APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Andrews:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 100 linear feet of
streams for the purpose of constructional road crossings at Duncan Creek Estates as described in your application dated January 26, 2000.
After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This
certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other
federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If you change
your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a
copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project
(now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below.
I. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order
to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this
letter or the issuance of the 404 Permit (whichever is later).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of
the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions,

in this Certification occur. The stormwater management plan must include plans and specifications for stormwater management Iacihucti
designed to remove 85% TSS according to the most recent version of the NC DENR Storrmvurer Best Murtagement Pru(tires 'Manual.
Also, before any permanent building is occupied at the subject site, the facilities, as approved by this Office, shall be constructed and
operational, and the stormwater management plan, as approved by this Office, shall be implemented.

Comments:
I inspected the Duncan creek Estate property on March 8 , 2000 in the company of Hutch Kerns. The
unnamed tributary to Duncan is approximately 18 inches wide and approximately 1 inch deep. It has
a stable wooded bank- The stream bottom is sand. No fi sh were observed and are probably not
present date to the small size of the stream. The water w as very clear. The proposed
crossing would consist of two section of 48" diameter cul vert, each 20' long. At the proposed lower
crossing an existing culvert made of old oil drums exist. The lower crossing might end up tg the
same amount of culvert material as the upper,

Subject: Pre-Construction Notification Application (PCN) - Duncan Creek Estates Subdivision
Dear Mr. Baker,
Our office has recently become involved with the development of a residential community outside of
Fletcher, North Carolina in the Hoopers Creek area. The proposed subdivision will consist of 24
residential lots accessed by a 1480' roadway with a cul-de-sac at the end.
The site encompasses 32.2 acres within Henderson County. The permit area and proposed roadway
/stream crossing will result in the disturbance of approximately 100' (400 s.f in area, assuming average
stream width of 4') of a stream flowing into Duncan Creek (which is the southern property boundary).
Duncan Creek flows east along the southern property boundary into Hoopers Creek and Cane Creek and
eventually into the French Broad River. We are proposing impacting 60' of creek for the subdivision
roadway and 40' of creek for the driveway (two separate areas of the creek - see plans).
A site location map, the proposed subdivision master plan, a typical culvert section and 2 copies of the
PCN application have been included per your request. Please call if you should have questions. Thank
