Reference you application for a Department of the Army (DA) permit to extend bulkheads/jetties to stabilize the access channel, excavate the entrance channel, and place two marker pilings in Greenville Sound, Wilmington, New Hanover County, North Carolina. Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. 198000291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in civil and/or administrative penalties. Pleas be advised that the following are conditions of this DA permit: The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 2. The permitted work must commence by August 4, 2001, the expiration date of general permit No. 198000291. If work will commence after August 4, 2001, it must not begin until the applicant has received written verification from this office that the work complies with all new conditions of the renewed general permit. 3. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Such action is necessary as revised plans must be reviewed and the authorization modified. CAMA Major Development Permit application Dear Jeff, After receipt and consideration of federal and state comments regarding the proposed project, the applicant has authorized me to respond to agency concerns and to present a modified version of the project for approval. Copies of this letter will serve to inform multiple federal and state agencies of plan modification and to provide them with additional information. I have enclosed a revised sheet 2 of 9 (dated 2/10/00) of the application materials detailing the current proposal. The original sheet 2 of 9 (dated 11/1/99) should no longer be used. Accordingly, I have also enclosed an updated application form which reflects this new plan. For further information, I have enclosed supplemental sheets 1 and 2 (dated 2/10/00) which consist of labeled photographs. Changes to the proposed project include the elimination of the flared channel end near the AIWW end. This reduces the dredging footprint to the same area already permitted for excavation (Permit # 31-98) and avoids impacting formerly undredged areas of PNA. The channel bulkheads have also been reduced in length to correspond to the outermost position of the existing channel marker pilings. This equates to a reduction of 102' on the north side and 109' on the south side. The bulkheads will remain 217from the edge of the AIWW channel. In order to minimize the frequency of future maintenance dredging events, the applicant proposes to dredge to a depth of -8' MLW from the outer end of the channel (AIWW depths are to -16' MSL nearby) to the outer end of the channel bulkheads. Depths within the channel bulkheads will be -6' MLW. Past dredging events occurred in 1991, 1995 and 1998. The estimated frequency of needed maintenance dredging now without the bulkhead extension and a -8' MLW depth are once a year due to the presence of a large sand shoal near the southern side of the channel (see supplemental sheet 1). It is hoped that the activity as proposed will reduce the maintenance frequency to once every 3 to 4 years by creating a larger capacity for sand accumulation and physically protecting a portion of the channel. The extension of the bulkheads should not present a hazard to navigation since they will only extend to the outermost position of the existing structures (marker pilings). The existing sand shoal now also severely limits the potential for boat passage across this area. The applicant will additionally install two more marker pilings midway along the bulkhead extensions to further define the channel for safety purposes. All marker pilings are to feature lights or reflectors for night visibility. It should be emphasized that the structures will remain 217' from the near edge of the AIWW channel. The existing pier to the north (see supplemental sheet 2) extends 104' further toward the AIWW channel than the proposed bulkhead extensions. The applicant's request for the ability to construct floating wave runner berths and to have the ability to dock wave runners or other small craft inside the exiting marina slips alongside the primary vessel has been made to cover any potential such circumstances. It is highly unlikely that more than a small percentage of the slip users would actually do this, but permission is needed to cover all slips equally and fairly. Any second small craft (wave runner, dinghy) within a slip will not have either a heads or cabin. Furthermore, the Shellfish Sanitation Office has been contacted regarding this additional slip usage and has indicated that there would be no need to extend the closed shellfishing area based on the request. Several positive aspects of the project include the avoidance of excavation or fill within wetlands; performing the dredging activity prior to the seasonal moratorium related to juvenile species development within the estuary and endangered species utilization; the utilization of mats for equipment access through a formerly-used, less vegetated area of the intertidal zone on the dredge spoil island; the project area is outside ORW; the absence of any SAV's in the project area; and the preservation of a navigable channel for continued use by boaters. PROJECT SUMMARY: The marina Association wishes to obtain a permit to extend jetties to stabilize their access channel, to excavate a flared end at the entrance channel, and allow an Turtle Harbor Association, Inc. Page Two owner to moor an additional jet ski/wave runner or small skiff within his existing slip, adjacent to his primary vessel. 9. PROJECT DESCRIPTION The project site is the existing community marina for Turtle Hall subdivision, located at the end of Hawksbill Dr., off of Greenville Loop Road, adjacent to Greenville Sound, in New Hanover County. The original basin and channel excavation was authorized in 1977, under State Permit #102-77. Subsequent modifications and upland development were permitted in 1985, under State Permit # 201-85. The Turtle Harbor Association, Inc., the group of property owners with deeded boat slips, now own and manage the community property. In 1998; the Association obtained State Permit # 31-98 authorizing the maintenance dredging of the facility. This permit will remain active until 12/31/01. The 2.85 acre boating facility consists of a bulkheaded boat basin, approximately 270 feet long and 220 feet wide, and an access channel, approximately 1160 feet long and 20- 30 feet wide. The bulkhead continues along that portion of the entrance channel through the marsh. The last 180 feet of the access channel, adjacent to the Atlantic Intracoastal Waterway (AIWW) was permitted at a width of 30 feet. There are forty-one (41) boat slips arranged along floating docks and finger piers, within the boat basin. Five (5) individual docks are located on Lots 26-30, along a portion of the access channel. The original basin was permitted for forty-nine slips. In the project area, the waters of the are classified as SA, by the NC Division of Water Quality, and they are CLOSED to the harvest of shellfish within 275 feet of the docking facility. These waters are designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The Atlantic Intracoastal Waterway is approximately 750 feet wide at the project area. The applicants are proposing to extend the entrance channel bulkheads/jetties into open water to prevent channel shoaling and reduce the frequency of maintenance excavation. The bulkheads would be extended 260 feet on the north side of the channel and 275 feet on the south side of the channel, with two (2) new marker pilings installed at each of their waterward ends. Bulkhead/jetty construction would be typical piling and whaler design, with 2 inch, V- groove sheathing boards. The structure would be supported by steel tie-back rods to a series pilings located 10 feet north and 10 feet south of their respective channel walls. The ends of the proposed jetties would terminate 115 feet from the Atlantic Intracoastal Waterway (AIWR) channel. The applicants also propose new excavation where the channel meets the AIWW. They propose to flair the channel mouth to a width of 215 feet, over the last 100 feet of the permitted channel, and to a depth of eight (8) feet. The Association's final proposal does not involve any additional construction. It consists of a request to expand the utilization of their existing slip arrangement to allow the docking of two (2) vessels per slip. This request has been prompted by numerous requests from slip owners to be allowed to add jet ski ramps or tie a small skiff or jon boat adjacent to their primary vessel, within the same boat slip. ANTICIPATED EVIPACTS The proposed jetty constriction, including the tie-back system, would result in the incorporation 5350 square feet of estuarine/public trust waters. The channel jetties would protrude approximately 275 feet into navigable waters of the AIWW, and may create accelerated erosion to the salt marsh on either side of the channel. As proposed, the jetties would be submerged at high tide, with marker pilings only at their waterward ends. This design creates a potential safety and hazard. The proposed flair at the end of the entrance channel would disturb approximatel 47?Vea 0 s are feet of previously undisturbed, shallow bottom habitat, within a designated primary nur (PNA), as well as, deepening 3000 square feet of previously dredged shallow bottom, from -6 to -8 feet deep at mean low water. The deposition of excavated sediments would disturb 180,000 square feet of the existing permitted highground spoils disposal area. The channel flair would create an additional 500 700 cubic yards of spoils materials over the previously permitted volume. The boat slip utilization request would effectively double the number of vessels that could be docked at this facility, from 41 to 82. PROJECT SUMMARY: The marina Association wishes to obtain a permit to extend jetties to stabilize their access channel, to excavate a flared end at the entrance channel, and allow an Turtle Harbor Association, Inc. Page Two owner to moor an additional jet ski/wave runner or small skiff within his existing slip, adjacent to his primary vessel. 9. PROJECT DESCRIPTION The project site is the existing community marina for Turtle Hall subdivision, located at the end of Hawksbill Dr., off of Greenville Loop Road, adjacent to Greenville Sound, in New Hanover County. The original basin and channel excavation was authorized in 1977, under State Permit #102-77. Subsequent modifications and. upland development were permitted in 1985, under State Permit # 201-85. The Turtle Harbor Association, Inc., the group of property owners with deeded boat slips, now own and manage the community property. In 1998, the Association obtained State Permit # 31-98 authorizing the maintenance dredging of the facility. This permit will remain active until 12/31/01. The 2.85 acre boating facility consists of a bulkheaded boat basin, approximately 270 feet long and 220 feet wide, and an access channel, approximately 1160 feet long and 20- 30 feet wide. The bulkhead continues along that portion of the entrance channel through the marsh. The last 180 feet of the access channel, adjacent to the Atlantic Intracoastal Waterway (AIWW) was permitted at a width of 30 feet. There are forty-one (41) boat slips arranged along floating docks and finger piers, within the boat basin. Five (5) individual docks are located on Lots 26-30, along a portion of the access channel. The original basin was permitted for forty-nine slips. In the project area, the waters of the are classified as SA, by the NC Division of Water Quality, and they are CLOSED to the harvest of shellfish within 275 feet of the docking facility. These waters are designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The Atlantic Intracoastal Waterway is approximately 750 feet wide at the project area. The applicants are proposing to extend the entrance channel bulkheads/jetties into open water to prevent channel shoaling and reduce the frequency of maintenance excavation. The bulkheads would be extended 260 feet on the north side of the channel and 275 feet on the south side of the channel, with two (2) new marker pilings installed at each of their waterward ends. Bulkhead/jetty construction would be typical piling and whaler design, with 2 inch, V- groove sheathing boards. The structure would be supported by steel tie-back rods to "a series pilings located 10 feet north and 10 feet south of their respective channel walls. The ends of the proposed jetties would terminate 115 feet from the Atlantic Intracoastal Waterway (AIWW) channel. The applicants also propose new excavation where the channel meets the AIWW. They propose to flair the channel mouth to a width of 215 feet, over the last 100 feet of the permitted channel, and to a depth of eight (8) feet. The Association's final proposal does not involve any additional construction. It consists of a request to expand the utilization of their existing slip arrangement to allow the docking of two (2) vessels per slip. This request has been prompted by numerous requests from slip owners to be allowed to add jet ski ramps or tie a small skiff or jon boat adjacent to their primary vessel, within the same boat slip. ANTICIPATED IIVIPACTS The proposed jetty constriction; including the tie-back system, would result in the incorporation of 5350 square feet of estuarine/public trust waters. The channel jetties would protrude approximately 275 feet into navigable waters of the AIWW, and may create accelerated erosion to the salt marsh on either side of the channel. As proposed, the jetties would be submerged at high tide, with marker pilings only at their. waterward ends. This design creates a potential safety and navigational hazard. The proposed flair at the end of the entrance channel would disturb approximately 4750 square feet of previously undisturbed, shallow bottom habitat, within a designated primary nursery area (PNA), as well as, deepening 3000 square feet of previously dredged shallow bottom, from -6 to -8 feet deep at mean low water. The deposition of excavated sediments would disturb 180,000 square feet of the existing permitted highground spoils disposal area. The channel flair would create an additional 500 700 cubic yards of spoils materials over the previously permitted volume. The boat slip utilization request would effectively double the number of vessels that could be docked at this facility, from 41 to 82. In my discussions with the Shellfish Sanitation Office, I have been told this would not lead to the extension of the shellfish closure area. The extension of the channel bulkheads will serve-to keep sand from accumulating within the channel and therefor support a safe, navigable marina entrance with less frequent maintenance dredging needed. The bulkhead extensions will be constructed in the same manner as the existing structures which are submerged at high tide. Marker pilings with reflectors along the extended bulkheads will provide for clear channel identification. Insufficient evidence is present in our files to conclude that your project must be builras planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you have a viable community marina without dredging this PNA area? We are also concerned that the channel extension would result in cumulative impacts to the salt marsh. Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Please respond within three weeks of the date of this letter by sending a copy of this information to me and one copy to Joanne Steenhuis, Wilmington DWQ Regional Office at 127 Cardinal Drive Extension 910-395-3900. If we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn.
