Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to impact 0.968 acres of wetlands
for the purpose of constructing the Wynston Subdivision at SR1551 and SRI 550, as you described in your application dated
January 17, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers
issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other
federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying
404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed
in the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas within 50
feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These
mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later).
2. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream buffers.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

,Jr An additional condition is that a final, written stormwater management plan for stormwater runoff from this project shall be
approved by this Office before the impacts specified in this Certification occur. The stormwater management plan must include
plans and specifications for stormwater management facilities designed to remove 85% TSS according tot he most recent version
of the NC DENR Stormwater Best Management Practices Manual. Also, before any permanent building is occupied at the subject
site, the stormwater facilities, as approved by this Office, shall be constructed and operational, and the stormwater management
plan, as approved by this Office, shall be implemented.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of
the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina

careful attention.
Says that South Creek is not impacted by this
project but there is a new interchange
planned off of I 40 for the golf course that must
cross it. 260 ft of Xing Walnut
Creek requires mitigation $$$$$. There also is
impact to 200 ft of UT to Walnut and
an additional crossing of water of the Neuse at the
Sod Fathers old pig farm.. And do
NOT FORGET the impacts that they propose at the golf
course.

The purpose of this letter is to request the use Nationwide Permit 26 and confirmation of comply with
the Neuse River Buffer Regulations for the construction of the proposed Wynston Subdivision looted
south of the intersection of Guy Road (S.R. 1551) and Winston Road ( S.R. 1550) and is bisected by
Amclia Church Road (S.R. 1552) (UTM Coordinates; Zone 17, 3947300 N, 725800 E). Proposed impacts
to waters for the construction of the residential subdivision will total 0.968 acres for the construction of
two road crossings and lot fill areas. Of the 0.968 acres of impacts to wetlands, two road crossings make
up 0.397. Construction of the subdivision will comply with the general conditions stated within
Nationwide Permit 26.
S&EC, Inc. believes that no wetland or stream mitigation will be required for this project because the total
amount of area impacted is only 0.968 acres (within the limits of Nationwide Permit 26) and no
significant channels were crossed. For this application, there arc no impacts to streams potentially
containing "importance" to significant aquatic function. If for some reason wetland mitigation is
required, our client proposes payment into the North Carolina Wetland Restoration Fund.
The surface waters subject to the Neuse River Buffer regulations (15A NCAC 2B .0233) were determined
on July 1, 1998 by Mr. Steve Mitchell of the NC Division of Water Quality (DWQ). There are no
proposed impacts to either Zone 1 or Zone 2 of the Neuse River Buffers.
Included are: (1) a completed Pre-Construction Notification Application, (2) Agent Authorization Form,
(3) USGS Site Vicinity Map, (3) Site Plans, (4) Wetland Delineation Forms and (6) a check for $200.00 to
cover the permit application fee.
