Dear Mr. Hicks:
You have our approval, in accordance with the attached conditions, to place fill material in 1,000 square feet of
wetlands or waters for the purpose of shoreline stabilization and boat ramp construction as you described in your
application dated 11 December, 1999. After reviewing xour application, we have decided that this fill is covered by
General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

8. PROJECT SUMMARY: The applicants are proposing to bulkhead two canal front lots and to
construct a private boat ramp measuring approximately 20' X 40'.

9. PROJECT DESCRIPTION
The applicants' properties are located at Lot 5 and Lot 6, 4th Street, within the Town of Surf
City, in Onslow County. The property is located adjacent to a man-made canal off the Atlantic
Intracoastal Waterway (Topsail Sound) and is in the area of Surf City known locally as Old
Settler's Beach. This man-made canal is the third canal (heading north) of a series of seven canals
which start just north of the Pender/Onslow County line.
The High ground property is two residential lots, each measuring approximately 55' wide by 120'
deep. The elevation of the property is approximately 4' above normal high water. The lot is flat
and is vegetated with lawn grasses. Currently, there are no structures on the property. 1995
aerial photography indicate that each lot had a mobile home on it at that time.
The two properties have approximately 110' of shoreline along the man-made canal. Along this
shoreline is a border of coastal wetlands averaging approximately 10' in width. The wetland
border is vegetated primarily with high marsh species consisting of Sea Ox-eye (Borrichia
frutescens), Salt-meadow Grass (SpatWna patens), Salt Grass (Distichlis spicata), and Black
Needlerush (Juncus roemerianus). Two small areas of Cord Grass (Spartina alterniflora), each
measuring approximately 4 sq. ft., are also located along the shoreline.
The man-made canal measures approximately 100' across at the applicants' properties. The waters
of the canal are classified "SA" by the Division of Water Quality. The area is not designated a
Primary Nursery Area and is closed to the taking of shellfish.
The applicants' are proposing to bulkhead the two canal front lots. The bulkhead would connect
to the adjacent bulkhead at Lot 4 to the east and connect to the end of the existing boat ramp
breakwater at Lot 7 to the west. The bulkhead would be constructed an average of 7' waterward
of NHW along its length. This position would be waterward of the existing marsh vegetation.
Also proposed is a private boat ramp to be shared by the two property owners. The boat ramp
would be constructed of concrete and would measure approximately 20' wide by approximately
40' long and would extend approximately 15' waterward of outer edge of marsh. The sides of the
boat ramp would be stabilized by the bulkhead wing walls which would extend 20' in a landward
direction on each side of the ramp.
10. ANTICIPATED EMPACTS
The proposed bulkhead alignment would result in the incorporation of approximately 1,000 sq.
ft. of mixed high marsh vegetation, approximately 8 sq. ft. of Cordgrass marsh and approximately
700 sq. ft. of open water. The construction of the boat ramp would result in the filling of an
additional 100 sq. ft. of mixed high marsh vegetation. High ground disturbance of approximately
1,100 sq. ft. can be expected for installation of the bulkhead tie back/anchor system and boat
ramp.

10. ANTICIPATED IMPACTS
The proposed bulkhead alignment would result in the incorporation of approximately 1,000 sq.
ft. of mixed high marsh vegetation, approximately 8 sq. ft. of Cordgrass marsh and approximately
700 sq. ft. of open water. The construction of the boat ramp would result in the filling of an
additional 100 sq. ft. of mixed high marsh vegetation. High ground disturbance of approximately
1,100 sq. ft. can be expected for installation of the bulkhead tie back/anchor system and boat
ramp.

Reference the application of Ronnie B. Ricks and Billy D. and Janice B.
Johnson for Department of the Army authorization and a State Water Quality
Certification to bulkhead two canal front lots and construct a private boat
ramp, on a canal adjacent to the Intracoastal Waterway, Surf City, Onslow
County, North Carolina. Your receipt of this letter verifies your acceptance
of a valid request for certification in accordance with Section 325.2(b)(ii)
of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by February 7, 2000, the District Engineer will deem that
waiver has occurred.
