According to the Report, the permit application is for the proposed construction of a 41-lot mobile/modular home subdivision, with an associated 12-foot-wide boat ramp. The project area is in Bogue Sound, near the community of Goose Creek, Carteret County, North Carolina. No mitigation is proposed. The water classification in the project area is SA ORW, and is open to shellfishing. Areas such as the project site are extremely important to North Carolina in terms of water quality, water quantity, commercial and recreational fin- and shellfish production, and wildlife habitat and food chain maintenance. The report states that the project area contains an abundance of submerged aquatic vegetation (SAV), although it has not been possible to inspect the immediate proposed location of the ramp. EPA is concerned that projects such as the one proposed can cause direct and secondary impacts to SAV in the area, the habitat which supports the nursery and shellfish beds, and can also cause significant secondary impacts to water quality. We recommend that prior to permit issuance, the applicant and/or permitting authority ensure that no SAV will be directly impacted by placement of the boat ramp. Based on this review, we have identified significant uses, which would be removed or degraded by this project. These uses are submerged aquatic vegetation (SAV) which would be impacted by "kicking" of boats in this shallow water.. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you provide evidence as to the presence and extent of SAVs to address our concerns? Any documentation such as maps and narrative that you can'supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Please respond within three weeks of the date of this letter by sending a copy of this information to me and one copy to Ms. Joanne Steenhuis, at the Wilmington Regional Office. If we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. NARRATIVE DESCRIPTION: Project Setting ,,,,,,,.. „.!O The applicants own a 26.6-acre tract of land known as Bogue View Court, located off of SR 1119 (Red Barn Road), near the Community of Goose Creek, adjacent to Bogue Sound. Except for the entrance road, the tract is undeveloped. Much of the tract is currently a young pine plantation that measures approximately 2700' X 550'. However, a 725' long X 32' wide strip leads down to Bogue Sound. Most of the tract is high ground and has been delineated for jurisdictional 404 wetlands. The USACOE has signed off on the wetland delineation and is attached. A 40' strip of marsh borders the water access strip. Approximately 16' of that border is characterized by Spartina patens while the next 24' of the marsh leading into the water is dominated by Spart in alterniflora. According to the applicant, water depths in Bogue Sound gradually drop off with a depth of approximately -1.3' below MLW found some 60' offshore. Submerged aquatic vegetation is know to be present in the area. However, due to high water associated with the recent hurricanes, their presence at the immediate site has not been determined at this time. Additional onsite review would be appropriate for a definitive determination of their presence or'abseiice. The adjoining property to the west is characterized by individual cottages. This immediate riparian property owner, to the east has a pier that extends some 400' offshore. The tract to the east is essentially undeveloped. The waters of Bogue Sound at the site are SA ORW and are open to shellfishing. Project Description The applicant proposes to 'develop` a 41-lot mobile/modular home subdivision. Water access is proposed to be' provided by a 14' X 112' elevated wooden boat ramp. The first 12' of the ramp would be 16 aied over high ground, the next 40' would span the marsh and finally the remaining '60''would extend out into the open waters of Bogue Sound. A 12' wide area down the access strip would be graded and two 2'-wide, 4"- thick ABC stone runners would be installed the length of the access. A 40' long X 30' wide gravel and ABC stone turnaround would be constructed at the landward side of the ramp outside a 30' "buffer" area.' A `sediment basin would be installed at the landward end of the turnaround. The wooden ramp would be constructed of 4" X 6" boards on edge and would be elevated 3' above the marsh substrate. According to the applicant, both a Sedimentation Erosion Control and a Stormwater Plan have been submitted for agency review. FIELD INVESTIGATION REPORT: MICHAEL A. JONES & JOHN E. CROM/CARTERET COUNTY PAGE #32 Anticipated Impacts The installation of the gravel runners leading down to the ramp along with the gravel turnaround would result in the disturbance of 6,540 fe of area and of that approximately 3,220 ft2 of area or approximately 18% of the Estuarine Shoreline would become impervious. Approximately 560 fe of Coastal Wetlands. would be shaded as a. result of the elevated boat ramp while another 840 fe of shallow Estuarine Waters would be shaded and usurped as the ramp extends out into Bogue Sound. The most obvious potential impact is associated with the shading of the marsh and the potential impact to any SAV habitat that may be in the area and the secondary impact to the fisheries resources. Individual septic and off-site treatment. A raised boat ramp for access to Bogue Sound. The project shall be for single family lots, underground utilities will be used. Once all local, state, and federal permits are in place, construction of project will proceed. A pre-construction meeting with all contractors will be required. The applicants own a 26.6-acre tract of land known as Bogue View Court, located off, of SR 1119 (Red Barn Road), near the Community of Goose Creek, adjacent to Bogue Sound. Except for the entrance road, the tract is undeveloped. Much of the tract is currently a young pine plantation that measures approximately 2700' X 550'. However, a 725' long X 32' wide strip leads down to Bogue Sound. Most of the tract is high ground and has been delineated 'for jurisdictional 404 wetlands. The USACOE has signed off on the wetland delineation and is attached. A 40' strip of marsh borders the water access strip. Approximately 16' of that border is characterized by rtina patens while the next 24' of the marsh leading into the water is dominated by Spartin alterniflora. According to the applicant, water depths in Bogue Sound gradually drop off with a depth of approximately -1.3' below MLW found some 60' offshore. Submerged aquatic vegetation is know to be present in the area. However, due to high water associated with the recent hurricanes, their presence at the immediate site has not been determined at this time. Additional onsite review would be appropriate for a definitive determination of their presence or'absence. The adjoining property to the west is characterized by individual cottages. This immediate riparian property owner: to the east has a pier that extends some 400' offshore. The tract to the east is essentially undeveloped. The waters of Bogue Sound at the site are SA ORW and are open to shellfishing. Project Description The applicant proposes to 'develop a 41-lot mobile/modular home subdivision. Water access is proposed to be" provided by a 14' X 112' elevated wooden boat ramp. The first 12' of the ramp would lie located over high ground, the next 40' would span the marsh and finally the remaining 60 `would extend out into the open waters of Bogue Sound. A 12' wide area down the access strip would be graded and two 2'-wide, 4"- thick ABC stone runners would be installed the length of the access. A 40' long X 30' wide gravel and ABC stone turnaround would be constructed at the landward side of the ramp outside a 30' "buffer" area. A sediment basin would be installed at the landward end of the turnaround. The wooden ramp would be constructed of 4" X 6" boards on edge and would be elevated 3' above the marsh substrate. According to the applicant, both a Sedimentation Erosion Control and a Stormwater Plan have been submitted for agency review. -t FIELD INVESTIGATION REPORT: MICHAEL A. JONES & JOHN E. CROM/CARTERET COUNTY PAGE #32 Anticipated Impacts The installation of the gravel runners leading down to the ramp along with the gravel turnaround would result in the disturbance of 6,540 fie of area and of that approximately 3,220 f0 of area or approximately 18% of the Estuarine Shoreline would become impervious. Approximately 560 ft2 of Coastal Wetlands.' would be shaded as a result of the elevated boat ramp while another 840 fe of shallow Estuarine Waters would be shaded and usurped as the ramp extends out into Bogue Sound. The most obvious potential impact is associated with the shading of the marsh and the potential impact to any SAV habitat that may be in the area and the secondary impact to the fisheries resources. Further field investigations should qualify the later. Given the length of the neighboring: pier, there should be no impact to navigation in the area.
