DWQ Project tt 000141 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. David & Tina Lee 3902 Sweeten Creek Road Chapel Hill, NC 27514 Dear Mr. And Mrs. Lee: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.13 acres of wetlands and 228 linear feet of streams for the purpose of constructing the Renaissance Center at South point near SR 1118 and SR 1105 as described in your revised application dated July 7, 2000. After reviewing your application, we have decided that this fill is covered by General Water . Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control. Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modifi,;d below. If you change your project. you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. An additional condition is that a final, written stormwater management plan shall be approved by this Office before the impacts specified in this Certification occur. The stormwater management plan must include plans and specifications for stormwater management facilities designed to remove 85% TSS according to the most recent version of the NC DENR Stormwarer Best Management Practices Manual. Also, before any permanent building is occupied at the subject site, the facilities, as approved by this Office, shall be constructed and operational, and the stormwater management plan, as approved by this Office, shall be implemented. If you do not accept any of the conditions of this certification. you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 1508 of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. An earlier Pre-Construction Notification was sent to your office February 21, 2000 for this project. The February 401 Certification request was put on hold by your office (DWQ Project #000141) in a letter dated April 20, 2000. The property is located east of Fayetteville Road (SR 1118) south of Herndon Road (SR 1105) approximately 1/2 mile south of Interstate 40 in Durham County, NC (NC Grid N-784143, E-2018926). Two stormwater ponds are proposed for construction. Design calculations for the stormwater ponds will be sent to your under by the project engineer under separate cover. Based on the comments/recommendations of your office, the project engineer has revised the requested impacts as follows: Impact 1 now involves 80 if of unimportant channel (160sf) Impacts 2-6 are no longer requested (avoidance) Impacts 7-9 remain as previously requested Impact 7 = 1304 sf, Impact 8 = 3821 sf, Impact 9 = 1481f unimportant channel (442 sf) Total requested project impacts after this revision = 228 if unimportant channel and 5727sf (0.13ac) Included with the original PCN were: (1) a completed Pre-Construction Notification Application, (2) Agent Authorization Form, (3) USGS Site Vicinity Map, (4) Construction Plans, (5) Wetland Delineation Forms, (6) Stormwater Pond Calculations and a check for $475.00 to cover the DWQ permit application fee. According to the project engineer stormwater pond calculations for the revised impacts are the same specifications as previously submitted. S&EC believes no mitigation should be required for the requested impacts. However, if for some reason mitigation is required, our client proposes payment into the North Carolina Wetland Restoration Fund. Included with this cover letter please find 1) a wetland impact justification letter from the project engineer, 2) revised construction plans (11"x17"). Dear Mr. Dorney: This re-submittal is in response to your letter of April 20, 2000 indicating denial of our original impact request and recommending the avoidance of several waters and/or wetland areas. I apologize for the tardiness of this response but the proposed plan for this project has gone through several intermediate revisions to address the concerns of the Durham City / County Planning Department and the City of Durham and North Carolina Department's of Transportation. During this process the concerns of the Division of Water Quality have also been kept in the forefront to insure that the eventual plan that resulted would address the concerns expressed in your letter. The Division of Water Quality requested that we look at the possibility of eliminating impacts to areas 2, 3, 4, 5, 6, 8 and 9. The new plan addresses the avoidance of 2, 3, 4, 5, and 6. Unfortunately, we were unable to eliminate the impacts to areas 8 and 9 as requested. Impacts 8 and 9 occur at the very narrowest portion of the project. Obviously, the attraction of this site for development is the proximity to the interchange at I-40 and Fayetteville Road and secondly the intersection of Fayetteville Road and Herndon Road. The retail portion of this mixed-use project is therefore located facing Fayetteville Road and in the northern end of the project nearest to Herndon Road. The topography of the site falls approximately 38 feet from Fayetteville Road to the back of the site. The constraints constructing grades to adequately address both the reality of a parking lot and also handicap accessibility necessitate providing as much room as possible between Fayetteville Road and the main retail arc. Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H.0507(e) and will place this project on hold as incomplete until we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can the pond proposed to impact wetlands and streams numbered 2, 3, 4, 5, and 6 be moved or redesigned so that the pond would not impacts these wetlands or streams? Also, can the road be realigned and the building moved to avoid the impacts to wetland 8 and stream 9? Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Please indicate all impacts to jurisdictional waters and wetlands on fiill sized plans of at least 50:1 scale that show layouts of buildings, parking fill slopes, etc., so that this Office can review if the proposed impacts are necessary. Also this project may require compensatory mitigation as described in 15A NCAC 2H.0506(h). Please respond within three weeks of the date of this letter by sending a copy of this information to me and to the Charles Brown, in the Raleigh Regional Office at 3800 Barrett Dr., P.O.
