating dock paralleling the bulkhead, adjacent to the ships store, 3) septic system with a forced main pipe. 4) reconfiguration of the existing drive to accommodate a 14 car parking lot. 5) installation of three 10,000 gallon fuel storage tanks within a masonry retention area. 6) install five fuel dispensers (two adjacent to the ships store along the canal and three in the east side of the tract adjacent to the fuel storage tanks): and. %) a 32 sf sign at the entrance of the canal identifying the fueling facility. Areas to be disturbed in conjunction with this project include the 30' x 50' (1,500 sf) ships store, with an 8' x 54' (432 sf) deck and a 4' x 20' (80 sf) ramp. The fuel storage tanks will be double wailed and will be placed above ground within a masonry retention area approximately 94' x 16' (1,504 sf ). The elevation of the fuel retention area will be between 10.0' and 10.05' above BFE, approximately one foot above the minimum established by Federal Insurance Rate Map (FIRM). Three fuel dispensers will be next to the storage tanks and will be placed on a small 4' x 16' (64 sf) pad. Two additional dispensers will be along the bulkhead on the north side of the ships store. Five 2' x 8' (80 sf) concrete barriers will be placed along the north side of the ships store to protect the fuel dispensers. Reconfiguration of the parking lot will include the placement of 14 wheel stops, a 60' x 5' (300 sf) landscaped island, a 8' x 20' (160 sf) concrete (or asphalt) pad for a handicap parking space, and a 9' x 12' (108 sf) dumpster pad. The proposed septic system will be approximately 850' north of the proposed ships store and require the installation of approximately 205' of waste pipe within the Estuarine Shoreline AEC. Installation of the pipe will result in the excavation and fill of approximately 410 sf of Estuarine shoreline. A 6' x 100' (600 sf) floating dock is proposed for boat traffic to use the store and the fueling facility. The final phase of the development includes the placement of a 32 sf sign on the southern end of the property, within twenty feet of Normal Water Level (NWL), at the mouth of the canal. Earth Resources Field Report March 6, 2000 Page 4 A CAMA Minor Permit was issued for the fuel tanks in 1999, by the Town of Kitty Hawk. Subsequent to issuing the permit the property owners voluntarily returned the permit and withdrew their claim to submit a Major Permit to cover all proposed improvements. ANTICIPATED IMPACTS 1) The floating dock will shade 600 feet of Estuarine and Public Trust Water. 2) Approximately 4,751 square feet of high ground will be disturbed. 3) The proposed improvements will draw public use to a heavily used commercial barge landing where raw materials are offloaded. 4) The proposed use creates a potential point of entry for fuel to Estuarine Waters. where none previously existed. 5) Navigation hazards will increase in the canal from the combined use by large commercial barges offloading raw materials and small vessels reaching the ships store and fuel facility. 6) Increased use of the high ground access by customers going to the ship's store, and large commercial trucks hauling stone, gravel and dirt will increase vehicular hazards on the applicant's property. 7) The addition of the proposed business will result in an increase in densitv on the property, and the intensity of use. '230G Project Narrative Dear Ms. Mathis, The following is a narrative summary of the proposed project. The subject site is a 141.-1 acres tract of land located at the terminus of Bon PerrnRoad SR 1=1UI in Kittv Hawk, Dare County, North Carolina. The approximate coordinates of the subiect site are 30 0 "N and 75? -13' 17"W. The north end of the subiect property is currently developed with a stone, sand and soil distribution yard and associated drive area. scales and office trailers. A ?_,ravel drive extends to the south end of the subject property adjacent to a manmade canal which connects the interior of the property with Kitty Hawk Bav. A steel sheetpile bulkhead extends the Length of the east side of the canal. Maintenance dredging has been approved within the canal under renewal of CAMA )laior Pernut X137-90, on November 30, 1999. The canal provides barge traffic access to the interior of the property tk? off-load soil, sand. Lravel and other landscape or roadwav construction materials. These are the oni? areas of the subiect property developed or in-use at the present time. Other areas within the suniect tract are primarily wetlands and coastal marsh. Access ro the subiect :?ropert% is from Bob Pem Roau to the north or the manmade canal to the south. The proposed development upon the subject tract of land is a 30 foot by 50 foot ships store, fuel stora_e and dispensers, parking area, floating dock and a drainfield to serve the new building. The intent of this activity is to provide fuel sales to vessels within the area waterways. The nearest, similar fueling facility is located in Colington Harbor and does not maintain regular hours of operation. As shown on the scaled site plan attached, access to vessels from the fuel pump area will be achieved by construction of a hinged ramp from the top of the steel bulkhead to the floating dock. Fuel will be stored in double walled above ground storage tanks and piping will be buried underground. Prior to operation, all applicable local, state and federal permits and inspections associated with fuel storage will be obtained. The proposed property improvements will primarily involve construction on land. Floating dock will be constructed on land and placed into the canal. Pilings will be hydraulically "jetted" into place along the west side of the floating dock to provide stability. The proposed facility is to be manned by trained personnel throughout the summer months during daylight hours.
