Water Quality Certification and Riparian Buffer Authorization from the Division for your project. The

NOTIFICATION
Good Afternoon, Wyatt:
Thanks for your time this afternoon. Per our conversation, the Pre -construction Notification (PCN) for the
proposed Everwood Subdivision - Phase II (SAW-2019-00882), dated December 11, 2019 is incomplete. To
facilitate our documentation of the proposed project's compliance with requirements and conditions for use of
Nationwide Permit 29, please provide the following information:
1) NWP General Condition 15: Single and Complete Project,
a. Please provide either construction or grading plans to demonstrate that lots and their individual
septic systems would be constructed without crossing stream and/or wetland areas, or include these crossings
in this application. Report unavoidable crossings with both construction (temporary) and access
(permanent/maintenance).
i. Based on our conversation earlier today, I've attempted to identify lots that appear to require
wetland crossings. Those include 43-45, 53-55, 69-77, 81, 82, and 935.
b. An explanation of how cumulative impacts will be avoided on this project in the future (e.g.
methods to avoid impacts may include deed restrictions, conservation easements, etc)-
C. Identify water and power utility tie-ins on project plans.
2) A preliminary jurisdictional determination is on file for this phase of the Everwood Subdivision (Phase
II), but we are unable to locate mapping for Phase L If a determination or delineation concurrence has been
provided on Phase I, please forward that for our records. Per our conversation, I'll look at the calendar and look
for a date we can schedule a site visit for this site and the Barnes Landing site just east of this project.
3) The PCN application states that no federally protected species or habitat occurs in or near the project, but
that the USFWS has not been contacted. A review of the USFWS IPaC website identifies several federally
protected species potentially affected by activities in this location. Please visit the USFWS IPaC website and
provide text justification for the claim no impacts would result (https://ecos.fvvs.gov/i/ipac/location/index). We
will use this information in our request to USFWS for concurrence with this project.
Please provide the requested information within 30 days, or your application will be withdrawn. Feel free to
contact me with any questions or concerns.
