Z 'o 4, 2)" NCDENR North Carolina Department of Environment and Natural Resources Pat McCrory Governor May 8, 2014 J. Alan Carson, City Manager Lexington City Hall 28 W Center St Lexington, NC 27292 Subject: Storrwater Permitting Requirements Dear Mr. Carson; John E. Skvarla, fll Secretary You are receiving this letter because the City has been identified as being located within an urbanized area according to the 2010 Census and therefore the City's municipal separate storm sewer system (MS4) is subject to the Clean Water Act's stormwater permitting requirements. Stormwater discharges are a significant contributor to local water quality impairments as high levels of sediment, oil, toxics and other pollutants flow from impervious surfaces into waterways. In 1987, Congress established a phased approach to regulating stonmwater discharges from municipal storm sewer systems. The largest municipalities were regulated first, followed by smaller municipalities located in urbanized areas as defined by the most recent US Census. The most recent Census shows that all or part of the City is located within an urbanized area. EPA requires local governments with populations over 10,000 that own or operate a MS4 within an urban area, as defined by the most recent US Census, to submit an application for a Phase 11 Stormwater Discharge Permit. Please submit the application, a narrative that describes the City's proposed Stormwater Management Plan, and the $860.00 application fee no later than June 1, 2015, to: Mike Randall Stormwater Permitting Program NC Division of Energy, Mineral and Land Resources (DEMLR) 1617 Mail Service Center Raleigh, NC 27699-1617 A sample stornnuater management plan and application form can be found on the following website: http.//nnrta 1.ncdesir.nrg/weksllrlms4resourcrs Division of Energy, Mineral, and Land Resources Energy Section - Geological Survey Section - Land Quality Section 1612 Mail Service Center, Raleigh, North Carolina 27699-1612.919-707-92001 FAX: 919-715-8801 512 North Salisbury Street, Raleigh, north Carolina 27604 • Internet: htto:llportal,ncdenr.oLg1webArl An Equal Opportunity 1 Affirmative Action Employer -- 50% Recycled 110% Post Consumer Paper Once you receive your permit you will have 12 months to develop a public education program and 18 months to develop a post -construction program.
