(APGI), through its Yadkin Division (Yadkin), has completed its review of the Environmental Assessment (EA) and supplemental documents as prepared and submitted by KEJ Marketing Co., Inc. (KEJ), for Lots 1- 62 of the Stoney Point Harbor subdivision located along the Flat Swamp Creek embayment of High Rock Reservoir. Yadkin has also completed its review with regard to KEJ's proposed multi-use facility - construction of a boat launch ramp at Lot 62. Yadkin has reviewed the EA from the perspective of examining potential impacts resulting from the proposed subdivision on the reservoir and Yadkin- Managed Buffer that lies between the reservoir and the subdivision. Yadkin would remind KEJ that High Rock Reservoir is operated as part of the FERC licensed Yadkin Project. High Rock functions as a storage reservoir and serves as the principal storage/regulation facility for the entire Yadkin/Pee Dee system including Yadkin's Tuckertown, Narrows, and Falls hydroelectric power plants as well as Carolina Power & Light's Tillery and Blewett Falls hydroelectric power plants. The operation of the generation facilities at High Rock, and consequently the releases of water through the turbines, depends principally on the supply of water (inflow to High Rock), current water surface elevation, and time of year. Because High Rock Reservoir is a storage reservoir, there are seasonal fluctuations in reservoir water levels. Also, because of downstream flow requirements, extensive drawdowns can occur during extreme drought conditions. Yadkin manages the FERC licensed Yadkin Project in an environmentally responsible manner, generally consistent with the recommendations of state and federal resource agencies. Accordingly, Yadkin has reviewed the EA along with agency comments from the US Fish and Wildlife Service (USFWS), the NC Department of Environment and Natural Resources, Divisions of Water Quality (NCDWQ) and Parks and Recreation (NCDPR), the NC Wildlife Resources Commission (NCWRC), the NC Department of Cultural Resources (NCDCR), and the U.S. Army Corps of Engineers (USACE). Yadkin believes KEJ has responded adequately to the majority of the agencies' comments and, subject to completion of the requirements noted below, Yadkin will consider the EA complete. Yadkin will not issue any permits for private piers or multi-use facilities before total completion of the EA. The following is a summary of Yadkin's specific comments on the Stoney Point Harbor EA. Clarification of Yadkin-Managed Buffer & No Waterfront Lots The Stoney Point Harbor EA incorrectly notes that Alcoa owns and Yadkin manages a shoreline buffer of 10 vertical feet along the shoreline area proposed for development. APGI owns, and Yadkin manages, a 5 vertical foot buffer along the shoreline (Yadkin-Managed Buffer). The Stoney Point Harbor EA also makes reference to "waterfront lots". As noted above, APGI owns, and Yadkin manages, a 5 vertical foot buffer along the shoreline. Thus, no lots in the Stoney Point Harbor development are "waterfront" lots. KEJ must communicate this information to existing lot owners and prospective buyers in writing and must provide Yadkin with evidence of this communication. Yadkin's Shoreline Stewardship Policy Yadkin's Shoreline Stewardship Policy (Stewardship Policy, July 1999, copy enclosed) summarizes Yadkin's policies, procedures, and requirements regarding use of the Project lands and waters and the Yadkin-Managed Buffer by owners of property adjoining the Project boundary or the Yadkin-Managed Buffer and others. The Stewardship Policy addresses issues including,,but not limited to: building setbacks, construction (such as access pathways, structures, etc.), shoreline stabilization (erosion control measures), shoreline alteration (excavation, dredge and fill), vegetation removal, shoreline clean-up, aquatic vegetation (e.g. water willow, buttonbush), private irrigation systems, and vegetative plantings. KEJ must provide a copy of the Stewardship Policy to existing lot owners and prospective buyers. KEJ must also inform existing lot owners and prospective buyers that failure to comply with Yadkin's Stewardship Policy and unauthorized activities in the Reservoir or the Yadkin-Managed Buffer may result in loss of eligibility for private Reservoir access. KEJ must communicate this information to existing lot owners and prospective buyers in writing and must provide Yadkin with evidence of this communication. Shoreline Vegetation Management By letter dated September 20, 1999, NCWRC concurs that the following will help mitigate direct impacts to fish and wildlife habitat from the Stoney Point Harbor Development. 1. Trees that must be removed will be replaced at 2:1 ratio. Efforts should be made to place paths and piers to avoid the need to remove shoreline or in-water trees. In accordance with Yadkin's Stewardship Policy and considering this recommendation, Yadkin will require 2:1 replacement of trees, including lap trees, which must be removed for construction of private piers or multi-use facilities. 2. KEJ must place 100 trees in-water along the shoreline of Stoney Point. The placement of these trees must be performed in consultation with NCWRC. Yadkin has received notification from NCWRC that this mitigation step has been completed. Significant Natural Heritage Areas (SN?IAs) NCDPR indicates that a portion of the Stoney Point Harbor subdivision is in a SNHA and has requested that Yadkin work with KEJ to implement the provisions of the SMP. Specifically, NCDPR would like to see a 100-foot buffer of natural trees and shrubs be permanently protected along the lakeshore, making allowances only for limited clearing to maintain access to the lake. As previously noted, Yadkin will require that all activities in the Yadkin-Managed Buffer be performed in accordance with its Stewardship Policy. NCDPR also requests that no waterfront construction be allowed within the Yadkin-designated Conservation Zone at the east-end of the Stoney Point Harbor subdivision. The Stoney Point Harbor subdivision pre-dates implementation of certain requirements of Yadkin's Shoreline Management Plan. In addition, Yadkin made it clear to agencies, developers, and the public that it would not implement those requirements retroactively. None-the-less, Yadkin notes the designated Conservation Zone at the east end of the project area (approximately Lots 1 through 18) was so classified for two reasons, a shrub/scrub wetland at the head of the cove and a sensitive area/habitat. Yadkin's Specifications For Private Recreation Facilities At High Rock And Narrows Reservoirs (Specifications, July 1999, copy enclosed) and its Stewardship Policy state Yadkin's requirements for construction of reservoir access facilities near aquatic vegetation. Yadkin will follow these requirements. KEJ must communicate this information to existing lot owners and prospective buyers in writing and must provide Yadkin with evidence of this communication. In addition, the basis for the sensitive area/habitat is a tract of mature hardwood forest. As background, Davidson County has adopted a watershed protection ordinance that requires a minimum vegetative buffer width of 50 feet along the banks of all perennial streams or other waters for low density development. Also, Yadkin's Stewardship Policy indicates that for adjoining property owners (in new subdivisions as well as in subdivisions platted and recorded prior to July 1, 1999, such as Stoney Point Harbor) who satisfy the requirements described in Section III (100-foot Forested Setback Requirement) of the Policy on their property, vegetation removal from the Yadkin-Managed Buffer will generally be considered, by written permit, in accordance with the criteria listed under Section III.A.5. Supporting this element of Yadkin's Stewardship Policy, KEJ has adopted a general policy for its Stoney Point Harbor architectural review process, which, in conjunction with requirements under the Stoney Point Harbor restrictive covenants, promotes greater building setbacks than required by Davidson County and allows limited vegetation removal within the setback for lots adjoining the Yadkin-Managed Buffer. Yadkin requests KEJ to provide that general policy to Yadkin, in writing, especially noting that Lots 1-18 will receive particular attention during the review process. In addition, KEJ must communicate this policy to existing lot owners and prospective buyers in writing and must provide Yadkin with evidence of this communication, especially noting that Lots 1-18 will receive particular attention during the review process. Yadkin believes that these steps, in conjunction with NCWRC's mitigation measures for the proposed subdivision provide adequate protection of the resources in the area. .F Cultural Resources In accordance with Yadkin's letter to KEJ dated February 4, 1999, KEJ has provided Yadkin with a copy of the final cultural resources survey report as well as correspondence from NCDCR indicating that NCDCR has no comment. KEJ has also provided documentation indicating that there are no cultural sites located wholly or partly within the Yadkin-managed buffer or within the project boundary (655-foot contour, Yadkin datum). (NCDCR letter dated November 1, 1999; NCDNR Nationwide Permit Review dated November 19, 1999 and Environmental Services, Inc. letter dated November 29, 1999). KEJ has satisfied concerns with regard to cultural resources in reference to Yadkin's subdivision access approval process. Private Pier Development KEJ has proposed that the Stoney Point Harbor development will include 27 private, individual piers and 11 shared piers. Yadkin would remind KEJ that per Yadkin's Specifications, in order to qualify for a private pier permit, certain minimum conditions must be met. First, lots proposed for private, individual piers must have a minimum shoreline lot width of 200 feet as measured by extending the adjoining property owner's side lot lines to the normal full-pool elevation of the reservoir (on High Rock Reservoir, 655-foot contour, Yadkin datum) and lots proposed for private, shared piers must have a minimum shoreline lot width of 100 feet each. Second, Yadkin requires that each lot have access to a minimum water depth of 8 feet within 75 feet of the shoreline as measured from the normal full pool elevation. Additionally, piers cannot be located in coves less than 100 feet in width at normal full-pool elevation. Yadkin staff has utilized plat maps and bathymetry to develop its own assessment of lot widths, water depths, and cove widths for the Stoney Point Harbor development lots 1-62. The attached table provides a summary of Yadkin's determinations (measured as noted above). Based on the information provided in the attached table, it is Yadkin's assessment that the following lots have sufficient water depth to meet Yadkin's minimum water depth requirement and the lots have a width of 200' or greater: #5-10; #12; #15; #32-34; #37-44; #55; and #61. Lots which have sufficient water depth and a lot width of at least 100' include: #1-4; #13-14; #16-31. Cove widths of 100' or more are available for the lots listed in this paragraph. Lot 11 has insufficient lot width and insufficient water depth to qualify for a private individual pier. This information on lot width, water depth, and cove width does not constitute final approval, pre-approval or conditional approval of any private individual or shared pier, or multi-use facilities, or activities to occur on the Yadkin-Managed Buffer adjacent to the lots indicated, but is provided to you as Yadkin's assessment of these minimum requirements. .i Multi-Use Facility Development KEJ proposes to construct a single boat launch ramp on Lot 62. USFWS, NCWRC and NCDCR have stated that they have no further comments regarding KEJ's proposal. Yadkin notes that KEJ has received an Approval of 401 Water Quality Certification from NCDWQ for the proposed multi-use facilities, along with General Permit Verification from the USACE. KEJ will need to notify USACE upon completion of the activity authorized in its permit. Issues Regarding Impact on Recreational Boatinq Use on the Reservoir and the Need for the Boat Launch Ramp By letter dated February 4, 1999, Yadkin requested KEJ to provide an assessment of the combined effect of full build-out of the Crystal Bay, Emerald Bay, Springs and Stoney Point Harbor subdivisions; an estimate of the recreational boating carrying capacity within the Flat Swamp Creek arm of High Rock Reservoir; an assessment of the effect of full build-out of Stoney Point Harbor and the Springs on recreational boating use of Flat Swamp Creek; and further justification for the need for the community boat launch proposed for Lot 62. Yadkin has previously indicated to KEJ that it has withdrawn these requests and that these assessments are not needed for Yadkin to complete its review of the Stoney Point Harbor EA. Summary To summarize, before Yadkin can consider the EA complete, it will need the following information from KEJ. 1. KEJ must provide Yadkin with substantial evidence of its efforts to inform existing lot owners and prospective buyers in writing about the following: (i) no lots within the Stoney Point Harbor development are "waterfront" lots because APGI owns, and Yadkin manages, a buffer of 5 vertical feet along the reservoir (Yadkin-Managed Buffer); (ii) KEJ has provided a copy of the Stewardship Policy and Specifications to existing lot owners and prospective buyers and communicated that failure to comply with Yadkin's Stewardship Policy and Specifications may result in loss of eligibility for private Reservoir access for lots otherwise eligible; (iii) that trees or tree-laps that are approved by Yadkin to be removed for private pier installation will have to mitigated at a 2:1 ratio; and (iv) that piers located in areas of aquatic vegetation will have to be designed to span the vegetation and will require the lot owner to sign an Aquatic Vegetation Agreement. 2. KEJ must provide its general policy for its architectural review process for Stoney Point Harbor that maximizes building setbacks and minimizes vegetation removal within the setback for lots adjoining the Yadkin-Managed Buffer. Yadkin requests KEJ especially note that Lots 1-18 will receive particular attention during the architectural review process. In addition, KEJ must communicate this policy to existing lot owners and prospective buyers in writing and must provide Yadkin with evidence of this communication, especially noting that Lots 1-18 will receive particular attention during the review process. Once KEJ has provided Yadkin with the above requested information, Yadkin will consider the EA for Stoney Point Harbor subdivision (Lots 1-62) complete. Completion of the EA clears the way for Yadkin to begin processing private pier permits and activity applications for any homeowner with a house under roof and for KEJ to obtain from Yadkin a construction permit authorizing the construction of the proposed multi-use facility. This letter in no way constitutes pre-approval or conditional approval of any private individual or shared pier, or multi-use facilities, or activities to occur on the Yadkin- Managed Buffer, along the shoreline, or in the reservoirs (including installation of private individual or shared piers, or multi-use facilities, shoreline stabilization measures, pathways, or vegetation clearing). Permission to install pathways, construct piers, clear vegetation or install shoreline stabilization facilities will be considered on a case-by-case basis with individual property owners and will be granted in accordance with Yadkin's policies and practices existing at that time. NC 27239 Dear Ms. Steed: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.12 acres of wetlands and 325 linear feet of streams for the purpose of constructing road crossings for Stoney Point Harbor development as described in your application dated January 21. 2000, and March 15, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in .your application except as modified below. If you change your project. you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh. N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. This correspondence is submitted as part of an effort to respond to you within three weeks of the date of the aforementioned letter. Please know that KEJ Marketing/Waterfront Properties is interested in pursuing this project and does not wish to have the project withdrawn. The N.C. Division of Water Quality (DWQ) has enumerated five points in the request for further information. Responses to the information requests are included below. (1) Supporting Information for Stream Crossings. A healthy economy, growing population along the nearby I-85 corridor, increased disposable income, and an apparently popular desire and ability to purchase a second home or retirement home near a body of water and outside of the urban environment of a city are primary factors resulting in the development of the subject property. The Springs development property is a linear strip of land adjacent to the Yadkin, Inc. buffer along south shore of the Flat Swamp Creek arm of High Rock Lake (see attached Figure 1). The main body of the development property is approximately 2.6 miles long and ranges from 550 to 700 feet in depth from the Yadkin buffer. An entrance road extends another 0.9 mile from NC Highway 8 to the main body of the development. The entrance road and development are crossed by 11 intermittent streams that flow down the north face of High Rock Mountain into High Rock Lake. Roadway access to the length of the development cannot be established without crossing these streams. The access roadway has been constructed on a fairly steep slope, so linear impacts to streams are necessarily longer than if the road was constructed on a level grade. With consideration to the stream reconstruction work that is currently underway, linear impacts resulting from stream crossings have been minimized to the greatest extent practicable. EcoScience Corporation has contacted Ms. Jennifer Frye and discussed methods for restoration of stream channels. Subsequently, a plan has been devised to remove sediment basins established in stream channels. Stream channels will then be restored as close as practicable to pre-construction conditions. Stream banks will be seeded with grass to provide for stabilization and supplemental plantings of wetland and mesic herbs and shrubs. Since the region is currently experiencing low-flow conditions, basin removal and stream restoration work is being carried out now. Following reconstruction, the linear footage of impacts at crossings will be determined and forwarded to DWQ. (3) Length of Stream Impact Discrepancies. The stream boundaries were delineated and surveyed at The Springs in 1997. Since that time, further fill impacts (sediment pond construction and boulder placement) have occurred in some stream crossings that were not recorded on the jurisdictional delineation plat. Sediment ponds and boulders are currently being removed from several streams. Stream banks will then be stabilized initially through grass seeding, with supplemental plantings of wetland and mesic herbs and shrubs. The linear footage of impact resulting from each crossing will be determined and forwarded to DWQ. It is the intention of the developer to impact less than 150 linear feet of stream at each crossing. (4) Missing Road Crossing. One delineated jurisdictional stream and a road crossing of the stream were inadvertently not included on the jurisdictional delineation of The Springs development. The delineation plat will be revised to include this crossing. Length of impact will be determined and forwarded to DWQ. (5) The only planned future impacts to jurisdictional areas at The Springs include the construction of three group piers on the shoreline of High Rock Lake. On December 17, 1999, DWQ issued an approval of 401 Water Quality Certification (DWQ# 99-1030) to allow coverage of fill resulting from construction of these piers under Nationwide Permit Number 18. The only planned future impacts to jurisdictional areas at Stoney Point Harbor include the construction of a residential pier and boat ramp on the shoreline of High Rock Lake. On October 24, 1999, DWQ issued an approval of 401 Water Quality Certification (DWQ # 991049) to allow coverage of fill resulting from construction of these piers under General Permit Number 198200030. The purpose of this letter is to request Section 401 concurrence for this nationwide permit. Impacts to jurisdictional areas have occurred through the installation of culverts and fill at five access road crossings. Three crossings impact intermittent streams and two impact headwater wetlands. The stream crossings impact 60, 140, and 65 linear feet, respectively, and a total area of 0.04 acre. The headwater wetlands crossings impact a total of 0.08 acre of vegetated wetlands. These crossings were constructed in the spring of 1998. It is assumed that the proposed action will be considered by the N.C. Division of Water Quality (DWQ) to require a "Major Water Quality Certification", and as such requires a fee payment of $475.00. You and I and Jerry McCrain of my office visited the site on October 15, 1997. Impacts to jurisdictional areas have occurred through the installation of culverts and fill at five access road crossings. Three crossings impact intermittent streams and two impact headwater wetlands. The stream crossings impact 60, 140, and 65 linear feet, respectively, and a total area of 0.04 acre. The headwater wetlands crossings impact a total of 0.08 acre of vegetated wetlands. These crossings were constructed in the spring of 1998. It is my understanding that, due to the type and amount of jurisdictional areas involved, these impacts are eligible for permitting under Nationwide Permit #26. And since the project is causing the loss of less than 0.33 acre of jurisdictional areas, and no single and complete stream crossing impacts 150 or more linear feet of jurisdictional stream, no formal notification to the Corps of Engineers (COE) is necessary. This information is being provided as a courtesy to keep the COE informed as to the status of jurisdictional areas in regards to this project. Stoney Point Harbor is a 159-acre, planned residential community on the north shore of the Flat Swamp Creek arm of High Rock Lake (Figure 1). The main body of the development is connected to NC Highway 8 by an approximately 2.5-mile entrance road. Section 404 jurisdictional areas in and adjacent to the development area are lcustrine and palustrine in nature, as defined by Cowardin et al. (1979) and displayed on the NW I map of the Grist Mountain and High Rock USGS 7.5 minute quadrangles. The Flat Swamp Creek arm of High Rock Lake is a lcustrine, limnetic system. Two forested, palustrine systems occur within the main body of the development, east of the entrance road (Stoney Point Drive) in an area not currently planned for development (Sheets 6 of 7 and 7 of 7). Both of these systems are depressional wetlands whose source of water is precipitation runoff from adjacent slopes. The entrance road corridor is a narrow strip of land, approximately 2.5 miles in length (Sheet 1 of 7), purchased from adjacent landowners for access to the main body of the development. There are five, small palustrine systems associated with the entrance road corridor (Sheets 2 of 7 through 5 of 7). Three of these systems are narrow, intermittent drains, or linear waters of the United States (waters of the U.S.) that vary from 2 feet to 15 feet in width. The northernmost drainage is fed by a man-made pond while the other two are fed by precipitation runoff. The entrance road has been designed to cross these linear drains at as near to perpendicular angles as possible. A typical cross section of an impacted stream crossing is provided in Figure 2. Two of the systems within the entrance road corridor are small, spring-fed vegetated wetlands that eventually drain into linear tributaries. The northern wetland supports a mixture of emergent and forest vegetation. Impacts to this wetland have been minimized (0.01 acre) and impacts to the associated stream have been avoided by shifting the entrance road to the east. The southern wetland is one of a series of wetlands that occur on a timbered slope. This wetland was disturbed by machinery during recent logging operation and presently supports emergent vegetation in tire ruts. Impacts to this wetland have been minimized (0.07 acre) by shifting the entrance road to the west. Jurisdictional areas were delineated in the field in September 1997. The delineation was verbally verified by you following a field visit on 15 October 1997, and the delineation survey plat was signed on June 11, 1998. The crossing on Sheet 3 of 7 will impact approximately 0.01 acre of vegetated wetland. No streams occur within the main body of the development. Block 12. The proposed work in surface waters involves the construction of a culverted crossing at each of three unnamed tributaries to High Rock Lake using 24-inch reinforced concrete pipes. The area around the pipes will be backfilled with soils from adjacent uplands, and the pipes will have a minimum of 4 ft of cover. Two, small vegetated wetlands will be backfilled with soils from adjacent uplands. The road surface will consist of two 10-ft, asphalt, travel lanes and an 8-ft grassed shoulder on each side. Final fill slopes have been stabilized by a maintained grass cover. The crossings have been designed to prevent the restriction of , and to withstand, expected high flows, and to prevent the restriction of low flows and the movement of aquatic organisms. The crossings conform to guidelines outlined in the North Carolina Sediment Control Planning and Design Manual. Appropriate sediment and erosion control practices will be implemented during construction. After construction, all sediment and erosion control practices placed in wetlands or waters shall be removed and the natural grade restored. Block 13.
