IRT Field Meeting - Forney Creek Mitigation Bank Meeting Minutes 1/22/2020 Present: Bryan Roden Reynolds — USACE Todd Tugwell — USACE Kim Browning — USACE Mac Haupt — DWR Erin Davis — DWR Olivia Munzer - NCWRC Sean Bloom —Catawba Lands Conservancy Charley Orner - Catawba Lands Conservancy Amy Moore - Catawba Lands Conservancy Nate Ober — Civil and Environmental Consultants Kevin Thomas - Civil and Environmental Consultants Tommy Cousins — Palustrine Group • Todd (USCAE) discussed the need to extinguish or subordinate the previous "CE" and replace with the USACE Mitigation Bank CE. He also discussed the need to identify property encumbrances such as sewer lines, leases, and mineral rights. All agreed that resolving the arrangement between CLC, easement holder and Sally's Y is the first step. • The existing protection instrument is a concern. Sean with CLC explained the existing conservation easement was written with active and passive recreation in mind. As such, the existing CE includes reserved rights include a 7-acre carveout for athletic fields, restroom facilities, archery ranges, campsites, and an amphitheater. CLC would not oppose extinguishing those rights in order to develop a mitigation bank. Preliminary discussions have begun amongst IRT members on how to address this issue of an existing conservation easement — possible credit reduction was mentioned. • CLC plans to return the proceeds from the mitigation bank to the Forney Creek watershed by restoring additional portions of Forney Creek and increasing the amount of conserved land within the watershed. • Todd mentioned the expanded buffer guidance and its potential to apply to this project given the amount of land owned by CLC. • Kim (USACE) commented that the proposed walking trail could decrease buffer credits unless it is run outside of the proposed conservation easement. Sean (CLC) indicated that CLC needed to retain a natural surface trail on the property, but agreed that locating it outside of the proposed easement and on the slopes would be a preferred location. • IRT commented that bridge crossings should reflect as deducts in credits. • Todd (USACE) commented that Priority 2 restoration will create a temporal loss of vegetation. • A number of design related questions were discussed and recommendations made by the IRT with the common goal of reducing the grading limits and construction footprint to save trees. However, the IRT identified that we need an adequate floodplain to reduce energy IRT Field Meeting - Forney Creek Mitigation Bank Meeting Minutes, 1/22/2020 Page 2 while balancing sediment transport. Nate is following up with cross sections and a proposed profile to include with the draft prospectus. • IRT commented that all the streams are degraded enough to require restoration with the exception of approximately 300 feet on Unnamed Tributary 2. • Mack (DMS) indicated that this is a larger river project and he considers the constraints of larger rivers to complicate the design. • Todd (USACE) Identified a residential development on google earth to the west of the railroad tracks. The IRT and Permittee attributed the sediment flux in Unnamed Tributary 2 to poor sediment and erosion controls from the development. Catawba Lands to follow up on the development NPDES requirements. • New beaver dam observed near proposed station 10+00.
