After reviewing your application, we have decided that this action is covered by General Water Quality Certification Number 3103. This certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. • If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions.listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. The purpose of this inspection was to review draft plans for the new access road provided by Mr. John Grey of Grey Engineering, and to inspect the site for waters and wetlands subject to Department of the Army permitting authority. Plan review and site inspections showed two single complete crossing of waters of the United States. The first was a bank to bank jurisdiction of an unnamed tributary of Stewarts Creek and the second was a bank to bank jurisdiction of Beech Creek. The site inspections showed that the proposed road crossings are located adjacent to the identified tributaries and impact only unvegetated waters of the United States (does not include any impacts to special aquatic sites). For the purposes of the corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the -` Rivers and Harbors Act of 1899 and Section 404 of the Clean Water viicoivv ?v:ct 7"JJV 110104u MbLIG WORKS/ENG -2- Act, was provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; C. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer (DE) in accordance with the "Notification" general condition. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for two years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. This verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification. No activity may occur in a component of the National wild and Scenic River System] or in a river officially designated by congress as a -study river" for possible inclusion in the system, while the river is in an official study status. Information on Wild and Scenic Rivers may be obtained from the National Park Service and the U.S. Forest Service. S. Tribax Rights. No activity or its operation may impair reserved tribal rights, including, but not limited to, reserved water rights and treaty fishing and hunting rights. 9. Water Quality Certification. In certain states, an individual state water quality certification must be obtained or waived. ld. Coastal Soae Usnageeaut. No activity is authorized under any NWP which is likely to jeopardise the continued existence of a threatened or endangered species or a species proposed for such designation, as identified under the Federal 8ndangered Species Act, or which is likely to destroy or adversely modify the critical habitat of such species. No activity which may affect Historic Properties listed, or eligible for listing, in the National Register of Historic Places is authorized, until'the District Engineer has complied with the provisions of 33 CPR 325, Appendix C. The prospective permittee must notify the District Engineer if the authorized activity may affect any historic properties listed, determined to be eligible, or which the prospective believe may be eligible for listing on the National Register sofafistoric to Places, and shall not begin the activity until notified by the District Engineer that the requirements of the National Historic Preservation Act have been satisfied and that the activity is authorized. Information on the location and existence of historic resources can be obtained from the State Historic Preservation Office and the National Register of Historic Places (see 33 CPR 330.4(g)). 13. Notification. a. Where required by the terms of the NW, the prospective permittee must notify the District Engineer as early as possible and shall not begin the activity: (1) until notified by the District Engineer that the activity may proceed under the IM with any special conditions imposed by the District or Division Engineer; or (2) if notified by the District or Division Engineer that an individual permit is required; or (3) Unless 30 days have passed from the District Engineer's receipt of the notification and the prospective permittee has not received notice from the District or Division Engineer. Subsequently, the permittee'o right to proceed under the NWP may be modified, suspended or revoked only in accordance with the procedure set forth in 33 CFR 330.5(d)(2). b. These comments are provided in accordance with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.) and the North Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; 1 NCAC 25). This project was discussed with Mr. Torn Webb on 24 July 1998. The City of Mount Airy is proposing to construct an access road to the 400 acre Piedmont Triad West Industrial Park located off NC 601 in Surry County. Beech Creek, a warm water stream, will be crossed by concrete box culverts. At his time we have not identified any major concerns with the proposed road construction and stream crossing. However, we recommend that stream impacts be kept to a minimum and that construction of the box culvert follow these guidelines: 1. If a multiple cell reinforced concrete box culvert is required, then it should be constructed so that -all water flows through only one cell during low flow to maintain fish passage. At ieast one cell should be buried I foot into the substrate unless bedrock is encountered. If both cells are buried, water should be diverted through a single cell by constructing a low flow notch through that cell or by installing a short sill on the upstream end of the other cell to block low flows. If a single cell culvert is used it should be burned I foot into the stream bottom or a low flow notch provided through the cell. 2. Concrete work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 3. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. If seeding is done after 1 October 1997, then project sponsors should return after 1 April to reseed if necessary. Project sponsors should be aware that, depending on the amount of stream disturbance required for this project, compensatory mitigation may be required by the NC Division of Water Quality (DWQ) under the Wetlands Restoration Program. Because of the industrial sites proximity to Beech Creek and Stewarts Creek, which contains smallmouth bass and redbreast sunfish, project sponsors should require a minimum 100 foot undisturbed buffer zone along all streams and wetlands to be maintained on the industrial park site.
