Dear Mr. Cummings:
This Approval replaces the Approval issued on February 15, 2000. You have our approval, in accordance with the attached
conditions and those listed below, to place fill material in 150 linear feet of streams and 0.25 acres of stream buffers for the
purpose of developing Hunter's Mark Subdivision at Jones Sausage Road as you described in your application dated 21 January,
2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number
3108. This certification allow you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. This approval is
also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed
in the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact.
These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later).
2. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream buffers.
3. Temporary sediment and erosion control measures shall not be placed in zone 1 of the protected stream buffers. .
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.

In response to your February 15, 2000 letter (copy attached), I am writing to confirm
that we have satisfied the additional conditions outlined in the letter. Your letter states
that we need to obtain a Nationwide permit #12 and a Nationwide permit #14. In
December of 1999, the Army Corps of Engineers granted approval for the proposed
work under a Nationwide # 12 and a Nationwide #26. In conversations with Mr_
Todd Tugwell of the ACOE, the ACOE granted the road crossings under the
Nationwide #26. 1 also spoke with Ms. Beth Barnes of the Raleigh Regional Office
we told me that the Nationwide #26 would satisfy the requirements of the 401
Certification.

In response to your February 15, 2000 letter (copy attached), I am writing to confirm
that we have satisfied the additional conditions outlined in the letter. Your letter states
that we need to obtain a Nationwide permit #12 and a Nationwide permit #14. In
December of 1999, the Army Corps of Engineers granted approval for the proposed
work under a Nationwide # 12 and a Nationwide #26. In conversations with Mr.
Todd Tugwell of the ACOE, the ACOE granted the road crossings under the
Nationwide #26. 1 also spoke with Ms. Beth Barnes of the Raleigh Regional Office
we told me that the Nationwide #26 would satisfy the requirements of the 401
Certification.

will require less grading to tie the culvert back to the creek bed. In addition to the
horizontal realignment, we have also lowered the crossing by almost 5'. This alone
reduces the stream impact by 20'.
This crossing is imperative to this tract of land. I am enclosing a copy of the Master
plan for this subdivision so that you can see that a crossing is required to access the
northwest portion of this property. Please keep in mind that this master plan is subject
to change and is not a promise or commitment in terms of the configuration of future
phases. As you can see from the Master Plan, no other crossing or impacts to buffers
or wetlands are proposed for future phases of this project.
I would like to address each concern as outlined in your letter:
1. We have redesigned the buffer crossing both to cross in a perpendicular manner
as well as lowering the crossing to substainally reduce the amount of fill placed in
the channel. We have calculated new buffer impacts for the redesigned crossing.
The new culvert is 125' feet long and a rip rap apron of 25' is proposed, bringing
the total stream impact of the Hay River Street crossing to 150'. The impacts to
Zone 1, the inner portion of the buffer total 8770 SF or 0.20 acres. Impacts to

Zone 2 are 2070 SF or 0.05 acres. Wetland impacts for this crossing total 750 SF
or 0.018 acres.
2. We have provided exhibits showing a graded pad for building construction on lots
40, 44, 61, 62, and 63. As you can see from the exhibits a buildable pad is
contained on each lot.
3. The stormwater system has been designed to provide sheet flow into the Neuse
Buffers. In the redesign of the stream crossing of Hay River for example, the low
point of the roadway has been set outside the buffer, stormwater is collected in a
pipe system and released through a level spreader. The proposed level spreader
for this application is a section of half pipe with the lip set at ground level. Water
flows into the pipe and then the section of pipe releases water over the side of the
pipe, acting as a weir producing sheet flow into the buffer. You will note that this
application is used throughout the subdivision for the release of storm water. Also
please note that the culvert is only passing water under the road, no additional
flow is added to the culvert; the storm drain system and the culvert are
independent.
4. 1 have included a copy of the master plan for this subdivision. You will see that no
future crossings or impacts are planned. We are aware that any future impact
must be in compliance with state and federal guidelines. We are requesting this
crossing now so that all permits will be in place and that we will not have to apply
for a crossing in a future phase.
I hope that we have provided you with necessary information to proceed in a
favorable manner with our request. We will gladly provide additional information or
meet with you if needed to resolve these issues.

The Division of Water Quality has reviewed your plans for the discharge of fill material into 362
feet of streams located at Hunter's Mark subdivision to Wake County for residential development. Based
on this review, we have identified significant wcb, which would he removed or degraded by this project.
Insufficient evidence is present in out files to conclude that your project must be built as planned in waters
and/or wetlands in accordance with ISA NCAC 2H .0506. Therefore, unless modifications of the proposal
arc made as des ribcd below. we will have to move toward denial of your 401 Certification ab requited by
1SA NCAC 2H 0307(e) and will place thi, project on hold as incomplete until we receive; this additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your
project on administrative hold.
Plcuse provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wciluuds. Specifically can you;
1) redesign the buffer crossing at Hay street to be perpendicular and therefore impact

reviewed the potential "surface waters" on the subject property for compliance with the Neuse River Basin

Mr. Mitchell determined that the "surface waters" subject to the buffers include Channel A along
the eastern property boundary (an attached map), Channel B along the western property boundary
(on attached map) and the intermittent stream along the northern property boundary (not on
attached map). Mr. Mitchell will be sending written confirmation of his determinations-
Mr. Mitchell agreed that the intermittent stream indicated an the Durham County Soil Survey map
within the area depicted as a "Not Subject to NRB" an the attached map does not actually contain
surface waters. Therefore, this area is not subject to the buffers.
Corps Approval:
S&EC. Inc. has sent the Wetland Delineation Map to W. Todd Tugwell of the USACE on 9/3/99 for
approv al. We have not yet roceivod the approvod delineation as of 10/6/99. We expect this within the
near future.

approximately 220 acres in size and is located west of Jones Sausage Road (SR 2547), approximately
2000 feet west US I-40, in Garner, Wake County, North Carolina. The site is adjacent to an unnamed
tributary of Big Branch, above headwaters, in the Neuse River Basin.

should be delineated and surveyed. The surveyed wetland lines must be verified by our staff before the Corps will
make a final jurisdictional determination on your property.

delineation of the wetlands. Once the consultant has flagged a wetland line on the property, Corps staff will
