After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This Certification allows to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your original application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. The waterward extent of the bulkhead shall be as shown on the plat included with your application. 2. Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" whichever is more appropriate (available from the Division of Land Resources in the DENR Regional or Central Offices) shall be designed, installed and maintained properly to assure compliance with the appropriate turbidity water quality standard (25 NTUs in all saltwater classes). Joe Priest Page 2 9. PROJECT DESCRIPTION: The project site is located adjacent to Banks Channel, at 308 Water Street, in Wrightsville Beach, in New Hanover County. The lot is 50 feet wide and approximately 81 feet in depth from the Water Street right-of-way. The property averages approximately 7 feet above mean sea level. There is an existing concrete bulkhead along the property's shoreline (northwest side), and an existing pier. The existing pier is within the Wrightsville Beach pierhead line, and adjacent lots exhibit similar piers. The concrete bulkhead was installed 15 to 18 years ago and was originally located well landward of mean high water (MHW). Since that time, adjacent properties have been subsequently bulkheaded at MHW, approximately 8 feet waterward of the applicant's wall. Since the old concrete wall is in need of replacement, the applicant wishes to construct the new wall on the same alignment as the two adjacent bulkheads. The shoreline in the project area is a sandy bottom and there is no border of wetland or marsh vegetation. The Wrightsville Beach Land Use Plan classifies Banks Channel as Conservation, and the adjacent highground in the project area as Developed. The waters of Banks Channel are classified as SA by the N.C. Division of Water Quality. They are not designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. The applicant is proposing to construct a replacement bulkhead in line with the existing bulkheads on adjacent properties, approximately 8 feet waterward of mean high water (MHW). The bulkhead would be 50 feet long and approximately 5 feet above the existing grade elevation. It would be constructed of treated pilings and whalers, with vinyl sheathing. 10. ANTICIPATED IMPACTS: The proposed project would result in the incorporation of 400 square feet of estuarine waters and public trust area.
