After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed below and in the attached certification. 1. Adequate sedimentation and erosion control measures must be implemented prior to any ground-disturbing activities. Structures should be inspected and maintained regularly, especially following rainfall events, to minimize impacts to downstream aquatic resources. 2. To minimize temperature impacts to downstream water, the pond outflow pipe should be designed to draw water from near the bottom of the pond. This will also prevent buildup of poorly oxygenated water and improve water quality in the pond. 3. When filling the pond, residual flow in the stream below the dam must be of sufficient magnitude to prevent destruction or serious diminution of downstream aquatic resources. This can be accomplished by partially opening the gate valve during the filling process. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. Davis, Mountain Region Coordinator Aja Habitat Conservation Program DATE: February 5, 1999 SUBJECT: Robin Smith Dam Unnamed Tributary to Little Fall Creek Polk County, North Carolina This memorandum responds to the subject dam safety permit application. The North Carolina Wildlife Resources Commission (NCWRC) has reviewed the proposed project, and an onsite investigation was conducted on February 5, 1999, to determine habitat quality in the project area. These comments are provided in accordance with provisions of the North Carolina Dam Safety Law of 1967. The proposed work involves construction of a large dam on an unnamed headwater tributary to Little Fall Creek to provide a lake (approximately 5 acres) for private recreation. While the affected stream is a tributary to trout waters, flow and available fish habitat is limited in the project area. However, we are concerned that the available water supply may not be sufficient to maintain the lake at full pool, especially during the low flow months. The applicant should consider reducing the size of the lake to ensure adequate elevations and water exchange rates throughout the year. The addition of a cold water release structure will greatly improve water quality within the lake and provide cooler water to downstream habitats. We have no objection to the issuance of a dam safety permit; however, we anticipate that a 404 permit from the U. S. Army Corps of Engineers (COE) will be required for this project. To comply with our recommendations under the anticipated 404 permit, the applicant must incorporate the following provisions into project design: Robin Smith Dam Page 2 February 5, 1999 1. Because Polk County is recognized as a "trout water county" by the COE, the NCWRC will review any nationwide or general 404 permits for this project.
