This Office has received the site map and plan for the proposed apartment complex located adjacent to SR 1515. As stated in your letter dated January 12, 2000, the proposed project is located in a cultivated field with a drainage channel. As such, this property is not subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC.0233). Any change in land use that is currently exempted, causes the water bodies present on the property to become subject to the Buffer Rules. Improvements to the buffer as noted in your letter are allowed by the Rule if the restoration site has a minimum of fifty feet as measured horizontally on a line perpendicular from the water body. This Office would request that the landscaping within the first thirty feet be accomplished with native species (the recommended rate is between 300 to 400 tree per acre). In accordance with the Rule, the Table of Uses allows a one time application of fertilizer within the buffer to aid in establishing the replanted vegetation. Additional and ongoing fertilizer applications are prohibited.
