After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112 In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre or total perennial stream fill exceeds 150 feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. FIELD INVESTIGATION REPORT: Ingram, Brown, and Fountain Page 2 9. NARRATIVE DESCRIPTION: The project site is a .27 acre vacant tract located adjacent to the New River at Lots 11 and 13 Bluff Street, in the City of Jacksonville. The western lot has been used for parking, and has little vegetation, most of which is typical of high ground grasses and trees. This lot is stabilized with a traditional bulkhead wall. The eastern lot is vegetated with transitional vines and shrub scrub vegetation, with designated Section 404 Wetlands consisting of Smilax W., Taxodium distichum, and Liauidambar styraciflua. Coastal marsh occurs nearest the river, consisting of Typha spp. and Spartina Cynosuroides. The property averages +11' msl in elevation. This property is owned by four partners, and is used for the docking of and access to their boats. On the western lot, and extending across the riparian corridor of the eastern lot, is a four slip dock which was authorized under CAMA General Permit 18459-C. The New River at the project site is ±390' across, approximately 4 nlw at the shore and -7'4" nlw at the dock terminus. The property is serviced by municipal water and sewer. The Jacksonville Land Use Plan classifies this area as Developed, with all AEC's classified as Conservation. This portion of the New River is closed to the taking of shellfish for consumption; the river carries a water quality classification of SB; the area is designated by the Division of Marine Fisheries as Primary Nursery Area. The property width is 140'±. The applicants propose to stabilize the eastern lot by connecting with the wall to the west, and following the delineated Section 404 Wetland line for the first 73', continuing another 47' to connect into the wall to the east. This will require the filling of ±460 sf of the above mentioned wetlands. No coastal marsh is within this alignment. The applicant has not attempted to recover the wetland portion of his property except in this area, which he felt was necessary to keep existing trees that are helping to stabilize the site. The purpose of the bulkhead is not only to stabilize the property, but to protect the street, which is beginning to show signs of subsidence, from future erosion. The proximity of the wetland escarpment to the road is ±40'. The total bulkhead length is 120'. The applicants are also proposing to increase the size of the docking facility from 4 slips to 6 slips. The specific design will remove 4 existing pilings, and add 2 on either side for the new slips. The parallel dock will be extended to each side, 15' x 3.2', with a finger dock on each end, 22' x 3'. The structure will extend to 3.15' from the adjacent riparian corridor line to the west (waiver on file), and will terminate 43' from the corridor to the east. The total decked area existing and proposed associated with this dock is 484 sf. There is a grandfathered structure over the water on the property to the east of the project site, which interferes with the riparian corridor of this property. Both property owners have worked around this, and it does not appear to be an issue. No portion of the structure will extend waterward of the existing facility. The project is intended to serve a private use. 10. ANTICIPATED IMPACTS: As proposed, this project will require approximately 300 cubic yards of material to fill 4000 sf of high ground and 460 sf of Section 404 Wetlands. The Public Trust Area incorporation posed by Ingram, Brown, and Fountain Page 3 the enlargement of the docking system will be approximately 2176 sf, with 228 sf of this in decking coverage (total decked area with existing will be 484 sf). The structure will allow for the dockage of 2 additional vessels, for a total of 6 boats. Water depths and water body width should support this use without additional ongoing impacts. PROJECT SUMMARY: Applicant proposes to construct a bulkhead requiring the filling of 460 square feet of Section 404 Wetlands, and to expand a 4 slip private dock into a 6 slip dock. NARRATIVE DESCRIPTION: The project site is a .27 acre vacant tract located adjacent to the New River at Lots 11 and 13 Bluff Street, in the City of Jacksonville. The western lot has been used for parking, and has little vegetation, most of which is typical of high ground grasses and trees. This lot is stabilized with a traditional bulkhead wall. The eastern lot is vegetated with transitional vines and shrub scrub vegetation, with designated Section 404 Wetlands consisting of Smilax spp., Taxodium distichum, and Liquidambar styraciflua. Coastal marsh occurs nearest the river, consisting of Typha W. and Spartina Cynosuroides. The property averages +11' msl in elevation. This property is owned by four partners, and is used for the docking of and access to their boats. On the western lot, and extending across the riparian corridor of the eastern lot, is a four slip dock which was authorized under CAMA General Permit 18459-C. The New River at the project site is ±390' across, approximately 4 nlw at the shore and -7'4" nlw at the dock terminus. The property is serviced by municipal water and sewer. The Jacksonville Land Use Plan classifies this area as Developed, with all AEC's classified as Conservation. This portion of the New River is closed to the taking of shellfish for consumption; the river carries a water quality classification of SB; the area is designated by the Division of Marine Fisheries as Primary Nursery Area. The property width is 140'±. The applicants propose to stabilize the eastern lot by connecting with the wall to the west, and following the delineated Section 404 Wetland line for the first 73', continuing another 47' to connect into the wall to the east. This will require the filling of ±460 sf of the above mentioned wetlands. No coastal marsh is within this alignment. The applicant has not attempted to recover the wetland portion of his property except in this area, which he felt was necessary to keep existing trees that are helping to stabilize the site. The purpose of the bulkhead is not only to stabilize the property, but to protect the street, which is beginning to show signs of subsidence, from future erosion. The proximity of the wetland escarpment to the road is ±40'. The total bulkhead length is 120'. The applicants are also proposing to increase the size of the docking facility from 4 slips to 6 slips. The specific design will remove 4 existing pilings, and add 2 on either side for the new slips. The parallel dock will be extended to each side, 15' x 3.2', with a finger dock on each end, 22' x 3'. The structure will extend to 3.15' from the adjacent riparian corridor line to the west (waiver on file), and will terminate 43' from the corridor to the east. The total decked area existing and proposed associated with this dock is 484 sf. There is a grandfathered structure over the water on the property to the east of the project site, which interferes with the riparian corridor of this property. Both property owners have worked around this, and it does not appear to be an issue. No portion of the structure will extend waterward of the existing facility. The project is intended to serve a private use. 10. ANTICIPATED IMPACTS: As proposed, this project will require approximately 300 cubic yards of material to fill 4000 sf of high ground and 460 sf of Section 404 Wetlands. The Public Trust Area incorporation posed by Ingram, Brown, and Fountain Page 3 the enlargement of the docking system will be approximately 2176 sf, with 228 sf of this in decking coverage (total decked area with existing will be 484 sf). The structure will allow for the dockage of 2 additional vessels, for a total of 6 boats. Water depths and water body width should support this use without additional ongoing impacts. PROJECT SUMMARY: Applicant proposes to construct a bulkhead requiring the filling of 460 square feet of Section 404 Wetlands, and to expand a 4 slip private dock into a 6 slip dock. FIELD INVESTIGATION REPORT: Ingram, Brown, and Fountain Page 2 9. NARRATIVE DESCRIPTION: The project site is a .27 acre vacant tract located adjacent to the New River at Lots I 1 and 13 Bluff Street, in the City of Jacksonville. The western lot has been used for parking, and has little vegetation, most of which is typical of high ground grasses and trees. This lot is stabilized with a traditional bulkhead wall. The eastern lot is vegetated with transitional vines and shrub scrub vegetation, with designated Section 404 Wetlands consisting of Smilax sM., Taxodium distichum, and Liquidambar styraciflua. Coastal marsh occurs nearest the river, consisting of Typha W. and S artina Cynosuroides. The property averages +11' msl in elevation. This property is owned by four partners, and is used for the docking of and access to their boats. On the western lot, and extending across the riparian corridor of the eastern lot, is a four slip dock which was authorized under CAMA General Permit 18459-C. The New River at the project site is ±390' across, approximately -4' nlw at the shore and -74" nlw at the dock terminus. The property is serviced by municipal water and sewer. The Jacksonville Land Use Plan classifies this area as Developed, with all AEC's classified as Conservation. This portion of the New River is closed to the taking of shellfish for consumption; the river carries a water quality classification of SB; the area is designated by the Division of Marine Fisheries as Primary Nursery Area. The property width is 140'±. The applicants propose to stabilize the eastern lot by connecting with the wall to the west, and following the delineated Section 404 Wetland line for the first 73', continuing another 47' to connect into the wall to the east. This will require the filling of ±460 sf of the above mentioned wetlands. No coastal marsh is within this alignment. The applicant has not attempted to recover the wetland portion of his property except in this area, which he felt was necessary to keep existing trees that are helping to stabilize the site. The purpose of the bulkhead is not only to stabilize the property, but to protect the street, which is beginning to show signs of subsidence, from future erosion. The proximity of the wetland escarpment to the road is ±40'. The total bulkhead length is 120'. The applicants are also proposing to increase the size of the docking facility from 4 slips to 6 slips. The specific design will remove 4 existing pilings, and add 2 on either side for the new slips. The parallel dock will be extended to each side, 15' x 3.2', with a finger dock on each end, 22' x 3'. The structure will extend to 3.15' from the adjacent riparian corridor line to the west (waiver on file), and will terminate 43' from the corridor to the east. The total decked area existing and proposed associated with this dock is 484 sf. There is a grandfathered structure over the water on the property to the east of the project site, which interferes with the riparian corridor of this property. Both property owners have worked around this, and it does not appear to be an issue. No portion of the structure will extend waterward of the existing facility. The project is intended to serve a private use. 10. ANTICIPATED IMPACTS: As proposed, this project will require approximately 300 cubic yards of material to fill 4000 sf of high ground and 460 sf of Section 404 Wetlands. The structure will allow for the dockage of 2 additional vessels, for a total of 6 boats. Water depths and water body width should support this use without additional ongoing impacts.
