SAW-2011-00377 Mr. Cal Miller Shaw Hwy Properties, LLC 3907 Bowen Road Canal Winchester, Ohio 43110 Dear Mr. Miller: nrr 1 2018 This letter serves to confirm our evaluation of the March 2018 Year 4 monitoring report for the Northeast Cape Fear Umbrella Mitigation Bank (Bank) Holly Shelter Tract located northeast of Shaw Highway and NC Hwy 210 intersection, in the headwaters of an unnamed tributary to the Northeast Cape Fear River, near Rocky Point, Fender County, North Carolina. Also, please reference the Mitigation Banking Instrument (MBI) executed on June 5, 2013 and our March 7, 2017 credit release letter. In review of the vegetation and hydrology data, all results show that the success criteria has been met for the fourth year of monitoring. However, the hydrology Well #24 continues to be of a concern. This well is located in close proximity to the intersection of two ditches and it is recommended that you further assess the plug(s) near this location to ensure the structures are functioning properly. Additionally, it has been observed that the Zero Order Valley "A" (or North Valley) is experiencing encroachment by off -road vehicles, resulting in denuded shoulders. Currently, tape is being used to mark off the area in attempt to keep motorized vehicles from using the area. This measure is not adequate and more permanent measures must be implemented to prohibit vehicles from crossing this, or any other, zero order valley(s) and compromising the mitigation site. Please address this and provide our office with a summary of the measure(s) you are taking. Our office, in coordination with the Interagency Review Team (IRT), concurs that Task 6.0 in Tables 4A, 4B and 4C of the MBI has been fulfilled. The completion of this task results in the mitigation credit release of 10% (or 0.1 credit) of riparian non-riverine wetland credits, 10% (or 142 linear feet) of stream credits, and 10% (or 89.3 credits) of non -riparian wetland credits. To date, this brings the total release to 1.7 credits of riparian non-riverine wetlands, 1871 linear feet of stream credits, and 733.5 credits of non - riparian wetlands. These totals include all preservation credits shown in Table 4D of the MBI. Please be reminded of your obligations pursuant to the June 5, 2013 MBI; and to continue maintenance inspections of the armored ditch plugs and check dams within the Bank in order to evaluate the condition and stability of each structure in perpetuity.
