requirements of the 401 Water Quality Certification issued for the subject project.
This receipt serves as notification that the compensatory mitigation requirements
for this project have been satisfied. Please note that you must also comply with all
other conditions of this certification and any other state, federal or local
government permits or authorization associated with this activity.
The NCWRP, by acceptance of this payment, acknowledges that the
NCWRP is responsible for the compensatory mitigation requirements associated
with this project and agrees to provide the compensatory mitigation as specified.
As specified, the NCWRP will restore 260 linear feet of stream in Subbasin
030619 of the Cape Fear River basin.

Wetlands Restoration Program for stream mitigation. Your letter stated that you intended to pay within three
months of the date of the letter (i.e. in and around January 31, 2001). To date we have received no record of
payment for this mitigation. If your payment is not received in full by March 31, 2001 we will be forced to
revoke your 401 Water Quality Certification and/or proceed with enforcement for the violation of the condition

For accounting purposes, this Certification authorizes the fill of 260 feet of streams, in 030619 river and
subbasin and 260 linear feet of stream restoration are required. Please be aware that the Wetland Restoration
Program (WRP) rules require rounding of acreage amounts to one-quarter acre increments (15A 2R.0503(b)).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in
260 feet of streams for the purpose of constructing an industrial expansion at SR 1341 near Warsaw NC in Durham
County, as you described in your application received March 6, 2000. After reviewing your application, we have decided
that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use
Nationwide Permit Number 260 when the Corps of Engineers issues it. In addition, you should get any other federal, state
or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This
Certification replaces one issued to you on June 27, 2000.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application for a new
certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is
thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed
one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be
valid, you must follow the conditions listed in the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters to notify the
state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30
days of the date of this letter or the issuance of the 404 Permit (whichever is later).
2. An additional condition is that a final, written stormwater management plan shall be approved by this
Office before the impacts specified in this Certification occur. The stormwater management plan
must include plans and specifications for stormwater management facilities designed to remove 85%
TSS according to the most recent version of the NC DENR Stormwater Best Management Practices
Manual. Also, before any permanent building is occupied at the subject site, the stormwater
management facilities, as approved by this Office, must be constructed and operational, and the
stormwater plan, as approved by this Office, shall be implemented.
We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for
these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R .0402, this contribution will satisfy our
compensatory mitigation requirements under 15A NCAC 2H .0506(h). According to 15A NCAC 2H .0506(h), feet of
restoration will be required. Until the Wetland Restoration Program receives and clears your check (made payable to:
DENR - Wetland Restoration Program), wetland or stream fill shall not occur. Mr. Ron Ferrell should be contacted at
919-733-5083 ext. 358 if you have any questions concerning the Wetland Restoration Program. You have until October
31, 2000 to make this payment.

WASTEWATER SYSTEM APPROVED FOR
PROPOSED DUPLIN COUNTY HOG PROCESSING FACILITY
RALEIGH - A proposed Duplin County hog processing facility has been given state approval to operate a wastewater
system, but it still may need local zoning approval before opening.
Owned by S&J Villari Livestock of Warsaw, Southern Packing was today permitted to run a 45,000-gallon per day spray
irrigation treatment and disposal system off Penny Branch Road. The 35-year-old plant, which has not been. operational for a
number of years, is being upgraded to a 10,800-square-foot facility designed to handle about 1,000 hogs daily.
Tommy Stevens, director of the Division of Water Quality, said issuance of the agency's 5-year nondischarge permit
does not preclude the company from having to meet applicable local, state and federal regulations. The facility also has to get
a National Pollutant Discharge Elimination System stormwater permit from DWQ because its is deemed an industrial facility
under federal regulations.
Southern Packing will have to comply with zoning requirements for the Town of Warsaw, according to comments
local officials made Dec. 14, 1999 at a public meeting DWQ held on the permit application and in follow-up communication.
Those officials stated that the facility is located in Warsaw's 1-mile extraterritorial jurisdiction, which reportedly restricts such
types of operations.
The company plans to process hogs that range in weight from about 50 to 200 pounds each. Larger facilities, such as
Smithfield Fields of Tar Heel, slaughter finishing hogs that typically weigh about 250 pounds. Villari officials have previously
stated that they plan on catering to the smaller, independent growers.
Stevens said the land application system Southern Packing plans on using is preferable because no treated wastewater
will be discharged to a receiving stream.
"None of their wastewater is to reach surface waters, and their effluent will be treated and disinfected before it is land
applied," he said. "We've put tight monitoring requirements on them for stream quality and ground water. They'll also have to
modify their irrigation system to meet standards."
DWQ today also issued Villari a 401 wetlands certificate for altering a 260-foot stream that leads to Turkey Creek. The
company, which inappropriately filled the unnamed tributary last year, will have to replace or restore the stream's function either
on-site or elsewhere in the same general watershed area.
In December 1999, DWQ found that Villari had constructed most of its wastewater treatment system without first
obtaining the required water quality permit. The Division fined the company $14,420 in April for building without such a permit
and for affecting surface water use. Villari has since paid the fine.

Dear Mr. Dorney:
This letter is in response to your office's request for alternatives analysis for 401 Certification for
Southern Packing's after-the-fact permit application that has received the 404 permit from the
United States Army Corps of Engineers ("USACOE").
Mr. Villari indicates several alternatives were considered to the proposed culverting of the
unnamed tributary:
1. No action, which would involve immediate and continued sedimentation and pollution to
the unnamed tributary;
2. Placing fill material in the tributary, which would prevented the natural flow of the
tributary; and
3. Movin; to a different site, which was not feasible;
Mr. Villari culverted only that portion of the tributary required to prevent project activity from
causing continued and future sedimentation, erosion, tu,u puiiution that would directly affect the
unnamed tributary.
Mr. Villari understands mitigation is required and is willing to purchase credits from an
established mitigation bank or form the State's Wetland Restoration Group.

REASONS FOR PUTTING A CULVERT IN AT SOUTHERN PACKING
PROCESSING PLANT
1. SAFETY
• ENVIRONMENTAL SAFETY - PLANT AND PLANT WASTE
TREATMENT SYSTEM WOULD BORDER THE STREAM. WITH A
CULVERT IN PLACE, THIS WOULD NOT ALLOW ANY
UNINTENTIONAL SPILLS TO ENTER THE STREAM.
• EMPLOYEE SAFETY - FROM THE PARKING LOT LOCATION, THE
EMPLOYEES WOULD HAVE TO WALK ON THE ROAD TO ENTER
THE PLANT.
• TRUCK TRAFFIC -- TO ENABLE US TO EXPAND OUR DRIVEWAYS,
IT WOULD ALLOW TRUCKS TO ENTER AND EXIT SAFER DUE TO A
CURVE IN THE ROAD APPROXIMATELY 600 FEET EAST OF THE
PLANT. THE TRUCKS WOULD NOT HAVE TO BACK DIRECTLY OFF
THE ROAD, INSTEAD THEY COULD PULL IN AND TURN AROUND
ON THE PROPF,RTY.

• THREE PARTS OF THE CULVERT WILL BE PAVED SO TRUCKS CAN
BACK UP NEXT TO THE PLANT FOR UNLOADING RAW MATERIALS
AND LOADING THE FINISHED PRODUCT.
• CULVERT BORDERS THE ENTIRE EAST SIDE OF THE PLANT.
BECAUSE OF UNAVAILABLE LAND ON THE WEST SIDE OF TIIE
PLANT, THE ONLY EXPANSION IS ON TILL EAST SIDE OF THE

III. STORMWATER AND SEDIMENTATION
• THE CULVERT WILL ALLOW US TO BETTER PREVENT
SURROUNDING GROUNDWATER FROM FLOWING DIRECTLY INTO
THE STREAM. IT WILL ALLOW WATER TO SHEET FLOW TO THESE
AREAS.
• BY ALLOWING US TO ELEVATE SOIL OVER THE TOP OF THE
CULVERT, WE CAN BETTER PREVENT EROSION AROUND THE
SURROUNDING BUILDINGS.

INDICATE A PERMIT OF ANY TYPE WAS MANDATORY. PRIOR TO THF,
COMPLETION OF OUR PROJECT, THE SAME TYPE OF WORK WAS
COMPLETED ON THE PROPERTY OF THE FIRST HOUSE WEST OF OUR
PLANT. I BELIEVE THF, DEPARTMENT OF TRANSPORTATION PROVIDED
THE LABOR AND EQUIPMENT; THE RESIDENT SUPPLIED THE PIPE.

The Division of Water Quality has reviewed your plans for the discharge of fill material into 260
linear feet of streams located at NC 1341 near Warsaw, NC in Duplin County for industrial expansion as
described in your application dated February 29, 2000. Insufficient evidence is present in our files to
conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A
NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will
have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place
this project on hold as incomplete until we receive this additional information, we are requesting (by copy
of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you provide mitigation and on-site stormwater management for the new
development? Any documentation such as maps and narrative that you can supply to address alternative
designs for your project may be helpful in our review of your 401 Certification. Also this project will
require stream compensatory mitigation as described in 15A NCAC 2H .0506(h). Your mitigation proposal
is insufficient because none was proposed.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and to the Joanne Steenhuis, Wilmington Regional Office at (910) 395-3900. If we do not hear from you
in three weeks, we will assume that you no longer want to pursue this project and we will consider the

Dear Mr. Dorney:
Mitchell & Associates, Inc. would like to submit an application for placement of fill material
within wetlands on behalf of Southern Packing, Inc. The subject property is located north of
NCSR 1341, approximately 2000' northwest of the junction of NCSR 1341 and NCSR 1340,
near the town of Warsaw, Duplin County, North Carolina.
The applican"as place 54" galvanized pipe in approximately 260' of an unnamed tributary
of Turkey Creek, and with the accompanying fill material, impacted approximately 0.0298
acres of jurisdictional wetlands. My client was unaware of the requirement to obtain a 401
certification at the time of this activity, and as a result, is submitting this application "after the
fact".
During the implementation of this activity, my client took efforts to ensure that additional
sediment did not enter the remaining portion of the creek, or any area other than that
required for the expansion of his existing business was adversely impacted.
The U.S. Army Corps of Engineers has also been provide with copies of this completed
construction notification.
By copy of this correspondence and completed construction notification, I am requesting that
you grant my client the necessary 401 certification in accordance with this Nationwide 26
permit request, Thank you for your time and consideration of this matter. If you have any
additional questions or comments, please fell free to give me a call.
