APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Ms. Horvat:
You have our approval, in accordance with the attached conditions and those listed below, to
place fill material in 1,118 square feet of wetlands for the purpose of constructing a driveway at
1057-B Twiford Road, Kitty Hawk as described in your application dated January 21, 2000. After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3112. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will
expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must
follow the conditions listed in the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and
streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms
shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

PROJECT SETTING
The applicant's property is located at1057 B Twiford Road (SR1207), adjacent to Sage Swamp, in Kitty Hawk,
Dare County. The applicant, Kristina Horvat, purchased 2.47 acres from the adjacent property owners Ruth and
Kenneth Tillett in 1995, and constructed a dwelling on the site. An existing dirt lane that passes through the front
yard of the Tillett's singlewide mobile home, bisecting the property, accesses Ms. Horvat's property. A 20' wide
access was deeded to Ms. Horvat at the time that the property was purchased, but has not been improved to date.
The deeded access is located along the western edge of the Tillett property, adjacent to Sage Swamp, and is
described in "Exhibit A" of the deed submitted.
Ms. Horvat's property begins 433 feet south of Twiford Road and is bounded to the north by the Tillett's.
Average elevation of the site is approximately 7.5 feet above normal water level and is greater that that of the
surrounding properties. Sage Swamp extends from Twiford Street along the southern boundary of the Tillett and
Horvat tracts, circles around the southern side of Ms. Horvat bisecting it into two high ground ridges that run in
a north south direction.
Approximately 1,118 square feet of delineated freshwater wetlands is located along the western edge of the
common property line between the Tillett's and the applicant. The wetland area has been delineated by the Corps
of Engineers, and lies within the applicant's deeded easement. Wetland vegetation includes approximately 1,088
square feet of cattail (Typha sp. ), and 30 square feet of saw grass (Cladium jamaicense) on the landward side of
the cattail.. High ground on the applicant's property includes, but is not limited to; deciduous hardwoods
intermixed with pine and an understory mix of red bay (Persea borbonia), wax myrtle (myrica cerifera),
groundsel tree (Baccharis halimifolis), Virginia-creeper (Parthenocissus quinquefolia), and poison-ivy
(Taxicodendron radicans).
Existing structures on the applicant's property include a single-family residence with associated septic system and
a six-foot privacy fence along the northern property line. A parking area is provided under the residence and is
access by an unimproved drive. Approximately 575 square feet of the residence and existing access are located
within the Estuarine Shoreline Area of Environmental Concern (AEC) on the applicant's property and 616 square
feet of the singlewide mobile home is located within the AEC on the Tillett's. While the applicant's residence is
located within the Estuarine Shoreline AEC and is consistent with the rules, it appears that the Town of Kitty
Hawk failed to require a CAMA Minor Permit for construction.
Kitty Hawk Bay and its tributaries are classified as joint waters by agreement between the Marine Fisheries
Commission and Wildlife Resource Commission. The Division of Environmental management's water quality
classification for Kitty Hawk Bay is SP (Fish Propagation). Review of available information indicates that there
are no known archeological sites or geological formations associated with the applicant's property.

PROJECT DESCRIPTION
The applicant proposes to construct a 15' wide access road along a 20' wide deeded easement for a distance of
513'. According to the deed, the easement runs along the western edge of the Tillett tract, adjacent to Sage
Swamp. With the exception of approximately 92', the area where the road will be located is stable and will
require little improvement. Will not essential some dirt and gravel will be added to the surface. Approximately
92' of the road, located along the Tillett/Horvat property line, will require approximately one foot of fill to
stabilized the area for road use. The applicant proposes to place sand and dirt fill topped with gravel. The total
area of fill within the Estuarine Shoreline AEC for the access road will be approximately 7,614 square feet, and
of that 1,118 square feet will be in delineated 404 wetlands. The proposed road will result in 6,496 square feet
of impervious surface on the Tillett tract and 1,200 on the Horvat tract. Total impervious will be less that 30%
on each tract.

• A copy of the deed (with state application oniv) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11 " white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary.
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and

PROJECT DESCRIPTION
The applicant proposes to construct a 15' wide access road along a 20' wide deeded easement for a distance of
513'. According to the deed, the easement runs along the western edge of the Tillett tract, adjacent to Sage
Swamp. With the exception of approximately 92', the area where the road will be located is stable and will
require little improvement. ww not essential some dirt and gravel will be added to the surface. Approximately
92' of the road, located alone Tillett/Horvat property line, will require approximately one foot of fill to
stabilized the area for road use. The applicant proposes to place sand and dirt fill topped with gravel. The total
area of fill within the Estuarine Shoreline AEC for the access road Will be approximately 7.614 square feet. and
of that 1.118 square feet will be in delineated 404 wetlands. The proposed road will result in 6,496 square feet
of impervious surface on the Tillett tract and 1.200 on the Horvat tract. Total impervious will be less that ;0 q
on each tract.
