Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to replace a culvert which
will impact 96 feet of Beech Creek for the purpose of commercial construction in Surry County, as you described in your
application received by the Division of Water Quality on February 9, 2000. After reviewing your application, we have
decided that this action is covered by General Water Quality Certification Number 3103. This certification allows you to use
Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying
404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. • If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in
15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions.listed in the attached
certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Dear Mr. Boyles:
Please reference the site inspection of September 12, 1994,
conducted by Mr. John Thomas of the Raleigh Regulatory Field
office at the proposed City of Mount Airy industrial park located
off U.S. 601, adjacent to an unnamed tributary of Stewarts Creek
and Beech Creek, west of Mount Airy, Surry County, North
Carolina. The purpose of this inspection was to review draft
plans for the new access road provided by Mr. John Grey of Grey
Engineering, and to inspect the site for waters and wetlands
subject to Department of the Army permitting authority.
Plan review and site inspections showed two single complete
crossing of waters of the United States. The first was a bank to
bank jurisdiction of an unnamed tributary of Stewarts Creek and
the second was a bank to bank jurisdiction of Beech Creek. The
site inspections showed that the proposed road crossings are
located adjacent to the identified tributaries and impact only
unvegetated waters of the United States (does not include any
impacts to special aquatic sites).
For the purposes of the corps of Engineers' Regulatory
Program, Title 33, Code of Federal Regulations (CFR), Part 330.6,
published in the Federal Register on November 22, 1991, lists
nationwide permits. Authorization, pursuant to Section 10 of the
-` Rivers and Harbors Act of 1899 and Section 404 of the Clean Water

Act, was provided for fills for roads crossing waters of the
United States (including wetlands and other special aquatic
sites) provided:
a. The width of the fill is limited to the minimum necessary
for the actual crossing;
b. The fill placed in waters of the United States is limited
to a filled area of no more than one-third acre. Furthermore, no
more than a total of 200 linear feet of the fill for the roadway
can occur in special aquatic sites, including wetlands;
C. The crossing is culverted, bridged or otherwise designed
to prevent the restriction of, and to withstand, expected
highflows and the movement of aquatic organisms;
d. The crossing, including all attendant features, both
temporary and permanent, is part of a single and complete project
for crossing of a water of the United States; and
e. For fills in special aquatic sites, including wetlands,
the permittee notifies the District Engineer (DE) in accordance
with the "Notification" general condition.
(Your work is authorized by this nationw a perm provided it
is accompM9n s rict accordance with the en osed
conditions. This nationwide permit does not relieve you of the
responsibility to obtain other required State or local approval.
This verification will be valid for two years from the date
of this letter unless the nationwide authorization is modified,
reissued or revoked. This verification will remain valid for the
two years if, during that period, the nationwide permit
authorization is reissued without modification or the activity
complies with any subsequent modification. If during the two
years, the nationwide permit authorization expires or is

suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the
nationwide permit, activities which have commenced or are under
contract to commence, in reliance upon the nationwide permit,

completed within twelve months of the date of the nationwide
permit's expiration, modification or revocation.

GENERAL CONDITIONS

1.. Navigation. No activity may cause more than a minimal adverse effect on
navigation.
2. Proper MaintenanCe. Any structure or fill authorized shall be properly
maintained, including maintenance to ensure public safety.
3. Erosion ante Siltation Controls. Appropriate erosion and siltation
controls must be used and maintained in effective operating condition during
construction, and all exposed soil and other gills must be permanently
stabilized at the earliest practicable date.
4. Aquatic Life Novenients. No activity nay substantially disrupt the
movement of those species of aquatic life indigenous to the waterbody,
including those species which normally migrate through the area, unless the
activity's primary purpose is to impound water.
5. Equiyment. Heavy equipment working in wetlands must be placed on mats or
other measures must be taken to minimtze soil disturbance.
6. Regional and Case-by-case Conditions. The activity must comply with any
regional conditions which may have been added by the Division Engineer and any
case specific conditions added by the Corps.
7. Wild and Scenic Rivers. No activity may occur in a component of the
National wild and Scenic River System] or in a river officially designated by
congress as a -study river" for possible inclusion in the system, while the
river is in an official study status. Information on Wild and Scenic Rivers
may be obtained from the National Park Service and the U.S. Forest Service.
S. Tribax Rights. No activity or its operation may impair reserved tribal
rights, including, but not limited to, reserved water rights and treaty
fishing and hunting rights.
9. Water Quality Certification. In certain states, an individual state
water quality certification must be obtained or waived.
ld. Coastal Soae Usnageeaut. In certain states, an individual state coastal
zone Management consistency concurrence must be obtained or waived.
11. Endangered speesios. No activity is authorized under any NWP which is
likely to jeopardise the continued existence of a threatened or endangered
species or a species proposed for such designation, as identified under the
Federal 8ndangered Species Act, or which is likely to destroy or adversely
modify the critical habitat of such species. Non-Federal permittees shall
notify the District Engineer if any listed species or critical habitat might
be affected or is in the vicinity of the project and shall not begin work on

12. Historic Properties. No activity which may affect Historic Properties
listed, or eligible for listing, in the National Register of Historic Places
is authorized, until'the District Engineer has complied with the provisions of
33 CPR 325, Appendix C. The prospective permittee must notify the District
Engineer if the authorized activity may affect any historic properties listed,
determined to be eligible, or which the prospective
believe may be eligible for listing on the National Register sofafistoric to
Places, and shall not begin the activity until notified by the District
Engineer that the requirements of the National Historic Preservation Act have
been satisfied and that the activity is authorized. Information on the
location and existence of historic resources can be obtained from the State
Historic Preservation Office and the National Register of Historic Places (see
33 CPR 330.4(g)).
13. Notification.
a. Where required by the terms of the NW, the prospective permittee must
notify the District Engineer as early as possible and shall not begin the
activity:
(1) until notified by the District Engineer that the activity may
proceed under the IM with any special conditions imposed by the District or
Division Engineer; or
(2) if notified by the District or Division Engineer that an

This office has reviewed the subject sedimentation and erosion control plan. We find
the plan to be acceptable and hereby issue this letter of approval.. This plan approval shall
expire three (3) years following the date of approval, if no land-disturbing activity has been
undertaken, as is required by Title 15A NCAC 4B .0029.
Be advised that Title 15 NCAC 4B.001 7(a) requires that a copy of the approved
erosion control plan be on file at the job site. Also, you should consider this letter to give
the Notice required by GS 113A 61(d) of our right of periodic inspection to insure
compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Program is performance oriented,
requiring protection of the natural resources and adjoining properties. If following
commencement of this project it is determined that the plan is inadequate to meet the
requirements of the Sedimentation and Pollution Control Act of 1973 (North Carolina
General Statute 113A-51 through 66), this office may require revisions to the plan and its
implementation of the revisions to insure compliance with the Act.
Please note that this approval is based in part on the accuracy of the information
provided in the Financial ResponsMity Form which you have provided. You are requested
to file an amended form if there is any change in the information included on the form. In
addition, it would be helpful if you notify this office of the proposed starting date for this
project. Please notify us if you plan to have a preconstruction conference, we will plan to
attend.
"The land-disturbing activity described in this plan may be subject to the
approval of other Local, State or Federal agencies. This could include the
Division of Water Quality under stormwater or water quality regulations,
the U.S. Army Corps of Engineers under Article 404 jurisdiction, county,
city or town agencies under other local ordinances, or other approvals that
may be required. This approval cannot supersede any other permit or

1. Rock check dams and temporary silt basins (details attached) shall be in stalled at 50-foot
intervals in Temporary Diversions A, B, C, D, #10 and #11, and Ditch #7.
2. Silt fence shall be installed just behind the top of the end walls of the double 96-inch culvert.
3. The outlet of Culvert #1 (Sheet ES2A) shall be stabilized with riprap before diverting flow
through the culvert.
4. The emergency spillway of the Sediment Basin (Sheet ES5) must be located in natural ground
on the west side of the basin, = over the embankment.
5. The proposed 8-inch sewer line below the sediment basin shall be stabilized with Class B
riprap where the discharge from the basin flows across the disturbed area of the sewer line.
6. An adequate rock check dam shall be placed across the natural swale at Shell Bldg. Access
Road, Sta. 7+00, right.
DOTE: Be advised that the above "Modifications Required for
Approval' are considered to be a part of the approved plan
unless an equally effective alternative is submitted to and
approved by this agency prior to beginning this land-disturbing

I have reviewed your proposed access road and new pump station sites with regard to the
Mount Airy Thoroughfare Plan and currently planned "transportation Improvement
Program (TIP) projects. The location of the proposed access road does not conflict with
any TIP projects or thoroughfare plan projects. The location of the proposed pump
station appears, from the map provided, to potentially be located in the path of TIP
project R-2917 (from NC 7532 to SR 1366 (Edgewood Drive) widen US 601 to a multi-
lane facility and Bridge No. 81 over Stewart Creek). Before, constructing this station its
location should be coordinated with the Divisions Engineers office. Surry County is
located in highway division eleven. The Division Engineer is Mr. Wade Hoke, P.E., and
his phone number is [phone].

SUBJECT: State Clearinghouse Project No. 9900071: NIAA for the Piedmont Triad West
Industrial Park Access Road Construction Project, Surry County
This correspondence responds to a request by you for our review and comments on the
Notification of Intent to Apply for Assistance (NIAA) for the above referenced project. These
comments are provided in accordance with the provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.) and the North Carolina Environmental
Policy Act (G.S. 113A-1 through 113A-10; 1 NCAC 25).
This project was discussed with Mr. Torn Webb on 24 July 1998. The City of Mount
Airy is proposing to construct an access road to the 400 acre Piedmont Triad West Industrial
Park located off NC 601 in Surry County. Beech Creek, a warm water stream, will be crossed by
concrete box culverts. At his time we have not identified any major concerns with the proposed
road construction and stream crossing. However, we recommend that stream impacts be kept to
a minimum and that construction of the box culvert follow these guidelines:
1. If a multiple cell reinforced concrete box culvert is required, then it should be
constructed so that -all water flows through only one cell during low flow to maintain
fish passage. At ieast one cell should be buried I foot into the substrate unless
bedrock is encountered. If both cells are buried, water should be diverted through a
single cell by constructing a low flow notch through that cell or by installing a short
sill on the upstream end of the other cell to block low flows. If a single cell culvert is
used it should be burned I foot into the stream bottom or a low flow notch provided
through the cell.
2. Concrete work must be accomplished so that wet concrete does not contact stream
water. This will lessen the chance of altering the stream's water chemistry and
causing a fish kill.
3. Stringent erosion control measures should be installed where soil is disturbed and
maintained until project completion.

4. Temporary or permanent herbaceous vegetation should be planted on all bare soil
within 15 days of ground disturbing activities to provide long-term erosion control. If
seeding is done after 1 October 1997, then project sponsors should return after 1 April
to reseed if necessary.
Project sponsors should be aware that, depending on the amount of stream disturbance
required for this project, compensatory mitigation may be required by the NC Division of Water
Quality (DWQ) under the Wetlands Restoration Program. The DWQ contact is Mr_ Ron
Linville. Winston-Salem Regional Office, 336/771-4608, ext. 245.
Because of the industrial sites proximity to Beech Creek and Stewarts Creek, which
contains smallmouth bass and redbreast sunfish, project sponsors should require a minimum 100
foot undisturbed buffer zone along all streams and wetlands to be maintained on the industrial
park site. This will help protect water quality and maintain proper stream functions.
