This Office has received the site map and plan for the new wastewater treatment plant for River Dell Utilities
located near Buffalo Creek at North Carolina Highway 42. This stream is perennial and as such is subject
to the Neuse River asm. utrient Sensitive Waters Management Strategy; Protection and Maintenance of
Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC .0233). Non electric utilities are
listed as allowed uses under this Rule and exempt if designed, constructed and maintained to minimize soil
disturbance and to provide the maximum water quality protection practicable. In addition, these impacts
(crossings) must be perpendicular and disturb equal to or less than 40 linear feet of the riparian buffer.
The proposed 12 inch outfall pipe for this facility is planned to enter the buffer as perpendicularly as possible
and disturb 0.02 acres in a fifteen foot wide access corridor. According to the specifics stated above, this
activity is exempt.
NCAC .0234 (5) states: "...permitted wastewater discharges to the Neuse River basin with permitted flows
of less than 0.5 MGD in 1995 shall be allocated an average annual mass load of 280,000 pounds of total
nitrogen. When this facility is constructed and permitted, there will be two discharge limitation sheets for
flows of 0.25 MGD and 0.5 MGD with the tertiary treatment limitations."
