Dear Mr. Wilhelm:
You have our approval, in accordance with the attached conditions, to place dredge in 0.33 acres of waters for the
purpose of dredging an area in front of 375 Peddle Point Road, Salisbury, NC on High Rock Lake, as you described in
your application dated February 17, 2000. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3099. This Certification allows you to use Regional Permit Number
198200030 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

In connection with our Application for Activity Permit for Reservoir and
Shoreline Alteration on High Rock Reservoir (the "Application"), we are enclosing the
following:
1. The original completed Pre-Construction Notification and six (6)
additional copies for a total of seven (7) copies;
2. A copy of the Application to be submitted to Yadkin, Inc. including
attachments;
3. Two (2) copies of partial maps delineating the location of the subdivision
Pebble Point; and
4. A check in the amount of $200.00 in payment of your fee.
Please review these documents as soon as possible. As you know, excavation is
not permitted after February; therefore, we would like to obtain a permit as quickly as
possible so that we can get the excavation done before the end of the month. We have
been told the excavation will take approximately two (2) days so that leaves us little time.
Your expeditious handling of this matter will be greatly appreciated.
Yadkin, Inc. has estimated the depth of the water in front of our lot to be seven (7)
feet and eight (8) feet is required. The excavation will be minimal.

The excavation to be performed will include removal of material within the highlighted area of the attached
survey plat. The excavation will cover approximately 14,000 square feet of the reservoir bottom. All
slopes will have a ratio of approximately 3 to 1. The estimated amount of material to be removed is 400
cubic yards. All excavation will be performed in a manner that allows natural drainage of water into the
reservoir without ponding of water. There should be no adverse impact to the water quality or to fish
habitats since there are no visible sections or structures for holding fish. There is no vegetation in the area
to be excavated. A bobcat or bulldozer will be used to remove the material.
13. PURPOSE OF PROPOSED WORK: The purpose of the proposed work is to increase the depth of the
water to meet the depth requirements of Yadkin, Inc. to construct a pier.

I . Map of the reservoir area where the excavation is proposed - Applicant must a ttach a map of the area of the reservoir and adjoining shoreline
property owned by the applicant where excavation is proposed. The map must clearly indicate the area of the proposed excavation and to
what depth (contour elevation) the excavation is proposed.
2. Description of the planned excavation - Applicant must attach a written description of the planned excavation including an estimate of the
reservoir bottom to be modified and the amount of material to be removed from the reservoir.
3. Plan for disposal of excavated material - Applicant must attach a written description of their plans for disposing of the excavated sediment. No
sediment may be disposed of within the FERC project boundary (655 foot contour), or on property owned or managed by Yadkin or Alcoa
4. Resource impacts assessment - Applicant must attach a brief written description of the potential impacts of the proposed excavation activity on
surrounding reservoir resources, including impacts to water quality and fish habitat If there is any vegetation growing in or around the area of
proposed excavation, it should be noted and the areas of vegetation should be photographed, and photos included with application.
5. Plans and schedule for conducting the proposed excavation - Applicant must attach a written schedule for completing the proposed excavation.
