Morgan Street, Ste 217 Lake City, FL 32055 Dear Ms. Womack: You have our approval, in accordance with the attached conditions, to place temporary fill in 11.2 acres of wetlands or waters for the purpose of constructing the ATT/PF NET Fiber optic Utility Cable from Greensboro and Rocky Mount to the NC/VA line as you described in your application dated March20, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3101.This certification allows you to use Nationwide Permit Number 12 when the Corps of Ehgineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. As well, I am providing you with no comment letters from the NCDCR agency for the entire route from Raleigh (RDU) to the Virginia State line. I also wish to comment on a recent letter received from the USFWS/Raleigh office. The attached segment information is similar to the past two routes. Essentially, the route begins in Greensboro and either follows an existing ATT easement in cross country areas or follows established right-of-ways containing NCDOT highways. You indicated that this information will allow you to publish a comments period, of which you will provide me with a copy. -Because of a recent letter received from the NCDENR, please be advised that no public funds will be used to complete this project. As well, no net filling or elimination of wetlands area is proposed. The only impact to the site's existing altered wetlands are temporary. Regarding the USFWS letter, ATT will directional bore the Tar River and Swift Creek. Most if not all of the Section 10 waterbodies referenced in our project will also be bored in a manner which will not impact those wetlands. Many other 404 wetlands aligned closely to structures will also be directional bored. After a review of this referenced route, please notify me which waterbodies also should require protection. Dear Mr.Garlick: The U.S. Fish and Wildlife Service (Service) has revie%ved your February 24, 0 1 letter concerning the proposed embedment of fiber optic c,!61 _. along an existing utility line corridor east from Rocky Mount to the North Carolina-Virginia border, in Edgecombe, Halifax, Martin, Bertie, Hertford, and Gates Counties, North Carolina. The fiber optic cable will cross many aquatic systems, including the Tar, Roanoke, and Chowan Rivers; Beech, Key, Flat, and Mills Branches; Swift, Fishing, Buckhorn, Deep, Turkey, Ahoskie, and Conoho Creeks; and, Etheridge and Wahtom Swamps. These comments are provided in accordance with provisions of Section 7 of the Endangered Species Act of 1973 (87 Stat. 884, as amended; 16 U.S.C. 1531-1543). Based on documented findings of the Federally-endangered Tar spinymussel (Elliptio steinstansana) in the Tar River and Swift Creek, the Service recommends that any crossings of these aquatic systems be avoided if possible. In the event that crossings are proposed in the above listed systems, the Service strongly recommends implementing one of the following to avoid impacts to Federally-protected species: (1) conduct protected species surveys at those sites 100 meter upstream and 400 meters downstream of the crossing (with reporting of survey results to the Service) prior to commencement of work; or (2) employ directional boring methods of the cable at those sites. In addition, the applicant must implement the following measures to ensure protection for all aquatic resources occurring downstream should the directional boring approach not be implemented: Since aquatic resources are highly susceptible to sedimentation, the Service generally recommends avoidance of in-stream construction work when possible to minimize adverse impacts. When in-stream construction does occur, we request that the following measures be implemented to ensure protection for all aquatic resources occurring downstream: 1) Installation of in-stream silt curtain weighted at the bottom, and stringent bank erosion control. If tree removal is required, stumps and roots should remain intact for bank stabilization; 2) In-stream construction activities should be initiated only during low flow conditions that permit the effective deployment of the silt curtain; 3) Before stream crossings are to begin, the contractor should notify the Service within one week of the construction initiation date. The Service would like the opportunity to inspect the installation of the silt curtain and check any possible changes in stream flow conditions when scheduling allows. Thank you for your cooperation with our agency in protecting Federally-listed species. Your efforts in reducing erosion and sedimentation associated with this project will be beneficial to water quality and all aquatic species in this area. The 80 +mile corridor is illustrated on sheets 1/10 through 10/10 of the attached maps. A review of the federal register indicates that Nationwide 12 authorization is applicable. A recent notification from the NCDENR also requires seven copies of the application with an application fee of $475, which is being submitted with a copy of this letter to hopefully accelerate the process. The proposed corridor includes approximately-46- 404 crossings and five section 10 crossings illustrated on sheets 2/10 through 7/10. Sheets 8/10 through 10/10 indicate the positions of the crossings in relation to the road corridors. Although the proposed 50 ft+ corridor is expected to mostly affect cleared road ROWs, there are areas of the corridor that contain vegetated coverage with soils that would be regulated by the 1987 unified method and other areas that exhibit altered wetland conditions. The embedment process involves using a cable plow that embeds the cable from 40 inches to 48 inches below grade. Although the disturbance is about 6 ft. in width, a cleanup tractor with blade and manual labor will return the area to grade. In the steeper sloped areas sterile rye grass will be deployed to aid in sediment stabilization. By the following spring the rye grass die back and will be replaced by native wetland herbs, forbes and grasses. Essentially, the altered wetland conditions will be unchanged from pre-existing conditions. The Section 10 wetlands' construction area will consist of an entry point of staging landward of the "Waters of the United States." A pit will enable the drilling apparatus to "push " a 6 '/z" diameter high density plastic tube and cutter head to, at least , 48 inches below the invert of the waterbody's lowest depth. The exit point will also be landward of the landward limits. Staked turbidity curtains will be deployed to ensure that no erosion or sedimentation enters wetlands or surface waters. The notification of a NW 12 application normally requires a FWS or SHPO consultation. To ensure a smooth process, a copy of this application is being sent to those offices for their review and edification.
