APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS, WRP

Dear Mr. Jacobus:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in 257 linear feet of streams for the purpose of constructing the English Hills subdivision at SRI 136
in Iredell County, as you described in your revised application dated May 1, 2000. After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Numbers 3102
and 3108. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when the Corps of
Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application for a new certification. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland
fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed in
the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters to
notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall
be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later).
2. Applicant is hereby warned that a Notice of Violation will be sent due to the often-the-fact
nature of this approval. A monetary fine may be imposed depending on your response.
We understand that you have chosen to contribute to the Wetland Restoration Program in order to
compensate for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R .0402, this
contribution will satisfy our compensatory mitigation requirements under 15A NCAC 211.0506(h).
According to 15A NCAC 2H .0506(h), feet of restoration will be required. Until the Wetland Restoration
Program receives and clears your check (made payable to: DENR - Wetland Restoration Program), wetland or
stream fill shall not occur. Mr. Ron Ferrell should be contacted at 919-733-5083 ext. 358 if you have any
questions concerning the Wetland Restoration Program. You have one month from the date of this
Certification to make this payment.

For accounting purposes, this Certification authorizes the fill of 257 feet of streams, in 030711
river and subbasin and 257 linear feet of stream restoration are required. Please be aware that the
Wetland Restoration Program (WRP) rules require rounding of acreage amounts to one-quarter acre
increments (15A 2R.0503(b)).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

I have reviewed the May 1, 2000 re-application for the English Hills
project (#990772) in Iredell County. The project has a considerable
history since June 1999 and its withdrawal in October 1999. According
to the consultant their has been missed and lost communications during
this process.
The bottom linen however is that the project has begun and the 257 if
stream impact has been done and the crossing below 150 if on the
mainstem is currently under construction. Their has also been
considerable problems with sedimentation getting into both streams.
I do not object to the issuance of an after the fact 401 WQC to cover
the impacts and the payment to the WRP for the required mitigation.
There is a strong feeling in the Regional Office that the developer
warrants a civil penalty for beginning the.project without the 401 WQC.
Please advise if the Central Office concurs and if so, please advise to
the procedures and form letters that we are now using for the civil
penalty recommendation.

The William Brewster Company would like to proceed With permitting the English Hills Project
in Iredell County (DWQ # 990772). The project was put on hold by letter from the Division
of Water Quality and was considered withdrawn on October 15, 1999. I did not receive a
copy of the letter stating the project was to be considered withdrawn, although Soil and
Environmental Consultants, my former employer, was listed to receive a copy of this letter.
If I had gotten a copy of the letter I would have sent the requested information earlier than
December 10, 1999.
The owner acknowledges that impacts on site have occurred without the consent of the
state, but wishes to resubmit the application with the avoidance and minimization previously
submitted. Please refer to the attached previous correspondence for the following
discussions.
We believe that the efforts to reduce impacts by 160 linear feet, following recommendations
by the Division of Water Quality, coupled with participation in the Wetland Restoration
Program brings this project within the range of projects that can easily be permitted through
the nationwide program.
Project History:
1. June 1999 - Joint 401/404 application submitted for review to regulatory agencies
2. August 27,1999 - Correspondence from the state requesting more information
3. September 9, 1999 - Request from consultant for more time to gather information
4. September 28, 1999 - Consultant request for more clarification from engineer and
developer
5. October 15, 1999 - State considers project withdrawn per letter
6. December 13, 1999- Submit both September 28, 1999 letter and December 10, 1999
letter from engineer to the DWQ.
7. April 18, 2000 - Engineer finds that the project is not in compliance
8. April 26, 2000 - Consultant receive a copy of the October 15, 1999 letter considering the
project as .withdrawn.
As per the August 27, 1999 correspondence from DWQ, the project plan has sacrificed
relocating the channel associated with lots 10-13 to avoid the temporal loss of the channel.
In addition, the attached minimization and avoidance is presented again for your review.

Since the project has no on-site mitigation potential, we request review by the Wetland
Restoration Program for participation in the state bank. The project is located in the HUC
03040105 of the Yadkin River Basin.

The purpose of this letter is to request authorization for wetland impacts under Nationwide Permit 14 and
26 and their general 401 Water Quality Certification for the project known as English Hills, Iredell
County, North Carolina. The project, as proposed, impacts 517 linear feet of Waters of the US in the
form of channels. Impacts are shown on the attached site plans and construction drawings. The proposed
activity is located within Iredell County and is within lands owned by William Brewster Company, Inc.
The attached site location map shows the location of the project.
A road crossing on West Fork Rocky River, utilizing NW 14, consists of a box. culvert with baffle walls.
West Fork Rocky River is considered to be perennial and important. Permanent impacts total 100 linear
feet.
A second road crossing utilizing NW 26 is proposed for impacts to an unnamed intermittent channel to
West Fork Rocky River. Channel impacts of 257 linear feet are anticipated utilizing pipe and rip-rap.
This channel was field observed with flow during our site visit in February, 1999. Fish and crayfish were
observed within the channel, and we assess that impacts to this channel will result in loss of important
aquatic function. Also, under Nationwide 26, we propose an open relocation of 160 linear feet of this
channel for the purpose of gaining lots. The relocation will be consistent with the Rosgen Principles. We
further understand that if the permit is issued conditional an accepted mitigation plan that we can not
proceed with the relocation until we have agency approval.
Total impacts to important channel for this project include 517 linear feet. Impacts to vegetated wetlands
total 0.095 acres. No mitigation for vegetated wetland impacts is proposed.

The Division of Water Quality has reviewed your plans for the discharge of fill material into 517
feet of streams and/or wetlands located at SR 1136 near West Fork Rocky River in Iredell County. Based
on this review, we have identified significant uses, which would be removed or degraded by this project.
Insufficient evidence is present in our files to conclude that your project must be built as planned in waters
and/or wetlands in accordance with 15A NCAC 2H.0506. Therefore, unless modifications of the proposal
are made as described below, we will have to move toward denial of your 401 Certification as required by
15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your
project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can your by not relocating the channel? Any documentation such as maps and
narrative that you can supply to address alternative designs for your project may be helpful in our review of
your 401 Certification. Also this project will require compensatory mitigation as described in 15A NCAC
2H .0506(h). Your mitigation proposal is insufficient because a location and relocation plan was not
provided.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and one copy to Charley Schwartz Mooresville Regional Office at 919 North Main Street Mooresville,
NC 23115. If we do not hear from you in three weeks, we will assume that you no longer want to pursue

The purpose of this letter is to request from you a letter addressing the measures that have been taken to
date to avoid and minimize channel and wetlands impacts for the proposed English Hills subdivision. A
copy of the permit application is enclosed. The letter from you should be returned to our office so that we
can make recommendations on additions or deletions. We will forward the final letter and a simple
statement from our office that the developer intends to utilize the NC Wetland Restoration Program to
satisfy mitigation requirements to John Domey's office to hopefully help influence their approval.
We need for you to address why it is necessary for the road crossing below the proposed pond (See
Attached Map for NW 26 Road Crossing - 257 linear feet of channel impact) to be constructed as wide as
it is proposed. Engineering points to address might be the need for the side slope ratios, the need to
connect to additional roads, the need for the height of the road, the fact that future utility crossings may
dictate the fill slopes, etc.
We also need for you to address the rationale behind the proposed side,slopes for lots 10, 11, 12, and 13
(See Attached Map). These lots are located south of the proposed pond. The potential cost of building
retaining walls for these lots should be mentioned. To us it appears that building envelopes are required to
be a certain size and that one's common sense dictates the 2 to 1 side slopes. As discussed on the phone,
you should mention depth of fill and potential slope failure. Also, you may be able to point out that
reducing the fill slope may only reduce channel impacts by a low percentage.
Once we get this justification letter back from you and forward it to the DWQ office, we anticipate that the
permit authorization process will once again begin to proceed as planned We will keep you updated on the
progress of the application.

RE: Explanation of Engineering Practices @ The Hampshires @ English Hills
Dear Mr. Huysman:
This letter is in response to your request for additional information regarding channel and wetland
avoidance and minimization. The Town of Mooresville required the developer to create a "grid" of
connectivity with the proposed streets in the project. One such connection is required to access phase
II from phase I. The resultant 257 linear feet of impact for the NW 26 road crossing is required based on
minimum engineering standards required by the local municipality. We were only allowed a vertical curve
of a certain size based on these regulations. These standards forced the road crossing between the two
phases of the subdivision to be this height. The road section is also based on local municipality standards
forcing road width and shoulder size. All side slopes are set to allow for adequate seeding and future
maintenance.
The proposed lots adjoining the creek on the south side of the proposed fire protection pond have been
designed for the building envelope required by the development. The homes shall be built on concrete
pads, which limits the amount of cross slope on the building envelopes. These two factors alone force
the height of the fill slopes to be so great. The proposed side slopes of 2 to 1 are the extreme maximum
allowed for future maintenance and slope stabilization. Reduction in the lot depths or the length of fill
slope would result in loss of buildable lots. Retaining walls to'confine the fill slope would not be
economically feasible and if constructed would still result in minor reduction in impacts during the
construction phase. The cost of retaining walls for the required amount of fill would also greatly reduce
feasibility for the lots entirely.

Dear Ms. Goolsby:
The Division of Water Quality has reviewed your plans for the discharge of fill material into 517
feet of streams and/or wetlands located at SR 1136 near West Fork Rocky River in Iredell County. Based
on this review, we have identified significant uses, which would be removed or degraded by this project.
Insufficient evidence is present in our files to conclude that your project must be built as planned in waters
and/or wetlands in accordance with 15A NCAC 2H.0506. Therefore, unless modifications of the proposal
are made as described below, we will have to move toward denial of your 401 Certification as required by
15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your
project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can your by not relocating the channel? Any documentation such as maps and
narrative that you can supply to address alternative designs for your project may be helpful in our review of
yotir 401 Certification. Also this project will require compensatory mitigation as described in 15A NCAC
2H .0506(h). Your mitigation proposal is insufficient because a location and relocation plan was not
provided.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and one copy to Charley Schwartz Mooresville Regional Office at 919 North Main Street Mooresville,
NC 28115. If we do not hear from you in three weeks, we will assume that you no longer want to pursue

The 1998 North Carolina General Assembly adopted fees for the 401 Water•Quality
Certification Program effective January 1,1999.(see attached) [Section 143-215.3D(e)]. Fees for
"Major Water Quality Certification" (defined as those with greater than or equal to one acre of
wetland or water fill or equal to 150 feet of stream impact) will have a fee of $475.00. "Minor
Water Quality Certifications" (defined as less than one acre of wetland or less than 150 feet of
stream impact) will have a fee of $200.00. Any applications received by DWQ after January 1,
1999 must be accompanied by a check for the required amount. If payment is not included with a
request for a Nationwide Permit, the application will be returned to the applicant as incomplete. If
the correct payment is not included with an Individual 4041401 or a CAMA Permit Application, a
project file will be created, but the applicant will receive a letter informing them that the project
will not be processed until the full payment is provided. Checks should be made out to the N.C.
Division of Water Quality.
You should be aware of these additional provisions of this new requirement:
• Changes to an existing 401 Water Quality Certification require a full new Certification by
DWQ. Additionally, any 401 Certification that is requested to be renewed, as a result of the
work not being completed prior to the expiration date, also results in a full issuance of a new
Certification. A fee is required with each issuance.
• Due to the requirement for fee payment for each request, applicants are advised to include as
many project details and phases as possible in the initial application.
• If a project requires a CAMA permit and its associated fee, a payment for the 401
Certification request is still required.
• No refunds will be issued for denied, modified or withdrawn certification requests. If DWQ
or the Corps of Engineers retires a project due to insufficient or inaccurate information, no
refunds will be issued.
• Payment must be made in full.
• Nationwide Permits for minor wetland impacts or those without wetland or stream fill that do
not require written approval of the 401 Water Quality. Certification do not require payment of
the fee. If an applicant still chooses to submit an application in order to have written approval
to file with their project records, then the fee payment is required if wetland or stream fill is
involved.
• Receipts for fees will only be sent upon written request.
Also please be aware that the Division considers stream impact to be length rather than area in
all cases regardless of Individual versus Nationwide permit status or significant versus
insignificant channel. This has been DWQ's policy since February 1997 but recently some
confusion has developed with some applicants.

The purpose of this letter is to request authorization for wetland impacts under Nationwide Permit 14 and
26 and their general 401 Water Quality Certification for the project known as English Hills, Iredell
County, North Carolina. The project, as proposed, impacts 517 linear feet of Waters of the US in the
form of channels. Impacts are shown on the attached site plans and construction drawings. The proposed
activity is located within Iredell County and is within lands owned by William Brewster Company, Inc. r
The attached site location map shows the location of the project.
A road crossing on West Fork Rocky River, utilizing NW 14, consists of a box culvert with baffle
West Fork Rocky River is considered to be perennial and important. Permanent impacts total 100
feet.
A second road crossing utilizing NW 26 is proposed for impacts to an unnamed intermittent c 1
West Fork Rocky River. Channel impacts of 257 linear feet are anticipated utilizing pipe rip
This channel was field observed with flow during our site visit in February, 1999. Fish ad yfis
observed within the channel, and we assess that impacts to this channel will result in loss of imp
aquatic function. Also, under Nationwide 26, we propose an open relocation of 160 linear feet of thil
channel for the purpose of gaining lots. The relocation will be consistent with the Rosgen Principles.
further understand that if the permit is issued conditional an accepted mitigation plan that we can not
proceed with the relocation until we have agency approval.

Total impacts to important channel for this project include 517 linear feet. Impacts to vegetated wetlands
total 0.095 acres. No mitigation for vegetated wetland impacts is proposed.
