FIELD INVESTIGATION REPORT: Lindon Brinn PAGE #2 9. NARRATIVE DESCRIPTION: The project site is a .63 acre residential site located within a single family subdivision on the New River in Jacksonville, NC. The street address is 21 Burton Street, and is southeast of the US 17 Bridge. Averaging 4' above mean sea level, the site is occupied by a residence, with a pier and dock, and stabilized by bulkhead. Typical lawn grasses and trees vegetate the property. The New River is approximately 430' across at the project site. Because the project lies within the Public Trust Area of Environmental Concern, it is classified Conservation in the Jacksonville Land Use Plan. The Division of Water Quality classifies the New River as SB at this location; The Division of Marine Fisheries does not designate the area as Primary Nursery, and there is no shellfish resource. There is an existing pier and docking facility extending approximately 65' into the 430' body of water. The dock is approximately 13' x 26' in size, or 338 square feet. There are moorings currently delineating four slips. Twelve of these mooring piles are on the north side of the dock, and are where the current proposal is located. Two are waterward of the dock, and two are on the south side, forming two other slips. The last two are adjacent to the bulkhead for mooring a small vessel. The river is approximately -8' nlw at the end of the docking facility. The property is approximately 132' in width along the river. The proposal is to roof the slip to the north over the twelve pilings, which extend to approximately 18' above the normal water level, with an overhang creating a boathouse area of 60' x 24', or 1440 square feet. The structure will terminate 8' from the adjacent riparian corridor to the north. The property owner to this side has refused to waive the required 15' setback for purposes of a roof over the mooring piles. A walkway for access to the vessel is proposed under the roof area. On the north side, this accessway is to be 2' x 57', continuing around the east end of the pilings for another 18', or a total square footage of 150 square feet. There are no walls or second story uses proposed. The project is intended for single family residential use. 10. ANTICIPATED IMPACTS: As proposed, the project will form a 1440 square foot boathouse out of a mooring space occupying the same location. An additional decked area of 150 square feet will be added to the 338 existing on the site for a total of 488 square feet in decking. A total 1440 square foot area of public waters will be covered by the proposal. There will be visibility impacts from the project that do not arise from the mooring slips currently used. While the mooring pilings exist currently in the space proposed for this project, a boathouse of this size is no longer consistent with the use standards in T1 5A: 07H f .0208(b)(6)(G), limiting boathouse sizes to 400 square feet, unless the applicant can demonstrate need for a larger structure. It is tempting to justify the roof in light of the fact that the pilings already enclose close to the amount of area proposed by the pilings. But the difficulty here lies in the fact that the rules still allow for mooring pilings to incorporate an unspecified area. Therefore, this justification could be used to cover mooring pilings installed under current guidelines, resulting in non-conforming boathouses. The CRC was sensitive to the issue of aesthetics and blocking "line of sight" when considering the size of boathouses to be allowed under the new guidelines. The size and height of this facility has elicited negative responses from both adjoining rtA property owners, as well as a refusal to waive the necessary setback from the A <n northern property owner. Blue-line- prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Form DCM-MP-1 site. NARRATIVE DESCRIPTION: The project site is a .63 acre residential site located within a single family subdivision on the New River in Jacksonville, NC. The street address is 21 Burton Street, and is southeast of the US 17 Bridge. Averaging 4' above mean sea level, the site is occupied by a residence, with a pier and dock, and stabilized by bulkhead. Typical lawn grasses and trees vegetate the property. The New River is approximately 430' across at the project site. Because the project lies within the Public Trust Area of Environmental Concern, it is classified Conservation in the Jacksonville Land Use Plan. The Division of Water Quality classifies the New River as SB at this location; The Division of Marine Fisheries does not designate the area as Primary Nursery, and there is no shellfish resource. There is an existing pier and docking facility extending approximately 65' into the 430' body of water. The dock is approximately 13' x 26' in size, or 338 square feet. There are moorings currently delineating four slips. Twelve of these mooring piles are on the north side of the dock, •?' and are where the current proposal is located. Two are waterward of the dock, and two are on the south side, forming two other slips. The last two are adjacent to the bulkhead for mooring a small vessel. The river is approximately -8' nlw at the end of the docking facility. The property is approximately 132' in width along the river. The proposal is to roof the slip to the north over the twelve pilings, which extend to approximately 18' above the normal water level, with an overhang creating a boathouse area of 60' x 24', or 1440 square feet. The structure will terminate 8' from the adjacent riparian corridor to the north. The property owner to this side has refused to waive the required 15' setback for purposes of a roof over the mooring piles. A walkway for access to the vessel is proposed under the roof area. On the north side, this accessway is to be 2' x 57', continuing around the east end of the pilings for another 18', or a total square footage of 150 square feet. There are no walls or second story uses proposed. The project is intended for single family residential use. 10. ANTICIPATED IMPACTS: As proposed, the project will form a 1440 square foot boathouse out of a mooring space occupying the same location. An additional decked area of 150 square feet will be added to the 338 existing on the site for a total of 488 square feet in decking. A total 1440 square foot area of public waters will be covered by the proposal. There will be visibility impacts from the project that do not arise from the mooring slips currently used. BARRETT " SUBJECT: COMMENTS & RECOMMENDATIONS - CAMA MAJOR PERMIT - LINDON BRINN, ONSLOW COUNTY DATE: November 16, 1999 The following are my comments and recommendations regarding the above mentioned application: While the mooring pilings exist currently in the space proposed for this project, a boathouse of this size is no longer consistent with the use standards in T1 5A: 07H .0208(b)(6)(G), limiting boathouse sizes to 400 square feet, unless the applicant can demonstrate need for a larger structure. It is tempting to justify the roof in light of the fact that the pilings already enclose close to the amount of area proposed by the pilings. But the difficulty here lies in the fact that the rules still allow for mooring pilings to incorporate an unspecified area. Therefore, this justification could be used to cover mooring pilings installed under current guidelines, resulting in non-conforming boathouses. The CRC was sensitive to the issue of aesthetics and blocking "line of sight" when considering the size of boathouses to be allowed under the new guidelines. The size and height of this facility has elicited negative responses from both adjoining property owners, as well as a refusal to waive the necessary setback from the northern property owner. This setback was waived for the installation of the pilings originally; however, the roof is a new structure, and is proposed to extend another 2' toward the corridor line. I recommend the project be denied as proposed.
