Inc 1650 Military Cut-off Road, Ste 200 Wilmington, NC 28403 Dear Mr. Albanese: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.64 acres of wetlands for the purpose of constructing the Porter's Neck Plaza development at 7979 Market Street as described in your revised application dated May 10, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 40.1 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project. you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in, 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and strums to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. A small berm (approximately) two (2) feet tall and approximatly 251 in length shall be placed at the property setback line between the 31" contour lines as shown on the plans dated May 9, 2000, to restrict surface water flow to the adjacent pond and to facilitate flow from the site to the 18" bypass pipe. 3. If subsequent operation of this facility reveals excessive ponding in the wetland due to stormwater, DWQ will allow, with via additional written approval, an open stormwater conveyance (e.g swale) no deeper than 20.5to be installed to direct water to the 18" bypass pipe at the 29.5' invert level as long as flows are not short circuited. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The plan will route all of the stormwater into the wet pond and discharge the first flush plus the amount of out flow that would discharge through a 10" pvc pipe flowing full. This will likely include the majority of storm events. As such the majority of stormwater that runs off of the site will enter the wetlands. The builder pointed out the fact that there is also a proposed outlet pipe from the wetland that has the same invert as the pipe that discharges into the wetland (inlet pipe). I have highlighted the inlet and the outlet on the plans. It is not clear if the proposed stormwater system will over-saturate the wetlands or not. As such, I am not sure what to recommend based on the plans. However, I do believe that the applicant has done his best to provide stormwater treatment and to provide hydrology for the wetland. As such, I recommend that we issue the 401 WQ Certification based on the current plans dated May 9, 2000. This wetland is surrounded by urban landuses (houses/light commercial). Also, during the site visit (April 5, 2000) Central Office and Regional Office staff observed that the wetland polygon has a discernible outlet which flows into unnamed tributary Pages Creek (a Class SA waters). A review of the site plan indicates that building and parking lot footprints could be adjusted to minimize wetland impact. Further, it is staff opinion that a pond at the distal end of the wetland polygon could be installed. This pond placement and wetland minimization would provide the ability to implement the proposed project while protecting water quality.
