Both Mr. Todd St. John and Ms. Jennifer Frye are familiar with the site. The site is approximately 10 acres in area and is located on Westbrook Plaza Drive in Winston-Salem (Figure 1). The site is to be developed with a three story commercial building and associated parking areas. A 401 Water Quality Certification was issued for the project on February 22, 2000 (DWQ Project # 000253). A copy of this certification is included with this package. Tributaries of Little Creek cross the site. Approximately 294 linear feet of intermittent stream channel will be impacted by the construction of a stormwater pond. The stream will be diverted around the pond in order to avoid treating off-site stormwater in the pond. The intermittent stream channel will be graded during construction of the pond. The stream currently enters the site through a 30" RCP. The stream was designated as intermittent by Ms. Jennifer Frye of the North Carolina Division of Water Quality in October 1999. Approximately 147.5 linear feet of perennial stream channel will be impacted by the construction of a roadway/dam. In order to minimize the impact to the perennial portion of the stream, the roadway/dam have been combined. The proposed development is illustrated on the attached Grading and Erosion Control Plan prepared by Stimmel Associates, P.A. We are requesting a 401 Water Quality Certification for the impact to 294 linear feet of intermittent stream channel and 147.5 linear feet of perennial stream channel. As the impact to the perennial portion of the stream channel is less than 150 linear feet, we are not including a mitigation plan with this request. A stormwater management plan has been designed to remove 85 % total suspended solids. The intermittent stream on the site is very low quality. GA 30067 P.02 Dear Mr. Boldt: You have our approval, in accordance with the attached conditions and those listed below, to construct a pond and a road crossing which will impact a total of 452 feet of stream channel for the purpose of commercial construction in Forsyth County, as you described in your application received by the Division of Water Quality on February 11, 2000. After reviewing your application, we have decided that this action is covered by General Water Quality Certification Numbers 3103 and 3108. This certification allows you to use Nationwide Permit Numbers 14 and 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may he required as described in 15A NCAC ZH .0506 (h) (6) and (7). For this approval to be valid you must follow the conditions below and those listed in the attached certification. 1. An additional condition is that a final, written stormwater management plan shall be approved by this Office before the impacts specified in this Certification occur. The stormwater management plan must include plans and specifications for stormwater management facilities designed to remove 85% TSS according to the most recent version of the NC DENR Sturmwater Best Management Practices Manual. Also, before any permanent building is occupied at the subject site, the facilities, as approved by this Office, shall be constructed and operational, and the stortnwater management plan, as approved by this Office, shall be implemented. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. The site is to be developed with a three story commercial building and associated parking areas. A 401 Water Quality Certification was issued for the project on February 22, 2000 (DWQ Project # 000253). A copy of this certification is included with this package. Tributaries of Little Creek cross the site. Approximately 294 linear feet of intermittent stream channel will be impacted by the construction of a stormwater pond. The stream will be diverted around the pond in order to avoid treating off-site stormwater in the pond. The intermittent stream channel will be graded during construction of the pond. The stream currently enters the site through a 30" RCP. The stream was designated as intermittent by Ms. Jennifer Frye of the North Carolina Division of Water Quality in October 1999. Approximately 147.5 linear feet of perennial stream channel will be impacted by the construction of a roadway/dam. In order to minimize the impact to the perennial portion of the stream, the roadway/dam have been combined. The proposed development is illustrated on the attached Grading and Erosion Control Plan prepared by Stimmel Associates, P.A. We are requesting a 401 Water Quality Certification for the impact to 294 linear feet of intermittent stream channel and 147.5 linear feet of perennial stream channel. As the impact to the perennial portion of the stream channel is less than 150 linear feet, we are not including a mitigation plan with this request. A stormwater management plan has been designed to remove 85 % total suspended solids. The intermittent stream on the site is very low quality. The stream currently enters the site through a 30" RCP. The stream was designated as intermittent by Ms. Jennifer Frye of the North Carolina Division of Water Quality in October 1999. Approximately 147.5 linear feet of perennial stream channel will be impacted by the construction of a roadway/dam. In order to minimize the impact to the perennial portion of the stream, the roadway/dam have been combined. The proposed development is illustrated on the attached Grading and Erosion Control Plan prepared by Stimmel Associates, P.A. We are requesting a 401 Water Quality Certification for the impact to 294 linear feet of intermittent stream channel and 147.5 linear feet of perennial stream channel. As the impact to the perennial portion of the stream channel is less than 150 linear feet, we are not including a mitigation plan with this request. Both Mr. Todd St. John and Ms. Jennifer Frye are familiar with the site. The site is approximately 10 acres in area and is located on Westbrook Plaza Drive in Winston-Salem (Figure 1). The site is to be developed with a three story commercial building and associated parking areas. A 401 Water Quality Certification was issued for the project on February 22, 2000 (DWQ Project # 000253). A copy of this certification is included with this package. Tributaries of Little Creek cross the site. Approximately 294 linear feet of intermittent stream channel will be impacted by the construction of a stormwater pond. The stream will be diverted around the pond in order to avoid treating off-site stormwater in the pond. The intermittent stream channel will be graded during construction of the pond. The stream currently enters the site through a 30" RCP. The stream was designated as intermittent by Ms. Jennifer Frye of the North Carolina Division of Water Quality in October 1999. Approximately 147.5 linear feet of perennial stream channel will be impacted by the construction of a roadway/dam. In order to minimize the impact to the perennial portion of the stream, the roadway/dam have been combined. The proposed development is illustrated on the attached Grading and Erosion Control Plan prepared by Stimmel Associates, P.A. We are requesting a 401 Water Quality Certification for the impact to 294 linear feet of intermittent stream channel and 147.5 linear feet of perennial stream channel. As the impact to the perennial portion of the stream channel is less than 150 linear feet, we are not including a mitigation plan with this request. A stormwater management plan has been designed to remove 85 % total suspended solids. The intermittent stream on the site is very low quality. Approximately 147.5 linear feet of perennial stream channel will be impacted by the construction of a roadway/dam. In order to minimize the impact to the perennial portion of the stream, the roadway/dam have been combined. We are requesting a 401 Water Quality Certification for the impact to 294 linear feet of intermittent stream channel and 147.5 linear feet of perennial stream channel. After reviewing your application, we have decided that this action is covered by General Water Quality Certification Numbers 3103 and 3108. This certification allows you to use Nationwide Permit Numbers 14 and 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
