Dear Nilsa Lobdell:
You have our approval. in accordance with the attached conditions and those listed below, to replace a culvert which
will impact 25 feet of Boylston Creek for residential construction in Transylvania County, as you described in your
application received by the Division of Water Quality on January 21, 2000. After reviewing your application, we have
decided that this action is covered by General Water Quality Certification Number 3103. This certification allows you to use
Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying
404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in
15A NCAC 211.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions below and those listed in
the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Dear Mr. Lund,
Our office has recently become involved with the development of a residential community outside the
city limits of Brevard, North Carolina. As part of the development of an entrance for the community onto
State Highway 280, we were asked by the Department of Transportation to coordinate the design of a
deceleration lane to the existing five-lane highway (280) that fronts the new community. In order to
accomplish the requested deceleration lane, we will be required to extend an existing concrete box culvert
that is adjacent to the site and currently flows from the community under highway 280, and onto an
adjacent parcel of land.
The site encompasses approximately 210 acres within Transylvania County. The permit area and
proposed 20' extension of the box culvert will result in the disturbance of approximately 20' (120 s.f. in
area) of a previously disturbed and rechannelized stone rip-rapped stream channel at the headwaters of
Boylston Creek. The permit area was re-engineered in the early 1990's by the Department of
Transportation with the widening of State Highway 280 and the existing nationwide permit should be on
file. The Department of Transportation requires drawings stamped by a professional structural engineer
(P.E.) detailing the demolition of the existing wing walls and extension of the box culvert in accordance
with the drawings originally designed by NCDOT and implemented in the early 1990's. These drawings
can be made available if you so require. A site location map, a sketch of the proposed work and 2 copies
of the PCN application have been included per your request. Please call if you should have questions.

Lobdell Woods Subdivision - Culvert Extension (Boylston Creek)
Current condition
Boylston Creek is a tributary of the French Broad River. The stream's morphology upstream of
the existing box culvert is a Rosgen B Channel that has a sandy bottom with cobble size material
scattered on the bed. The proposed segment to be placed in a culvert exists as a straightened
trapezoid channel devoid of vegetative cover and lined with rip-rap.
Proposed condition
Although preliminary and not yet approved by NCDOT, we are recommending using a pre-cast
concrete box culvert extension to minimize the use of poured-in-place concrete during
construction. The existing riprap-lined channel upstream of the existing culvert will be removed
to accommodate the culvert extension. Upstream from the culvert extension the stream will be
left in a natural condition. Erosion control measures will be in place to minimize impacts on the
stream.
