APPROVAL of 401 Water Quality Certification
Dear Mr. and Ms. Zettervall:
You have our approval, in accordance with the attached conditions and the additional conditions listed below,
to fill 0.09 acre of vegetated and non-vegetated wetlands in order to place rip-rap along the shoreline of your house
in Currituck County as described in your application dated 5 April 2000. After reviewing your application, we
have determined that this fill is covered by General Water Quality Certification Number 3112. This Certification
allows to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should
get any other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application: If you change
your project, you must notify us and you may be required to send us a new application for a new certification. If
the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby
responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed
one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to
be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.
Box U447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask
for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.

The applicant, James Zettervall, owns six acres of land located south of Colonial Beach
Road (SR 1122) in the Jarvisburg community in Currituck County, adjacent to the North River
off Albemarle Sound. The irregularly shaped parcel is 550' deep and fronts the North River
for approximately 400 linear feet. To access the property, turn west onto Colonial Beach Road
off US Highway 158 and continue straight 3/10 mile beyond the west end of the paved portion
of the road. At this point turn left (south) onto Rita Street which is unpaved. After traveling
200' turn right onto the narrow path through the woods.
At the west end of the rough 500' long path you will enter a 300' long area which has
been partially cleared. In the center of the 1/2 acre clearing there is a woodframe residence
located a few feet landward of a 4' high 225' long wooden bulkhead which ties into the
bulkhead protecting the abutting property to the north. Immediately south of the applicant's
bulkhead there is a 75' long natural shoreline with a sandy beach extending 10'-12' landward
of NWL. Along this shoreline there are two wooden groins about 75' apart which extend 28'
out beyond NWL. Landward of the sandy beach there is a 30'-40' wide, 3' tall berm
supporting a few pines and bald cypress. The landward edge of the berm drops off quickly to
the western edge of a 51/2 acre wooded swamp which has been delineated as "404"
jurisdictional wetlands by a representative of the US Army Corps of Engineers. A small
portion (±3,700 square feet) of the delineated "404" wetlands lies along the landward side of
the 1/2 acre clearing within a 15'-25' wide, 185' long area.
Elevation within the upland portion of the clearing ranges between 3.5' and 4' above
mean sea level. Vegetation growing =within the upland areas includes loblolly pine (Pinus -
taeda), bald cypress (Taxodium distichum), sweet gum. (Liquidambar styraciflua) and red
maple (Ater rubrum). Vegetation which was noted within the "404" wetlands area includes all
of the above plus wax myrtle (Myrica cerifera), sweet bay (Magnolia virginiana) and large
areas of soft rush (Juncus io, us).
Prior permitting and development activities include the following:
1) The issuance of CAMA Major Permit #114-88 on June 22, 1988 which authorized
the construction of a wooden bulkhead and pier.
2) The construction (without a permit) of a 370 square foot dock for which a Notice
of Violation (#99-30A) was issued on October, 20, 1999. The total assessment was
received by NC DCM on March 24, 2000.
The waters of the North River in the vicinity of the project are classified as SC by the
NC Division of Environmental Management. These waters are classified as Joint Fishing

Waters by the NC Marine Fisheries Commission and the NC Wildlife Resources Commission
and as Estuarine Waters and Public Trust Waters by. the NC Coastal Management Resources
Commission. Water depths in the project area (5' out into the North River) measure .5'-1'
below NWL. The presence of submerged aquatic vegetation was not noted in the vicinity of
the project. Review of available information suggests that there are no known archeological
sites or unique geological formations associated with the applicant's property.
Project Description
The applicant proposes the following development:
1) Place 370 cubic yards of fill within 3,512 square feet of "404" jurisdictional
wetlands located along the easternmost portion of the clearing.
2) Fill and grade 18,488 square feet of uplands with 830 cubic yards of material.
3) Place a 5' wide section of stone riprap (volume of 14 cubic yards) a maximum
distance of 5' waterward of NWL along 75 linear feet of shoreline. The riprap
will continue landward of NWL for 5' thereby covering 375 square feet of
Estuarine Shoreline AEC.
4) Extend the southernmost 28' long wooden groin an additional 16' in length at its
landward end. Approximately 5 linear feet of this addition will be placed within
waters of the North River leaving adjacent shoreline to the south unstabilized.
5) Place approximately 1400 square feet of stone riprap under the existing residence.
6) Excavate approximately 38 cubic yards of material from a 2' x 225' long area
immediately landward of the existing leaking bulkhead, replace filter cloth, then
backfill the 2' x 225' long area with the dewatered material.
Anticipated Impacts
1) The filling of "404 jurisdictional wetlands will result in the loss of 3,512 square
feet of freshwater wetlands habitat.
2) Other filling and grading will disturb 18,488 square feet of uplands of which
17,508 square feet is located within the Estuarine Shoreline Area of Environmental
Concern.

3) The placement of 14 cubic yards of stone riprap along 75 linear feet of shoreline a
maximum distance of 5' beyond NWL will result in the loss of°375 square feet of
Estuarine/Public Trust Waters shallow water habitat.
4) The placement of stone riprap within a 5' wide x 75' long section of the Estuarine
Shoreline will cause an increase in the total lot coverage by impervious surfaces.
Resultant lot coverage equals 6%.

Certification for bulkhead improvements at your property bordering the Albemarle Sound in Currituck County. The
Division of Coastal Management has informed us that a CAMA Major Permit will be required for your project. In
accordance with standard operating procedures in the State of North Carolina, DCM will forward copies of your
CAMA Permit application to the DWQ Central Office in Raleigh and Washington Regional Office. Upon receipt of
the DWQ Regional Office Staff Report, the DWQ Central Office will be prepared to issue the 401 Certification upon
the recommendation of WARO staff. Until the CAMA Permit is forwarded to this office by DCM, your application
will be placed on hold as incomplete. We have set up a file for your project, and ask that you note the DWQ Project
No. (99-1014) in future correspondence related to your project.

This permit, issued on !i -;/ D/ / , is subject to compliance with the application (where consistent
with the permit), all applicab a regulati ns, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The bulkhead will be aligned on an average of 2' and a maximum of 5' waterward
of NWL at the time of construction. To prevent an unintentional violation
of this authorization, representatives of the N. C. Division of Coastal
Management and the Corps of Engineers will be available to stake the alignment
prior to construction.
(2) All backfill materials will be obtained from a high ground source and confined
landward of the permitted bulkhead.
(3) The fill material will be clean and free of any pollutants, except in trace
quantities. Metal products, organic materials, or unsightly debris will
not be used.
(4) The filled area will be properly graded and a ground cover sufficient to
restrain erosion will be established within 30 working days of project comple-
tion.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1991
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Waters by the NC Marine Fisheries Commission and the NC Wildlife Resources Commission
and as Estuarine Waters and Public Trust Waters by the NC Coastal Management Resources
Commission. Water depths in the project area (5' out into the North River) measure .5'-1'
below NWL. The presence of submerged aquatic vegetation was not noted in the vicinity of
the project. Review of available information suggests that there are no known archeological
sites or unique geological formations associated with the applicant's property.
Project Description
The applicant proposes the following development:
1) Place 370 cubic yards of fill within 3.512 square feet of "404" jurisdictional
wetlands located along the easternmost portion of the clearing.
2) Fill and grade 18,488 square feet of uplands with 830 cubic yards of material.
3) Place a 5' wide section of stone riprap (volume of 14 cubic yards) a maximum
distance of 5' waterward of NWL along 75 linear feet of shoreline. The riprap
will continue landward of NWL for 5' thereby covering 375 square feet of
Estuarine Shoreline AEC.
4) Extend the southernmost 28' long wooden aroin an additional 16' in length at its
landward end. Approximately 5 linear feet of this addition will be placed within
waters of the North River leaving adjacent shoreline to the south unstabilized.
5) Place approximately 1400 square feet of stone riprap under the existing residence.
6) Excavate approximately 38 cubic yards of material from a 2' x 225' long area
immediately landward of the existing leaking bulkhead, replace filter cloth, then
backfill the 2' x 225' long area with the dewatered material.
Anticipated Impacts
1) The filling of "404" jurisdictional wetlands will result in the loss of 3,512 square
feet of freshwater wetlands habitat.
2) Other filling and grading will disturb 18,488 square feet of uplands of which
17,508 square feet is located within the Estuarine Shoreline Area of Environmental
Concern.
