Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. 198000291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in civil and/or administrative penalties. Pleased be advised that the following are conditions of this DA permit: 1. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 2. This permit does not authorize any dredging. 3. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on the authorized pier. If any change in your work is required because of unforseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland tills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 N. For this approval to be valid, you must follow the conditions listed in the attached certification. PROJECT SUMMARY: The applicant proposes to replace and extend the existing bulkhead and add an anchoring system to the existing pier. 9. PROJECT D . 1PTION The project site is an existing single-family residence at 8741 Bald Eagle Lane, in the Porter's Neck area of New Hanover County. The site is accessed by Porter's Neck Rd. off U.S. Highway 17-N. Bald Eagle Lane lies parallel to the AIWW, between Futch Creek and the Figure 8 Island Bridge, and is developed with single family residences. The applicant's property is at the north end of Bald Eagle Lane adjacent to Futch Creek, just northwest of the creek's intersection with the Atlantic Intracoastal Waterway (AIWW). The applicant's lot is triangular with approximately 157 linear feet of shoreline along Futch Creek. There is a border of coastal wetlands along the shoreline, ranging from 20 to 80 feet in width. It is predominantly Smooth Cordgrass (Spartina altemiflora), but also includes some Salt Meadow Grass (Spartina patens), Spike Grass (D'stic las picaa), and Sea Lavender (Limo i um, spp.) in the northwest corner of the property. At low water, Futch Creek exhibits numerous areas of oyster rock/bars and mud flats. The applicant's lot is stabilized by an old existing bulkhead along the eastern 85 feet of the shoreline. It is constructed of corrugated cement asbestos sheathing and creosote timbers, and is in need of replacement. The applicant has recently completed repairs on his existing pier from damage sustained during Hurricane Floyd in 1999. The pier extends into Futch Creek from the northwest corner of the lot. It is approximately 150 feet long, 6 feet wide and includes a 16 ft. by 16 ft. platform at its waterward end. New Hanover County's 1999 Land Use Plan classifies the upland area as Resource Protection and the water and marsh as Conservation. Futch Creek is a designated Primary Nursery Area (PNA), by the N.C. Division of Marine Fisheries. The waters of Futch Creek are classified SA by the N.C. Division of Water Quality, and in the project area, they are OPEN to the taking of shellfish. As a result of hurricanes between 1996 and 1999, the applicant has had to rebuild his pier several times. In an attempt to reduce the damage to the pier in future storms, he is proposing to install a pier anchoring system. The anchoring system would consist of two rows of pilings located 8 feet to either side of the footprint of the existing pier (21 pilings each side). The pilings would be driven or jetted on an angle into the marsh and/or shallow bottom to within 1-2 feet of existing grade. Each set of pier pilings would be attached to the anchor pilings by 5/8" threaded galvanized rods or stainless steel cable. The applicant also wishes to replace the existing bulkhead and extend the new wall across the remainder of his property. The applicant is requesting to construct the replacement portion of the bulkhead (85 ft.) 1-2 feet waterward of the existing bulkhead, in order to avoid having to disturb the hazardous asbestos sheathing. The remainder of the new wall (72 ft.) would be constructed landward of the adjacent marsh on an alignment established by DCM field staff. The new bulkhead would be constructed of treated wood V-edge sheathing, with 4"X 4" whalers, and 8"X 8" posts. Backfilling and landscaping activities would disturb a 30 - 40 ft. area landward of the new wall, across the width of the lot. 10. ANTICIPATED EM PACTS: The proposed pier anchoring would increase the incorporation of estuarine waters and public trust area, by 2704 square feet, over the current footprint of the existing pier. The 85 feet long section of replacement bulkhead would result in the filling and incorporation of approximately 170 square feet of coastal wetlands, vegetated primarily with Spanina altem flora. The proposed bulkhead construction would require some highground disturbance during the installation of new wall, tiebacks, and backfilling activities. The proposed construction of the wall just in front of the existing wall would limit both human and environmental exposure to the deteriorating and hazardous correlated asbestos sheets. PROTECT DESCRIPTION The project site is an existing single-family residence at 8741 Bald Eagle Lane, in the Porter's Neck area of New Hanover County. The site is accessed by Porter's Neck Rd. off U.S. Highway 17-N. Bald Eagle Lane lies parallel to the AIWW, between Futch Creek and the Figure 8 Island Bridge, and is developed with single family residences. The applicant's property is at the north end of Bald Eagle Lane adjacent to Futch Creek, just northwest of the creek's intersection with the Atlantic Intracoastal Waterway (AIWW). The applicant's lot is triangular with approximately 157 linear feet of shoreline along Futch Creek. There is a border of coastal wetlands along the shoreline, ranging from 20 to 80 feet in width. It is predominantly Smooth Cordgrass (Spartina alterniflora), but also includes some Salt Meadow Grass (Spartina patens), Spike Grass Wistichlas Wicada), and Sea Lavender (Limonimn, spp.) in the northwest corner of the property. At low water, Futch Creek exhibits numerous areas of oyster rock/bars and mud flats. The applicant's lot is stabilized by an old existing bulkhead along the eastern 85 feet of the shoreline. It is constructed of corrugated cement asbestos sheathing and creosote timbers, and is in need of replacement. The applicant has recently completed repairs on his existing pier from damage sustained during Hurricane Floyd in 1999. The pier extends into Futch Creek from the northwest corner of the lot. It is approximately 150 feet long, 6 feet wide and includes a 16 ft. by 16 ft. platform at its waterward end. New Hanover County's 1999 Land Use Plan classifies the upland area as Resource Protection and the water and marsh as Conservation. Futch Creek is a designated Primary Nursery Area (PNA), by the N. C. Division of Marine Fisheries. The waters of Futch Creek are classified SA by the N. C. Division of Water Quality, and in the project area, they are OPEN to the taking of shellfish. As a result of hurricanes between 1996 and 1999, the applicant has had to rebuild his pier several times. In an attempt to reduce the damage to the pier in future storms, he is proposing to install a pier anchoring system. The anchoring system would consist of two rows of pilings located 8 feet to either side of the footprint of the existing pier (21 pilings each side). The pilings would be driven or jetted on an angle into the marsh and/or shallow bottom to within 1-2 feet of existing grade. Each set of pier pilings would be attached to the anchor pilings by 5/8" threaded-galvanized rods or stainless steel cable. The applicant also wishes to replace the existing bulkhead and extend the new wall across the remainder of his property. The applicant is requesting to construct the replacement portion of the bulkhead (85 ft.) 1-2 feet waterward of the existing bulkhead, in order to avoid having to disturb the hazardous asbestos sheathing. The remainder of the new wall (72 ft.) would be constructed landward of the adjacent marsh on an alignment established by DCM field staff. The new bulkhead would be constructed of treated wood V-edge sheathing, with 4"X 4" whalers, and 8"X 8" posts. Backfilling and landscaping activities would disturb a 30 - 40 ft. area landward of the new wall, across the width of the lot. 10. ANTICIPATED IMPACTS: The proposed pier anchoring would increase the incorporation of estuarine waters and public trust area, by 2704 square feet, over the current footprint of the existing pier. The 85 feet long section of replacement bulkhead would result in the filling and incorporation of approximately 170 square feet of coastal wetlands, vegetated primarily with Spartina altemi, flora. The proposed bulkhead construction would require some highground disturbance during the installation of new wall, tiebacks, and backfilling activities. The proposed construction of the wall just in front of the existing wall would limit both human and environmental exposure to the deteriorating and hazardous correlated asbestos sheets.
