We have further redesigned the sewer line to minimize impacts in accordance with the Neuse River Buffer requirements. In the area of Station 27+00 to 30+00, the line is still in the 50' buffer area. However, a large portion of the buffer in this area is cleared for the existing sewer line. With the new interceptor construction, the existing 8" sewer line between Station 24+00 and 32+50 will be abandoned. As mitigation for the tree removal to construct the new line between Station 27+00 and 30+00, we propose to revegetate the existing easement which will be abandoned between Station 24+00 and 29+00. Boylan Avenue Raleigh, NC 27603-1402 Re: Raleigh/Crabtree Creek Sewer Interceptor Parallel, Section IV Dear Ms. Jackson, You have our approval, in accordance with the attached conditions, to place fill within streams and protected riparian buffers for the purpose of constructing the Crabtree Creek Sewer Interceptor Parallel, Section IV, as described within your application dated 11/12/99 with modifications as identified within your revision letter and plans dated 3/17/00. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit Number 12 when the Corps of Engineers issues it. This approval is also valid for the Neuse buffer rules (15A NCAC 213 .0233). In addition, you should get any other required federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control and Non- Discharge. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application and proposed construction plans as identified within your revision letter and plans dated 3/17/00. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Approval from the DWQ is required for the proposed impacts. The proposed line will be impacting several sections of Zone 1 of the riparian buffers that will require mitigation and Zone 2 that require written authorization. In addition, the proposed line contains a crossing of a tributary stream of Crabtree Creek that does not follow the conditions of certification listed under the general certification for projects eligible for Corps of Engineers Nationwide Permit 12 or Regional Permit 198100049 and therefore will require written authorization. Detailed below is a listing of impacts to Neuse River Riparian Buffers for the proposed project. 1. STA 14+35 - Crossing of an intermittent stream subject to the Neuse River Riparian Buffers (indicated on either the USGS topographic quadrangle or soil survey). This crossing was determined to meet the requirements to be considered an "exempt" activity, not requiring written authorization from the DWQ. 2. STA 20+50 - Crossing of an intermittent stream subject to the Neuse River Riparian Buffers (i.e., indicated on either the USGS topographic quadrangle map or soil survey). This crossing was determined to meet the requirements to be considered an "exempt" activity, not requiring written authorization from the DWQ. 3. STA 28+00 to STA 32+75 - Impact other than a perpendicular crossing in Zone 1. The proposed line running parallel to Crabtree Creek will impact Zone 1 of the riparian buffers. This impact is considered to be an "Allowable with Mitigation" activity. The required area of mitigation will equal the area (square feet or acres) of Zone 1 impacted by this section of the line multiplied by 3 (15A NCAC 213 .0242). The crossing will need to follow all of the conditions of certification for Nationwide Permit 12. 7. STA 44+00 - Impact other than perpendicular crossing in Zone 1. The proposed line running parallel to Crabtree Creek will impact Zone 1 of the riparian buffers. However, since this impact is located within an existing maintained sanitary sewer right of way it is considered an "existing use" and is therefore exempt from the buffer regulations [15A NCAC 2B .0233 (3)(b)]. 8. STA 64+60 - Crossing of an intermittent stream subject to the Neuse River Riparian Buffers (i.e., indicated on either the USGS topographic quadrangle map or soil survey). This crossing was determined to meet the requirements to be considered an "exempt" activity, not requiring written authorization from the DWQ. 9. SELECT PORTIONS OF THE PROPOSED LINE - The proposed line contains several sections running parallel to and within Zone 2 of the buffers. These areas are considered to be "Allowable" activities, requiring written authorization from the DWQ. The Pre-construction Notification Application (PCN) needs to be revised to include the amount of impacts that require mitigation within impacts 3 (STA 28+00 to STA 32+75) and 4 (STA 31+00 to STA 32+25). The PCN should also include a proposed mitigation plan (on-site or payment into the Riparian Buffer Restoration Fund) for these areas. The mitigation can be avoided by re-designing (if possible) the sanitary sewer line to stay out of Zone 1 within impact 3 and crossing at a perpendicular angle within impact 4. In addition, the N.C. General Assembly enacted a new law effective January 1, 1999 which requires fees for 401 Water Quality Certifications. If the impact is equal to or less than one acre of wetland (or waters) or 150 feet of streams (such as with this project), payment of $200.0 is required. Checks should be made payable to the N.C. Quad Map of the area The entire sewer line will be over 50 feet from the waters edge of Crabtree Creek except for the creek crossing. The crossing will be by inverted siphon and will be entirely below the creek bottom. All areas will be restored to original grade after the line is installed.
