Dear Mr. Lastinger and Mr. Mac Haupt:
On behalf of our client, the City of Raleigh – Public Utilities Department, Kimley-Horn is submitting the
attached application for authorization under Nationwide Permit (NWP) 12 for the above referenced
project in Wake County. The project proposes to improve the existing, aging, and undersized Walnut
Creek Interceptor to accommodate anticipated existing demand while reducing risk of overflows and
failures.
Kimley-Horn staff delineated the project study area on July 15 and 19, 2013, September 30, 2014,
October 17, 2016, June 14, 2018, May 9, 2019, and September 11, 2019 and identified 15 wetlands
(W1-W15) and 14 streams (S1-S14). Erin Deck of the NCDWR issued a Buffer Determination Letter
(NBRRO # 19-332) on November 12, 2019. A Preliminary Jurisdictional Determination Request was
submitted to Ross Sullivan of the USACE on September 24, 2019 and documentation is pending. The
Preliminary Jurisdictional Determination request has been included as part of this application as well,
for convenience.
Permanent impacts to Walnut Creek and its tributaries will result from stream enhancement and a
culvert extension to accommodate the newly constructed utility line. Stream impacts will be minimized
to the extent practical resulting in primarily temporary impacts as a result of utility line construction
and stream enhancement, where there is no loss of waters. Limited stretches of culvert extension
stream impacts will occur at Sites 7 and 9. Temporary impacts to streams will occur as a result of
construction access during the repair/construction of the utility line. Temporary impacts will be
restored to pre-construction contours and vegetation upon completion of the proposed project.

Additionally, unavoidable permanent impacts to the buffers associated with Walnut Creek and its
tributaries will result from the proposed utility line construction. Buffer impacts due to a non-electric
utility line perpendicular crossing and non-electric utility line impacts other than perpendicular
crossings (parallel impacts) are proposed.
Compensatory mitigation has been proposed for unavoidable impacts to wetlands at a 2:1 for areas
of grade/fill and at a 1:1 ratio for permanent wetland conversion due to loss of function. Additionally,
compensatory mitigation has been proposed for unavoidable impacts to Buffer Zone 1 at a 3:1 ratio
and Buffer Zone 2 at a 1.5:1 ratio when required by the Neuse River Basin Riparian Buffer Rules. To
offset these losses, wetland and riparian buffer credits have been reserved through Wildlands
Holdings II, LLC and Wildlands Holdings III, LLC. The Statements of Availability from the mitigation
banks have been included as part of this application.

The proposed project is located north of Walnut Creek, directly behind residential housing, between Sunnybrook Road and South State Street, outside of downtown Raleigh in Wake
County, North Carolina. The project site is largely composed of epsting greenway, epsting sanitary sewer easement, and undeveloped forested areas. The project vicinity is primarily
composed of residential development, commercial and institutional development, utility easements, and an epsting greenway.

For the previous phase, LWC Interceptor, a Section 404 Permit (SAW 2013-01612), submitted by Froehling and Robertson, Inc. on November 29, 2016, was issued by Tasha Alexander
of the USACE on January 11, 2017. A Section 401 Permit (DWR 14-0325), submitted by Froehling and Robertson, Inc. on November 18, 2016, was issued by Danny Smith of NCDWR
on December 8, 2016. This verification authorized impacts to 432 linear feet of stream, at 9 locations, and 0.01 acres of wetland. The proposed UWC Interceptor project drains to the
LWC Interceptor, however, proposed impact sites are separate and distant from the impact sites permitted by the LWC Interceptor project.

The purpose of this project is to improve the existing Walnut Creek Interceptor, which is divided into the existing, downstream Lower Walnut Creek (LWC) sanitary sewer interceptor and
the existing, upstream Upper Walnut Creek (UWC) sanitary sewer interceptor. This project proposes to rehabilitate, repair, and upsize the UWC sanitary sewer interceptor.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
For Upper Walnut Creek (UWC), it includes two parts. Part one of the UWC project extends from the LWC project connection point at Sunnybrook Road to Rock Quarry road and
involves in -situ replacement, with limited relocation, of the existing 42-inch (northern branch) sanitary sewer interceptor with a 60-inch sanitary sewer pipe. Part two of the UWC project
extends from Rock Quarry Road to State Street and involves construction of approximately 5,000 LF of new60-inch sanitary sewer interceptor to replace the existing 42-inch (northern
branch) sewer interceptor and rehabilitation of the existing parallel 48-inch (southern branch) sanitary sewer from Rock Quarry Road to State Street. Existing greenway that will be
disturbed by the proposed sewer improvements is going to be replaced, but no new greenway is proposed. Construction equipment typical of utility projects will be utilized including
bulldozers, excavators, graders, cranes, dump trucks, concrete trucks, and pavers.

1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Impacts to streams, wetlands and riparian buffers have been avoided and minimized to the extent practical. The proposed sanitary sewer line is being
constructed largely within an epsting sanitary sewer and greenway easement as much as practicable to minimize impacts from new easement
construction. Additionally, this project was designed to almost completely avoid Walnut Creek and stream impacts due to the installation of the utility
line are temporary.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Impacts to streams, wetlands, and protected riparian buffers within the corridor and its vicinity will be minimized to the exent practical throughout the
construction process by avoiding these features with equipment, materials, and access corridors. Where feasible, staging and construction access
routes Will be located in upland areas throughout the corridor. Silt fencing will be installed around the limits of disturbance to help ensure that all
construction equipment will remain within the project area throughout the construction process. Sediment control measures will be used to reduce
stormwater impacts to receiving waters and minimize runoff from the construction sites.

addition, there are no current known occurrences within a one -mile radius of the project area, but there are historical known occurrences of Atlantic
pigtoe and Northern long-eared bat within a one -mile radius of the project area. The project is not anticipated to impact any federally -listed species
known to occur in Wake County.

to the above-mentioned project. The project is located within the service area (HUC 03020201) of the
Bank.
Credits may be reserved for a period of 12 months upon the receipt of a non-refundable deposit of 10%
of the purchase price. Should credits not be reserved, they will be sold on a first come, first serve basis.
Credit prices will be guaranteed for a period of 6 months from the date of this letter and are then
subject to change.
An invoice for this transaction will be sent upon your request and we will reserve the credits and price
for a period of 30 days from invoice. This letter is a Statement of Availability as of the date provided – it
is not a reservation of credits nor a guarantee of price. Credits will be sold on a first come, first serve
