Dear Mr. Yow:
You have our approval, in accordance with the attached conditions and those listed below, to dredge 2.75 acres of open
waters for the purpose of conducting maintenance dredging at an existing marina at Treasure Coast Yacht Club and Marina as
described in your application dated November 17, 1999. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below if
you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new
owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions.
If total wetland tills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described
in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below.
1. Dredging should not be done during the April to September dredging moratorium.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Alright I have pushed these to the wire. With the following projects:

they will not degrade WQ and that the WQ is good enough for the dolphins)
We should have some comments from APHIS (Animal & Plant Health Inspection
vice). I am concerned about this being by a marina.

8. PROJECT SUMMARY: The applicant proposes to rebuild an existing, dilapidated marina and
construct new facilities on high ground (store, club house, pool, parking, dry stack).

9. PROJECT DESCRIPTION
The project site is approximately six acres in size located at the intersection of Highway 50 and 210 in
Surf City, Pender County. The site was formerly called Surf City Marina and trailer park. The Page
House Restaurant is located on the site. The restaurant building / gift shop will be the only existing
development to remain in place if the proposed re-development project is authorized. The property owner
is proposing a total revamping of the site. The Mobile homes, old bulkhead, docks, boat ramp, etc. will
be removed. The bulkhead and docks within the marina are old and have sustained damage from multiple
hurricanes leaving them in terrible disrepair with little function. Hardly any natural vegetation exists on
the site due to intensive use.
The high ground property is located within the Estuarine Shoreline Area of Environmental Concern.
Dredging work is proposed within Public Trust and Estuarine Waters. These waters connect to the
Atlantic Intracoastal Waterway just North of the Surf City bridge. There is a small fringe of coastal
marsh along the existing shoreline comprised primarily of Spartina alterniflora. The widest area of marsh
along the shoreline is 5'-10', waterward of the proposed bulkhead. On sheet 1 of 4 the marsh is
delineated and is located between the "New Wooden Bulkhead" and the proposed docks. There are marsh
"islands" that are located off-shore of the site, between the land and the AIWW. No disturbance of
wetlands or marsh is proposed in conjunction with this development.
The proposal for the high ground requires that all of the existing mobile homes be removed. The
restaurant building would remain. After mobile homes are removed, the site would be used to
accommodate construction of the spoil disposal area for the proposed dredging project. Once the
dredging is finished and the spoil in the basin is dewatered, suitable spoil material will be used on the site.
Unsuitable material will be removed from the site to an approved location off of the island. Once the site
is prepared, the owner plans to construct a ships store, three dry-stack boat storage buildings (for 336
boats), club house, swimming pool and a paved parking lot with 147 parking spaces. Sizes of the existing
building and proposed buildings are listed on sheet 2 of 4 under "Tract Data". The impervious surface
coverage within the 75' estuarine shoreline AEC would be 30%. The impervious surface amount for the
entire tract of land is proposed to be 58 %. An 8'-wide wooden boardwalk is proposed around the entire
shoreline of the property. It is to be located over high ground.
The proposed commercial marina portion of the project consists of all brand new structures. Included
is a 10' wide by 110' floating dock with fuel service and pump out facilities. This floating dock is to
be located near the ship's store. No permanent boat slips are shown along this floating dock. Dockage
consists of a 285' by 6' wide fixed dock and a 670' x 8' boardwalk parallel to the shoreline with 13 finger
piers extending waterward providing boat access to the proposed 26 boat slips. Please see the plans for
exact layout of the boardwalk, docks, slips and finger piers. A 20' wide haul out, "drop area", is
situated through the fixed dock as shown on the plans. This area will be used to put in and take boats out
of the water for storage in the dry stack storage buildings.
The 26 boat slip count does not include temporary dockage along side the 110' floating fuel dock. All of
the proposed slips are situated along the fixed docks with finger piers in between. Twelve of the
proposed boat slips have been designed for large boats, with slips being 16'-17' wide by 42' long. The
remaining 14 slips are 14'-15' wide by 27' long. The proposed structures have been set back 15' from
the adjacent riparian corridor lines as is required by the rules. Approximately 29,000 square feet of
public trust / estuarine waters will be shaded by the proposed docks and slips.

Approximately 700' of estuarine shoreline will be bulkheaded. A portion of the shoreline (about 350')
is bulkheaded now but is in very poor condition. That bulkhead will be replaced and the remainder of
the shoreline will be also be bulkheaded. The location of the new wall will be at mean high water or
landward of all coastal wetlands.
The final aspect of the proposed project is the maintenance dredging of the channel and harbor or "boat
basin" area between the proposed docks and the marsh island. The channel commences at the AIWW and
extends past several properties 1300 linear feet to the harbor area. The width of the proposed channel
is 50' with a 5' wide side slope on each side. See typical cross-section on Sheet 1 of 4. The harbor
dredging would be roughly 520' x 80' wide. The proposed depth is -6' at low tide. Existing depths are
shown on sheet 1 of 4 and range from -0.18 to -6.20 at low tide. The work would be accomplished by
hydraulic dredge and pumped into a proposed upland basin on the property. A cross section of the spoil
retention basin is shown on sheet 1 of 4.
In 1979, John Edward Yow applied for a maintenance dredging permit on the channel and' boat harbor.
The application requested the removal of 500 cubic yards of material down to a depth of -5' mean low
water. Also, with that 1979 application, Mr. Yow requested approval for construction of new docks.
1978 aerial photography and 1979 project drawings indicate that there were fewer boat slips (10-12) and
a slightly different dock configuration in 1978/79.
The water surrounding the Yow tract are classified as SA by the Division of Water Quality. They have
been designated as Primary Nursery Area by the Division of Marine Fisheries. However, due to the past
historical use as a marina, this localized area is closed to shell fishing.
10. ANTICIPATED IMPACTS
Turbidity will result from the dredging activity and construction of piers, docks and new bulkhead.
Shallow bottom habitat will be altered as a result of the proposed work. Public trust and estuarine waters
(29,000 square feet) will be shaded by the new structures. Wildlife that frequent this area will be
temporiarly displaced.
Approximately 5.4 acres of high ground will be disturbed as a result of this project. A sedimentation
control plan will be required and erosion control measure will be necessary to control sediment.
Impervious surface coverage will be 30% inside the 75' estuarine shoreline area of environmental
concern. 2.97 acres of impervious surface is proposed over the entire tract for a total impervious amount
of 58 %. An on-site stormwater control system is being proposed by the applicant and is depicted on
sheet 3 of 4 of the plans.
Waste water from the site will be handled by the existing municipal system, Town of Surf City.

PROJECT NARRATIVE
FOR
TREASURE COAST YACHT CLUB AND MARINA

The Treasure Coast Yacht Club and Marina is proposed for development on a 6.16 Acre
tract at the intersection of Hwy 210 and Hwy 50 within the corporate limits of the Town of Surf
City in Pender County. The site is currently developed and contains a mobile home park,
restaurant, real estate office, and the remains of a marina which formerly operated on the site.
The proposed project will include the construction of a 8725 S.F. ships store, three (3)
dry stack enclosures capable of containing a total of 336 boats, and a 7,500 S.F. club house. The
project also includes re-construction of the existing marina basin to include dredging the existing
entrance channel and basin to a 6 ft. Depth and the provision of 26 boat slips. The existing
restaurant will remain in place.
Dredging operations will be conducted by a hydraulic dredge with temporary disposal of
spoils materials on the site. Spoils will be contained within an earthen berm.. Future soil testing
will determine the suitability of the spoils material for use as fill material for the construction
project. Excess material will be transported to a mainland upland site owned by the Developer of
this project. It is proposed to use the corps of engineers spoil island on the south side of the Surf
City draw bridge for future maintenance dredging.
The project is proposed to be developed under the states redevelopment option for
CAMA and Stormwater permitting purposes. The total proposed project impervious areas have
been limited so as not to exceed the existing impervious areas (157,712 S.F.) The proposed
built-upon area within the 75 ft. A.E.C. is 30% (15,998 S.F. Impervious Surface; 53,265 S.F.
total area). In addition a sub-surface stormwater infiltration piping system consisting of a
network of underground 24" diameter perforated pipes encased in a gravel envelope has been
designed for the project in order to meet the Town of Surf City's requirement to retain the 1.5
inch rainfall event from the impervious area on site. The site will be graded such that all
stormwater from the impervious areas flows toward catch basins which feed the piping network.

This project will involve the construction of a dry stack marina operation complete with
ships store, club house, dry stack building, and fueling station, new wooden docks,
parking lots, and a recreation area at the site of an existing delapitated marina and mobile
home park. Maintenance dredging of an existing channel and boat basin as well as
demolition of existing delapitated dock structure will also be completed. This project
will be a commercial marina operation and will provide Topsail Island with it's only

9. PROJECT DESCRIPTION
The project site is approximately six acres in size located at the intersection of Highway 50 and 210 in
Surf City, Pender County. The site was formerly called Surf City Marina and trailer park. The Page
House Restaurant is located on the site. The restaurant building / gift shop will be the only existing
development to remain in place if the proposed re-development project is authorized. The property owner
is proposing a total revamping of the site. The Mobile homes, old bulkhead, docks, boat ramp, etc. will
be removed. The bulkhead and docks within the marina are old and have sustained damage from multiple
hurricanes leaving them in terrible disrepair with little function. Hardly any natural vegetation exists on
the site due to intensive use.
The high ground property is located within the Estuarine Shoreline Area of Environmental Concern.
Dredging work is proposed within Public Trust and Estuarine Waters. These waters connect to the
Atlantic Intracoastal Waterway just North of the Surf City bridge. There is a small fringe of coastal
marsh along the existing shoreline comprised primarily of Snartina alterniflora. The widest area of marsh
along the shoreline is 5'-10', waterward of the proposed bulkhead. On sheet 1 of 4 the marsh is
delineated and is located between the "New Wooden Bulkhead" and the proposed docks. There are marsh
"islands" that are located off-shore of the site, between the land and the AIWW. No disturbance of
wetlands or marsh is proposed in conjunction with this development.
The proposal for the high ground requires that all of the existing mobile homes be removed. The
restaurant building would remain. After mobile homes are removed, the site would be used to
accommodate construction of the spoil disposal area for the proposed dredging project. Once the
dredging is finished and the spoil in the basin is dewatered, suitable spoil material will be used on the site.
Unsuitable material will be removed from the site to an approved location off of the island. Once the site
is prepared, the owner plans to construct a ships store, three dry-stack boat storage buildings (for 336
boats), club house, swimming pool and a paved parking lot with 147 parking spaces. Sizes of the existing
building and proposed buildings are listed on sheet 2 of 4 under "Tract Data". The impervious surface
coverage within the 75' estuarine shoreline AEC would be 30%. The impervious surface amount for the
entire tract of land is proposed to be 58%. An 8'-wide wooden boardwalk is proposed around the entire
shoreline of the property. It is to be located over high ground.
The proposed commercial marina portion of the project consists of all brand new structures. Included
is a 10' wide by 110' floating dock with fuel service and pump out facilities. This floating dock is to
be located near the ship's store. No permanent boat slips are shown along this floating dock. Dockage
consists of a 285' by 6' wide fixed dock and a 670' x 8' boardwalk parallel to the shoreline with 13 finger
piers extending waterward providing boat access to the proposed 26 boat slips. Please see the plans for
exact layout of the boardwalk, docks, slips and finger piers. A 20' wide haul out, "drop area", is
situated through the fixed dock as shown on the plans. This area will be used to put in and take boats out
of the water for storage in the dry stack storage buildings.
The 26 boat slip count does not include temporary dockage along side the 110' floating fuel dock. All of
the proposed slips are situated along the fixed docks with finger piers in between. Twelve of the
proposed boat slips have been designed for large boats, with slips being 16'-17' wide by 42' long. The
remaining 14 slips are 14'-15' wide by 27' long. The proposed structures have been set back 15' from
the adjacent riparian corridor lines as is required by the rules. Approximately 29,000 square feet of
public trust / estuarine waters will be shaded by the proposed docks and slips.

Approximately 700' of estuarine shoreline will be bulkheaded. A portion of the shoreline (about 350')
is bulkheaded now but is in very poor condition. That bulkhead will be replaced and the remainder of
the shoreline will be also be bulkheaded. The location of the new wall will be at mean high water or
landward of all coastal wetlands.
The final aspect of the proposed project is the maintenance dredging of the channel and harbor or "boat
basin" area between the proposed docks and the marsh island. The channel commences at the AIWW and
extends past several properties 1300 linear feet to the harbor area. The width of the proposed channel
is 50' with a 5' wide side slope on each side. See typical cross-section on Sheet 1 of 4. The harbor
dredging would be roughly 520' x 80' wide. The proposed depth is -6' at low tide. Existing depths are
shown on sheet 1 of 4 and range from -0.18 to -6.20 at low tide. The work would be accomplished by
hydraulic dredge and pumped into a proposed upland basin on the property. A cross section of the spoil
retention basin is shown on sheet 1 of 4.
In 1979, John Edward Yow applied for a maintenance dredging permit on the channel and boat harbor.
The application requested the removal of 500 cubic yards of material down to a depth of -5' mean low
water. Also, with that 1979 application, Mr. Yow requested approval for construction of new docks.
1978 aerial photography and 1979 project drawings indicate that there were fewer boat slips (10-12) and
a slightly different dock configuration in 1978/79.
The water surrounding the Yow tract are classified as SA by the Division of Water Quality. They have
been designated as Primary Nursery Area by the Division of Marine Fisheries. However, due to the past
historical use as a marina, this localized area is closed to shell fishing.
10. ANTICIPATED IMPACTS
Turbidity will result from the dredging activity and construction of piers, docks and new bulkhead.
Shallow bottom habitat will be altered as a result of the proposed work. Public trust and estuarine. waters
(29,000 square feet) will be shaded by the new structures. Wildlife that frequent this area will be
temporiarly displaced.
Approximately 5.4 acres of high ground will be disturbed as a result of this project. A sedimentation
control plan will be required and erosion control measure will be necessary to control sediment.
Impervious surface coverage will be 30% inside the 75' estuarine shoreline area of environmental
concern. 2.97 acres of impervious surface is proposed over the entire tract for a total impervious amount
of 58 %. An on-site stormwater control system is being proposed by the applicant and is depicted on
sheet 3 of 4 of the plans.
Waste water from the site will be handled by the existing municipal system, Town of Surf City.

This project will involve the construction of a dry stack marina operation complete with

PROJECT NARRATIVE

TREASURE COAST YACHT CLUB AND MARINA

The Treasure Coast Yacht Club and Marina is proposed for development on a 6.16 Acre
tract at the intersection of Hwy 210 and Hwy 50 within the corporate limits of the Town of Surf
City in Pender County. The site is currently developed and contains a mobile home park,
restaurant, real estate office, and the remains of a marina which formerly operated on the site.
The proposed project will include the construction of a 8725 S.F. ships store, three (3)
dry stack enclosures capable of containing a total of 336 boats, and a 7,500 S.F. club house. The
project also includes re-construction of the existing marina basin to include dredging the existing
entrance channel and basin to a 6 ft. Depth and the provision of 26 boat slips. The existing
restaurant will remain in place.
Dredging operations will be conducted by a hydraulic dredge with temporary disposal of
spoils materials on the site. Spoils will be contained within an earthen berm.. Future soil testing
will determine the suitability of the spoils material for use as fill material for the construction
project. Excess material will be transported to a mainland upland site owned by the Developer of
this project. It is proposed to use the corps of engineers spoil island on the south side of the Surf
City draw bridge for future maintenance dredging.
The project is proposed to be developed under the states redevelopment option for
CAMA and Stormwater permitting purposes. The total proposed project impervious areas have
been limited so as not to exceed the existing impervious areas (157,712 S.F.) The proposed
built-upon area within the 75 ft. A.E.C. is 30% (15,998 S.F. Impervious Surface; 53,265 S.F.
total area). In addition a sub-surface stormwater infiltration piping system consisting of a
network of underground 24" diameter perforated pipes encased in a gravel envelope has been
designed for the project in order to meet the Town of Surf City's requirement to retain the 1.5
inch rainfall event from the impervious area on site. The site will be graded such that all
stormwater from the impervious areas flows toward catch basins which feed the piping network.

to rebuild the existing Treasure Coast Yacht Club and Marina including

of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by January 18, 2000, the District Engineer will deem that
