On June 12, 2017, Currituck County, entered Special Order by Consent S 17-005 with the North Carolina
Environmental Management Commission whereby the Moyock Regional WWTP (Permit No.
WQ0035706) is not capable of consistently meeting effluent limits in the current permit due to numerous
equipment failures, construction issues, and the strength of the influent wastewater being greater than what
was estimated when the system was designed.
A review of the August 2019 Non -Discharge Monitoring Report (NDMR) for the Moyock Regional W WTP
revealed that Currituck County did not meet the modified effluent limits included paragraph 2(e) in Special
Order by Consent S 17-005, as was noted in the Notice of Violation (NOV-2019-SP-0007) issued to
Currituck County on December 19, 2019. Therefore, pursuant to paragraph 3 of the Special Order by
Consent, stipulated penalties associated with NOV-2019-SP-0007 are now due at $500.00
Payment by certified check payable to the Department of Environmental Quality or evidence to support
your claim that noncompliance was beyond the Company's control must be submitted to the Department at
the address given below within fourteen (14) days from receipt of this demand:
