We have been working with Emily Greer to address the Corps' review comments, including an on -site meeting with her to evaluate the off -site portion of sanitary sewer (Emily confirmed no additional jurisdictional features there). Through that same time period, we have been working with the civil engineer for this project to get drawings that address all of your office's comments and the Corps' comments. We don't have everything we need from the civil engineer yet, and I emailed him again yesterday as a reminder that we need his information for a complete resubmittal. January 28, 2020 Mr. Chad Turlington NCDEQ — Division of Water Resources 512 North Salisbury Street 1617 Mail Service Center Raleigh, North Carolina 27699-1617 Re: Purfoy Place Subdivision Fuquay-Varina, Harnett County DWR # 19-1406 Mr. Turlington: This letter is in response to review comments we received regarding proposed Purfoy Place Subdivision in Fuquay-Varina (Harnett County), and associated wetland and stream impacts proposed for this activity. Responses to review comments are provided below. NCDEQ — Division of Water Resources Comments: 1. On the Overall Grading & Drainage Plan (C 2.0), please remove the topographical layer, clearly label impact locations and clearly show all streams and wetlands. The PCN application for this project was submitted through the ePCN portal. Impact maps drawn to scale on 11x17" drawings were uploaded through that portal, but those maps apparently did not transmit. Please accept the attached impact maps to address this review comment, as these clearly illustrate and label all impact locations, as well as all streams and wetlands. 2. Please reduce the number of topo contours on sheets C2.1 and C2.3 so that impacts can be seen more clearly. Please accept the attached impact maps to address this review comment. 3. Please provide documentation as to why it is necessary to relocate the stream, which would result in 249 linear feet of stream impacts. This office believes that this impact could be eliminated or minimized to reduce impacts to the stream. The site layout that was provided to the USACE with the delineation request (see attached) was created prior to detailed review by Harnett County staff. You will notice on this layout that all proposed lots extend to the parent tract boundaries. Though Harnett County's review process, a 15 foot perimeter buffer was required around the entire parent tract boundary, as illustrated on the attached "Overall Subdivision Plan", dated December 10, 2019. This resulted in a concurrent 15 foot reduction of available lot depth, which rendered lot 20 on the original site layout submittal, non -buildable. To address this issue, the cul-de-sac bulb was 1501 Lakestone Village Lane, Suite 205 Fuquay-Varina, North Carolina 27526 919-669-0329 shifted southward to allow the creation of buildable lots north of this cul-de-sac. This southward cul-de-sac bulb shift requires a fill slope that will impact a significant portion of the intermittent stream south of the cul-de-sac. The only way to avoid fill slope impacts at this location involves the installation of a 130 foot long, 10 foot tall, retaining wall north of the stream, which is impractical due to concerns about long-term stability and maintenance, as well as safety. Since avoidance of this stream impact is impractical, the stream has to be piped or relocated. The engineer and owner have chosen to relocate the stream as illustrated in order to avoid piping the stream, while also enabling the development of proposed lot 28. Relocation of the stream will enable continued stream functions to replace those lost for the impacted segment, while piping would result in a complete loss of function. Since the relocated stream will replace the functions lost from impacted stream segments, we ask that you not classify this proposed impact as a permanent loss. 4. If the stream relocation impact cannot be eliminated, please provide a detailed plan for how the stream will be relocated and design for the new channel. Please show both existing and relocated channel. Please provide a stream monitoring plan that monitors the relocated stream channel for a minimum of three years to ensure that natural stream function and a stable channel is achieved. The stream relocation would also be viewed as a permanent impact. Attached drawing C 2.4 illustrates the proposed stream relocation, including a detailed grading plan, a longitudinal profile, and several cross -sections. This plan also notes the relocated stream shall be lined with a fully biodegradable erosion control blanket to protect bare soils until seeded and planted vegetation can assume this roll of soil stabilization. For stream monitoring, we propose the following data collection once per year for three years after installation: A. Three stream/channel cross-section locations will be permanently marked using iron rods, iron pipes, or PVC pipes, driven into the ground. Cross- section data will be collected at all of these locations, using a laser level. B. Stream channel profile will be monitored using tape measures and a laser level. A stream profile drawing will be created using this data, including a minimum 50 feet upstream and downstream of the relocated stream. C. Vegetation establishment will be photographically documented. D. Stream channel stability will be photographically documented. E. Stream channel function will be documented using the NC Stream ID Form Version 4.11. All collected data will be provided to you in an annual stream monitoring report, including plotted cross -sections, stream profile, photographs with explanatory captions, and completed Stream ID Forms, as supporting information. 5. Please provide the Division a copy of your response to November 7, 2019 email from the U.S. Army Corps of Engineers requesting additional information. The response to this "Incomplete Notification/Request for Additional Information" email could result in changes to impact amounts and is therefore necessary for DWR to complete a review of your application. You were copied on our email response to the USACE earlier today. Please confirm receipt of that email with six attachments. 2 Please note three modifications to the impact maps, including a correction of wetland boundaries and impact area for Impact 1 (subdivision entrance), an increase of stream impact length at Impact 3 (stream relocation at cul-de-sac), and the addition of a new sanitary sewer crossing to serve lot 27, labeled as Impact 5. The wetland boundary at Impact 1 was illustrated incorrectly on the initial PCN application. That issue has been corrected on the attached revised impact maps. As a result, wetland impacts at Impact 1 have increased from 2,704 sf to 3,800 sf. At Impact 3, stream impact length increased from 249 ft to 265 ft during the detailed stream relocation design. Impact 5 is an open cut across the intermittent stream to install a new sanitary sewer service for lot 27. This impact was originally planned as a bore under the stream, but steep slopes on both sides of the stream were found to make boring under this stream impractical.
