Dear Mr. Martin:
The referenced project involves the installation of approximately 2,600 linear feet of 8-inch
gravity sewer line; which is proposed to generally follow the run of Williams Creek from
the Brookfield Subdivision to the Town of Apex's existing gravity sewer line immediately
downstream of U.S. 64. When completed, this project will enable the Town of Apex to
abandon the old Brookfield Pumping Station and to enable the adjacent service area to
receive gravity sewer service. The Apex Senior High School will also be able to abandon
its private pumping station in favor of gravity sewer service.
The project will necessitate the crossing of a small section of wetlands (approximately
0.024 total acres), which were identified and mapped by your firm. Also, the project will
involve the crossing of Upper Williams Creek at two locations, plus a crossing of a small
tributary (ditch) at another location.
We made every possible effort to assure that the area to be disturbed for construction of
the sewer line is outside of the 50' Neuse River Buffer area - Zones 1 and 2. However, in
the area downstream of Manhole #4, we found that we had to encroach within the Zone 2
Buffer (>30'<50'), in order to facilitate the connection to the existing sewer line in Laura
Village Drive. Near the point of connection, the design necessitated construction by
boring and jacking to eliminate any disturbance within Zone 1. We also had to redesign a
portion of the segment immediately upstream of U.S. 64 for similar reasons.
Enclosed are 11" X 17" prints of our construction drawings along with two (2) diskettes
with our drawing files for the project in case you need them. On behalf of the Town of
Apex, I would appreciate your preparing and submitting the necessary applications for the
stream crossings and wetland encroachments for this project. You have previously
received the necessary authorization form signed by Mr. Tim Donnelly, P.E., Director of
Public Works and Utilities for the Town.

APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules

Dear Sirs:
You have our approval, in accordance with the attached conditions, to fill 0.024 acre of wetland for the purpose of sewer
line construction in Wake County as you described in your application received by the Division of Water Quality on January
14, 2000. After reviewing your application, we have determined that this action is covered by General Water Quality
Certification Number 3101. This Certification allows you to use Nationwide Permit Number 12 when issued by the U.S.
Army Corps of Engineers. This approval is also valid for the Neuse River Buffer Rules (15A NCAC 2B .033). In addition,
you should get any other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when
the accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If you
change your project, you must notify us and you may he required to send us a new application. If the property is sold, the new
owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If
total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in
15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise
provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This
certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

'File purpose of this letter is to request the use of Nationwide Permit 12 and confirmation of compliance
with the Neuse River buftcr regulations liar the project known as Town of Apex / Trunk Sewer
Extension. The property is located west of Laura Duncan Road (SR 1308) and east of the CSX railroad
near the intersection of US 64 in Apex, NC (NC Grid N-726685, E-2047446). The site is shown on the
attached plans and USGS Topo Quad vicinity map. Impacts totaling 1045 sq. ft of vegetated wetland and
90 linear feet of Waters (390 sq. ft) are proposed (see impact map) for the installation of approximately
2600 linear feet of 8" gravity sewer. Impacts to Waters will involve three-30' perpendicular crossings.
Construction of the sewer line will comply with the general conditions of Nationwide Permit 12.
Therefore this application does not request written concurrence from the DWQ for 401 certification
nor does it contain payment for 401 certification. S&EC, Inc. believes that no stream mitigation will be
required for this project because the sewer line crossings covered under Nationwide Permit 12 typically do
not require mitigation. If for some reason mitigation is required, our client proposes payment into the
North Carolina Wetland Restoration Fund.
Surface waters subject to the Neuse River buffer regulations have not been confirmed by the NC DWQ.
The riparian buffer on the attached map is taken from top of bank on surface waters shown on the most
recent USGS "Apex" topo quad and/or Wake County Soil Survey. Three perpendicular crossings of an
unnamed tributary subject to the buffer, each 30-feet wide, are proposed for the project. These proposed
crossings are exempt from buffer notification. With the exception of the perpendicular crossings, no
impacts to Zone I are proposed. The proposed alignment of the sewer corridor as shown from manhole I
to the existing sanitary sewer to the west (approx. 300 linear ft) will involve underground boring resulting
in no disturbance of the ground surface within Zone 1. With the exception of perpendicular crossings the
sewer line enters Zone 2 and runs in a parallel fashion approximately 550 linear feet involving approx.
11,000 ftZ of Zone 2. The proposed impacts are allowed under the current Neuse River buffer regulations
without requiring a variance from the Environmental Management Commission and without buffer
mitigation. The attached letter from Tate Lanning & Assoc. outlines the need to impact Zone 2 of the
buffer.
Included are: (1) a completed Pre-Construction Notification application, (2) Agent Authorization Form, (3)
USGS Site Vicinity Map, (4) Site Plans, (5) Justification Letter, and (6) Wetland Delineation Forms.
