PROJECT DESCRIPTION The project is located at 1927 Tunier Nursery Road, adjacent to the AIWW /Middle Sound, near Wilmington, in New Hanover County. To locate the property from Market Street (NC Highwayl7), turn onto Middle Sound Loop Road and continue east past Ogden Elementary School approximately 2 miles. Turn left on Mason Landing Road and travel approximately 0.1 miles. Turn right onto Turner Nursery Road and the property of interest will be located on the left. The property encompasses approximately 9.97 acres and was the former location of Johnson's Marina, which has recently been sold. The existing residential and commercial buildings have been or are currently in the process of being demolished. There is an existing gravel road located on the southern end of the property that leads to a paved peninsula located on the most eastern end of the property. The peninsula has been historically used as trailer parking for the associated boatramp located on the northern end of peninsula. The paved parking areas, driveways and foundations remain. As a result of incremental paving at the site, the application states that approximately 64% of the site within the 575' Estuarine Shoreline Area of Environmental Concern (AEC) and approximately 42% of the overall site is impervious. The majority of the impervious surface consists of poured concrete, from which the majority of the surface runoff drains directly into the onsite wetlands and boat basin through an existing culvert, measuring approximately 137' in length by 18" in diameter. This culvert is located on the north end of the property, adjacent to the commercial metal building. The existing marina contains approximately 60 wet slips comprised of floating docks and finger piers. Steel and wooden bulkheads stabilize portions of the interior section of the marina basin. There is also an existing highground wooden retaining wall that stabilizes the highground area between the gravel access road and the metal building (Sheet 1 of 5). The applicant and adjacent riparian property owner recently received a joint CAMA General Permit No. 47450 for a new bulkhead along the shared northern portion of the property. The current application only involves the proposed upland portion of the property at this time. The upland area averages approximately 16' above mean sea level (MSL) and includes approximately 1,430 linear feet of shoreline along the man-made basin and the AIWW. High ground vegetation consists of infixed hardwoods. There is a small pocket of §404 Type Wetlands (approximately 840 sq. ft.) located on the northern end of the property. There is also another area of §404 Type Wetlands (approximately 15,746 sq. ft.) located on the western end of the property. Coastal Wetlands exist on the south side of the peninsula and consist primarily of Smooth Cordgrass Marsh (Spartina alterniflora). Other mixed species of Coastal Wetlands include: Glasswort (.S'alicornia sp.), Sea Lavender (Limonium sp.) and Salt Meadow Grass (Spartina patens). Transitioning to §404 Type Wetlands including: Marsh Elder (Iva frutescens), Wax Myrtle (Myrica cerifera L.), Sea Oxeye (Borrichia frutescens) and Common Reed (Phragmites australis). Small pockets of Coastal Wetlands also exist along the north and south side of the existing basin also consisting primarily of Smooth Cordgrass (Spartina altc>rniflora). An area of marsh, approximately 300' in width, borders the northern side of the access channel to the basin, which primarily consists of Smooth Cordgrass (Spartina altern~ora). The waters of Middle Sound, directly adjacent to the project site, are classified as SA-ORW by the North Carolina Division of Water Quality. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. The upstream area of Pages Creek, which the western portion of the project drains to, is classified as SA by the North Carolina Division of Water Quality, is designated as a Primary Nursery Area by the Division of Marine Fisheries, and is closed to the harvest of shellfish. Mason Landing Yacht Club, LLC c/o Steve Siaeed Page Three PROPOSED PROJECT The applicant is proposing to redevelop the upland portion of the former commercial marina facility into a 25- lot residential subdivision with associated marina clubhouse, pool and parking. Development would include the clearing and grading of approximately 5.7 acres of the site for road and utility installation and lot preparation. The property would be divided into 25 lots at a density of 2.5 units per acres. The new lots, with associated clubhouse would be served by a 20' private driveway located within a 40' right-of--way extending from Turner Nursery Road. The new clubhouse and associated pool would be constructed at the location of existing metal. commercial service building located at the head of the existing boat basin. Dimensions of the marina clubhouse would be approximately 90'x 80'. The existing culvert located on the northern end of the property would be replaced with a 137' in length by 30" in diameter culvert, which would continue to drain into the basin. The application states that during the construction of the proposed development, the majority of the impervious area would be removed in order to restore open space. The project would. create 65% open space within the 575' Estuarine Shoreline AEC, which would result in a 29% increase in open space within the AEC (See Sheet 2 of 5). The application states that approximately 41,479 sq. ft. of pervious pavement would be utilized throughout the project in accordance with N.C. Division of Water Quality Stormwater BMP Manual to further reduce runoff. This would include the entire peninsula, parking areas, driveways, amenities and access roads (See Sheet 5 of 5). 10. ANTICIPATED IMPACTS The proposed road construction and site grading would disturb approximately 5.7 acres (246,811 sq. ft.) of high ground. Total impervious surface coverage within the 575' Estuarine Shoreline AEC would be 30%. The application states that New Hanover County Engineering Department has issued a Construction Authorization (#363-01/04/07) for the development. A state Stormwater Permit through the N.C. Division of W~~ter Ou~ili~~. (SW8 060720) was issued on 10/10/06. A Well Site Approval through the N.C. Division of t~nvirc~nmrntai Health, Public Water Supply Section, (PWS ID No. 70-65-035) was issued on 1/22/07. The application also states that a Sedimentation and Erosion Control Plan was submitted to New Hanover County on 10/04/06. A §404 Wetlands delineation has been completed and was approved on 1/30/06 by the U.S. Army Corp of Engineers (USACOE). The application states that due to a moratorium on all jurisdictional determinations, the applicant is unsure as to when it will be issued. The application also states that the documentation would be submitted upon receipt. Submitted by: Robb Mairs Date: 3/8/07 Office: Wilmington Project Narrative The Mason Landing Yacht Club will consist of a 25 lot subdivision, with an amenities complex including a clubhouse, a pool and pool house, and private access to water recreation. Existing Conditions The project site consists of the old Johnson Marina, a commercial boat storage and repair facility, and numerous residential dwellings throughout the property. In the existing condition, the majority of the site has been paved to accommodate parking and boat storage. As a result of the excessive paving, approximately 64% of the site within the 575' Area of Environmental Concern (AEC) is currently impervious, and the site is currently 42% impervious for the entire site. The majority of the impervious surface consists of poured concrete, see attached site pictures. The runoff from the onsite impervious surfaces currently drains into onsite wetlands and boat basin with no supplemental water quality treatment due to a lack of a stormwater management system. The project site also contains a 60 slip boat basin and boat ramp. Proposed Project The proposed project will result in an aesthetic, water-based, environmentally friendly development. The proposed impervious area within the AEC will be 30%, resulting in a 34% reduction in the impervious area within the AEC. In order to minimize the amount of impervious area within the AEC to the greatest extent possible, the project has been designed to incorporate the use of both impervious and pervious pavement. Approximately 41,479 sf of pervious pavement will be utilized throughout the project in areas meeting the guidelines for use of pervious pavement, established in Section 3.10.6 of DWQ's Stormwater BMP Manual. The pervious pavement will provide the hardscape needed for parking lots, driveways and roads, while allowing infiltration of stormwater. The pervious pavement will be utilized in areas including driveways, amenities center parking area, the marina parking area and portions of the access roads. During the construction of the proposed development, the majority of the impervious area will be removed in order to restore open space within the development.. The proposed project will create 65% open space within the AEC, resulting in a 29% increase in open space within the AEC. The project will provide water quality treatment to all impervious runoff through a grassed Swale detention system, which has been approved by the Division of Water Quality (Permit #SW8-060720). A curb and gutter system will capture all stormwater runoff, and provide water quality treatment through a grassed dry detention basin. The detention basin will outfall into the onsite wetlands through level spreaders. Treated stormwater will flow through the onsite wetlands prior to outfalling into the boat basin, further improving water quality. F~ EC~Ii/ED DCi~1 lNILN1lNGTQ~~I, NC ~ EB ~ 5 2007 The combination of the reduction of overall impervious area, increase in open space and water quality treatment of runoff will result in a positive improvement to the water quality within the boat basin and improvements to the water quality of the adjacent Outstanding Resource Waters (ORW). The permitting of alterations to the boat basin and boat slips will be submitted under a separate application in the future. However, it should be noted that the final project proposes the reduction of the overall number of boat slips from 60 slips to 56 slips. Non-Conforming Development Due to the proposed project requiring 30% impervious area within the AEC, the project must be permitted as aNon-Confirming Development, as established in Section 15A NCAC 07J.0211. It is our belief that the project meets the guidelines fora Non- conforming Development, as explained below: (1) the structure will not be enlarged beyond its original dimensions It should first be noted that in the case of the proposed development, the term "structure" represents impervious area. The proposed project will result in a 34% reduction in impervious surface within the AEC. Therefore, the "structure" will not be enlarged beyond its original dimensions. (2) the structure will serve the same or similar purpose In the existing condition, the project site consists of residential dwelling sites and a commercial marina. The proposed project will consist of a 251ot residential subdivision, and a 56 slip marina. The boat slips within the marina may be purchased by both the residents of the subdivision, as well as non-residents. Therefore, the project will serve a similar use. (3) there are no practical alternatives for replacing the structure to provide the same or similar benefits in compliance with current rules. The project has been designed to minimize the amount of impervious area within the AEC, while meeting all State and County regulations. All roads, driveways, parking areas, etc., have been designed to meet the minimum criteria required by State and County permitting agencies. Additional requirements that shaped the design of the development include: 1) New Hanover County requires a 1:1 ratio of parking spaces to boat slips on the peninsula; 2) New Hanover County requires that all lots must have street frontage, which requires the circular road design; 3) New Hanover County requires emergency vehicle access and turnaround capability for the marina parking on the peninsula. The site plan represents the minimum amount of built upon area needed to support the proposed development. Additional efforts to reduce impervious area within the AEC have resulted in the utilization of pervious pavement in all areas allowed by DWQ. Approximately 41,479 sf of pervious pavement will be utilized to throughout the development. RECEIVEC2 DCM Itl/iLMiNGT®I~l, NC ~E B 1 5 20fl7 Exploration and exhaustion of all alternatives for reducing the amount of impervious area within the AEC, while maintaining a feasible project, has resulted in the proposed 30% impervious area. Current CAMA regulations do not have a provision for redevelopment within the 575' AEC. Therefore, there is no practical alternative for replacing the structure (impervious area) in compliance with current rules. (4) the structure will be rebuilt so as to comply with current rules to the maximum extent possible. As previously explained in item (3), the project has been designed to comply with current rules to the maximum extent possible. The project has been designed to meet the minimum requirements of State and Local agencies, while reducing the impervious area within the AEC from the existing 64% to the proposed 30%. The proposed project represents the most environmentally and financially feasible option for developing the property. As proposed and already permitted by DWQ, the project will result in 30% impervious within the AEC, which is only 5% above the CAMA requirement of 25% impervious area. If the CAMA Major Development permit is denied for the proposed project, the site would continue to be detrimental to the adjacent ORW. Due to constantly increasing property values for waterfront property, any future developer would likely require the same or additional lots to meet profit margins, resulting in additional impervious within the AEC, which is not allowable by the current DCM ORW Estuarine Shoreline AEC rules. Therefore, without review under the non- conforming structures provision, or until CAMA regulations are revised to include a redevelopment allowance, the property will most likely remain as an abandoned concrete marina without any stormwater treatment features. The existing condition of the site would continue to impact the water quality of the adjacent ORW. The application proposes to leave the existing 8" PVC drain that drains the pier road and offsite water from adjacent property owner. The applicant is also proposing to leave the two sock drains that drain the area around the existing 2 story building. Existing discharge will be decreased when the parking lot is regraded to drain into the stormwater management system. The 18" CPP will be replaced with a 30" HDPE.
