You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 150 linear feet of streams and 0.25 acres of stream buffers for the purpose of developing Hunter's Mark Subdivision at Jones Sausage Road as you described in your application dated 21 January, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allow you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream buffers. 3. Temporary sediment and erosion control measures shall not be placed in zone 1 of the protected stream buffers. . If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. In addition to the horizontal realignment, we have also lowered the crossing by almost 5'. This alone reduces the stream impact by 20'. This crossing is imperative to this tract of land. I am enclosing a copy of the Master plan for this subdivision so that you can see that a crossing is required to access the northwest portion of this property. Please keep in mind that this master plan is subject to change and is not a promise or commitment in terms of the configuration of future phases. As you can see from the Master Plan, no other crossing or impacts to buffers or wetlands are proposed for future phases of this project. I would like to address each concern as outlined in your letter: 1. We have redesigned the buffer crossing both to cross in a perpendicular manner as well as lowering the crossing to substainally reduce the amount of fill placed in the channel. We have calculated new buffer impacts for the redesigned crossing. The new culvert is 125' feet long and a rip rap apron of 25' is proposed, bringing the total stream impact of the Hay River Street crossing to 150'. We have provided exhibits showing a graded pad for building construction on lots 40, 44, 61, 62, and 63. As you can see from the exhibits a buildable pad is contained on each lot. 3. The stormwater system has been designed to provide sheet flow into the Neuse Buffers. In the redesign of the stream crossing of Hay River for example, the low point of the roadway has been set outside the buffer, stormwater is collected in a pipe system and released through a level spreader. The proposed level spreader for this application is a section of half pipe with the lip set at ground level. Water flows into the pipe and then the section of pipe releases water over the side of the pipe, acting as a weir producing sheet flow into the buffer. You will note that this application is used throughout the subdivision for the release of storm water. Also please note that the culvert is only passing water under the road, no additional flow is added to the culvert; the storm drain system and the culvert are independent. 4. 1 have included a copy of the master plan for this subdivision. You will see that no future crossings or impacts are planned. We are aware that any future impact must be in compliance with state and federal guidelines. We are requesting this crossing now so that all permits will be in place and that we will not have to apply for a crossing in a future phase.
