Utilities would be installed within a planned road right-of-way which contains the only wetland crossing on the 117-acre tract. The location of this road crossing has been placed at the narrowest section of the wetland, and installation of utilities within the right-of-way minimizes wetland disturbance to a single location. Two trenches, 2'-wide each, would be placed 46' apart on opposite sides of the right-of-way. This would result in approximately 430ft2 of temporary wetland disturbance. Following installation of the utility lines, the wetland area will be returned to original grades. A courtesy copy of this application is being provided to the NC Division of Water Quality. Permanent wetland impacts within this road right-of-way have already been permitted under a 401 Water Quality Certification, DWQ # 000041. However, fill for the road itself has not been installed since Corps approval for that activity has not been obtained. The need to install utilities at this time, prior to Corps approval for actual road fill, has resulted from the timing of utility installation. As upland portions of the property are being developed, utility lines are installed in loops. There is a need to complete the loop containing this wetland crossing at the time utility crews are on-site. Attached with the application is a "Project History/Future Plans Supplement" which further describes these issues. There is no wetland fill in the right-of-way at this time. Installation of actual road fill was requested in 1/2000 under a joint Nationwide 14/401 Certification request. At that time, mitigation was proposed since cumulative wetland impacts for the overall St. James Plantation exceeded State and Federal thresholds. Although a 401 Certification was issued (DWQ # 000041), the Corps decided the road could not be issued under a Nationwide Permit and that an Individual Permit would be required. In spite of this change, the mitigation plan was implemented "up-front" (without an approved Corps permit) since construction in the area surrounding the mitigation site was already scheduled and underway. The utility installation requested in this application is not a permanent impact, and therefore remains eligible for a Nationwide 12 permit without a requirement for mitigation. However, it is noted that mitigation for the entire road right-of-way (in which the utilities will be placed) has already been mitigated for at a 2:1 ratio. Future Plans: An individual permit will be submitted in the near future and will request wetland fill for the road crossing shown in this application, and all remaining road crossings on the 2400- acre and Paladin tracts. The 2400-acre and Paladin tracts are currently being delineated and surveyed so that all remaining wetland impacts within St. James Plantation may be submitted in a single application. However, the utility installation requested in this application has been separated due to timing issues. Utilities are being installed on the remainder of the Tri-Brunswick tract, with the exception of this one crossing, in ACOE- approved upland areas. Since the utility installation is scheduled with the County and is installed in loops, more immediate authorization was needed for this activity. All permanent impacts at the crossing will be addressed in the future Individual Permit application. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. All roads have been planned so as to avoid wetland crossings to the greatest extent practicable. A single road crossing is needed on this 117-acre tract, and is the crossing shown in this application. The crossing was placed at the narrowest section of the wetland to minimize impacts. In addition, the installation of utilities within the road right-of-way minimizes all wetland impacts to a single and distinct location. Following utility installation, original wetland contours would be returned to original grades. VII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide,html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. North Carolina 28461 Dear Sir or Madam: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.11 acres of wetlands and 0.93 acres of ditches for the purpose of constructing a residential development at a part of St. James Plantation as described in your application dated January 6, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Compensatory wetland mitigation is required for the 0.11 acre of wetland impact. Applicant shall provide a written mitigation plan to DWQ for written approval within one month of the date of this Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. On- site wetland creation adjacent to the same impacted wetland system totaling .25 acres is to take place within two areas within 240' of the road crossing. These are shown as wetland areas A and B on the enclosed wetland mitigation drawing. Wetland area A is located to the east of the road crossing near the tee area for golf course hole #8. This 7,000 square foot area will be graded down to form an emergent wetland shelf with <<<' ,' water depths to 6". Emergent wetland species from pond edges within the nearby developed subdivisions and selected commercially available aquatic specimens will be planted in this area. Desired species include himhristylis sI)cidicea, Pellandra virginica, Potygonum hydrol)il)eroides, Ponlederia cordala, Saururu,v cernuus, Nymphaea odorala, Ycirl)us rohuslus and Typha auguslifolia. Additionally in this area, four 6' to 8', container grown nixodium distichum trees will also be planted within the central portions of the mitigation area. This emergent wetland area will adjoin a deeper pond to the east. The combined system is designed to compliment the existing wetland and provide a diverse array of shelter and food sources for waterfowl, amphibians and reptiles. Any overflow of water from large rainfall events will be directed toward the existing wetland to the west through sheet flow over a level gradient. Wetland area B is located to the southwest of the road crossing and also adjacent to the existing wetland. A 4,000 square foot area is to be graded down to produce elevations which range from featuring soil saturation within the upper 12" for more than 5% of the early growing season to a potential 6" maximum inundation after root mat addition and planting. The adjacent existing wetland will serve as the reference for the establishment of proper elevation. Root mat and associated upper hydric soil material will be removed from the road crossing area and spread within the mitigation area. The root mat will contain living root and stems of the native wetland C flora which include I,yonia hicida, Cyrilla racemiflora, Ilex glabra, Persea borbonia, Magnolia virginiana and Smilax lauri folia. The 0.11 acre road crossing is being requested in order to access additional lots/uplands within the project. The crossing has been located as to cross the wetlands at its narrowest point to minimize wetlands impact. The original ditches determined to be Waters of the US by the US Army Corps of Engineers are also being requested to be filled. The total linear footage of the ditches is 10704 feet with an average width of 3.8 feet totaling 0.93 acre. In order to further minimize wetlands impact the original lots which impacted jurisdictional wetlands have been eliminated from this project.
