Raleigh, NC 27607 0?, ti t RE: Rocky Branch Greenway WQC 401 Project # 994077 001 Permit Modification Status WRES Project No. 98097 7 I 1 Dear Mr. Dorney: On June 26, 2000, we filed application with your office on behalf of the City of Raleigh Pre-Construction Notification to modify the above referenced permit. Under the proposed modification, we relocated a portion of the greenway trail from a wetland area into the riparian buffer adjacent to Rocky Branch. This relocation minimized the impact on the wetland area. We believe that minimizing impacts to wetland areas while encroaching into the riparian buffer is the most practicable solution in this instance. As of the date of this letter, we have yet to receive either permission or denial to proceed with the greenway trail; as outlined in the permit modification request. The City of Raleigh currently has a contractor constructing the Rocky Branch greenway trail. We have delayed any construction activity in the area covered by the permit modification until now. Because the City is, anxious to proceed with the construction of the entire trail, the City has asked that we notify you of our intent to proceed. Accordingly, not hearing from you by close of business on September 15, 2000, we will proceed with the trail's construction in the riparian buffer as shown in the application for the permit modification. Benton PO Box 590 Raleigh, NC 27602 Dear Mr. Benton: You have our approval, in accordance with the attached conditions, to place fill material in 0.413 acres of wetlands or waters for the purpose of a greenway trail, as you described in your application dated May 12, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This Certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one'acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. RE: City of Raleigh _-- Rocky Branch-Greenway Trail Request -for Approval of Realignment WRES No. 98097 Dear Mr. Dorney: On behalf of the City of Raleigh, this letter request permission to install a greenway trail within the riparian, buffer adjacent to Rocky Branch in Raleigh. Via its May 21, 1999 letter; the City of Raleigh received permission to install its greenway trail along Rocky Branch under WQC 401 Project # 990477. The accompanying figures 3e and 3f are from the original Pre-Construction Notification for the project and show the trail alignment as currently permitted. Since the time of the approval, modifications to the riparianbuffer regulations now permit greenways within the buffer. In order to avoid disturbing approximately 820-feet of wetlands, the.City respectively requests permission to install the greenway trail within the riparian buffer adjacent to Rocky Branch. The `accompanying plan sheet, Sheet No. G4 of 21 by Withers & Ravenel, Engineering & Surveying, Inc., depicts the new alignment for which the City now seeks permission. This new alignment results in a significant reduction in the area of wetlands scheduled for disturbance during construction, but it does encroach within the riparian buffer. With the new alignment, the trail will encounter`about 820-feet less of wetlands, or a 75% o reduction in wetlands disturbed area. The elevated trail. over wetlands consists of a 10-feet wide, treated timber boardwalk; an asphalt trail of the same width will serve as the trail surface outside of wetland areas. All other aspects of the Rocky Branch Greenway Trail remain as approved. We have endeavored to work closely with Mr. Steve Mitchell of the regional office to design a greenway trail that minimizes impacts to the environment, particularly wetlands, and we believe this realignment furthers that goal even though it encroaches the buffer. We sent a copy, of the proposed realignment plan to Mr. Mitchell, and we received his consent of the realignment via a June 6, 2000 telephone' conversation. By copy of this letter, we are requesting Mr. Mitchell's written concurrence of the realignment. We are also communicating with Mr. Mitchell via e-mail for his comments. We trust this realignment meets your approval. WOE 00? 0 c) - °z It o % CL mU C?0 0ooZ Z C3) J LL til'rJ ROCKY BRANCH GREENWAY TRAIL REALIGNMENT PROJECT DESCRIPTION The City of Raleigh applied for and received permits for the construction of the Rocky Branch Greenway Trail. Under WQC 401 Project # 990477 dated May 21, 1999, it received permission to place fill material in 0.413 acres of wetlands. At the time of filing the permit application, the Neuse River Riparian Buffer regulations prohibited the placing of a paved greenway trail within the buffer. This necessitated crossing a wetlands area northwest of South Wilmington Street, SR 1564, in Raleigh with approximately 820-feet of elevated trail. Subsequent to receiving the permit, the Neuse River Riparian Buffer regulations were revised. One of the revisions includes the allowing of paved greenway trails within the buffer. Because an upland area exists between the wetlands and the bank of Rocky Branch, the City of Raleigh seeks permission to realign the trail such that it avoids a vast majority of the wetlands area. This realignment, however, while avoiding the majority of the wetlands area, does encroach within the riparian buffer adjacent to Rocky Branch. ITEM 12 of PCN As with the current permit, the all weather trail will be constructed of boardwalk and asphalt. Where necessary for the trail to cross wetlands, and elevated boardwalk will be constructed. Elevating the trail will commence within upland areas so that it is elevated to grade by the time it reaches the wetland perimeter. Where the trail does not cross wetland, an asphalt trail will be constructed. In wetland areas, we envision light rubber tired equipment will be used for clearing operations. Only small trees and undergrowth will be cleared, as we will purposely make field adjustments in trail alignment to avoid as many trees as practicable. Depending upon subsurface conditions, construction of the elevated wooded trail will likely require use of similar type equipment, including "Bobcats." We do not anticipate a need for track vehicles in wetland areas. REALIGNMENT REQUEST AND PCN This Pre-Construction Notification is intended to cover only that portion of the Rocky Branch Greenway affected by the realignment. All other data and information supplied in the original Pre-Construction Notification remains unchanged. These sections of trail will become a part of the greenway system of the City of Raleigh. Included with the application is a synopsis of the trails. In general, the trails are located within existing sewer easements of the City of Raleigh. In several locations, however, the alignment must deviate from the easements, such as the crossing underneath two railroads. A description of these railroad crossings is contained within the synopsis. Other locations where deviation is necessary are at bridges proposed for crossing Rocky Branch. The bridge locations are shown on the reduced copies of the plans included with the application. And lastly, on the Rocky Brach trail, we chose to occupy a corridor, but located on property owned by the City, closer to the stream but still more than 50-feet from the creek bank: At the railroad crossings and at the bridge crossings, it will be necessary to construct the greenway within areas that may be designated as Neuse River Buffers. As evident from field inspections, existing constraints prohibit a more economical solution. As for, the bridges, "site constrictions require crossing of the Branch at the proposed locations. Where practical, we will endeavor to.avoid the wetlands _during construction with the flexibility of moving the trail so as to avoid wetlands. However, there are certain areas where no alternative such as moving the trail exists. Where wetlands are crossed, the greenway trail will be elevated above the wetlands via a boardwalk. The boardwalk will be constructed of treated lumber, and any disturbance to the wetlands areas created by construction should be minimal. Disturbed areas will then be allowed to revegetate naturally. Where necessary, clearing for the greenway trail will be limited to a corridor not more than 20-feet wide. A,10-feet wide asphalt trail will then be constructed with 2-feet wide shoulders on each side. The shoulders will be dressed with wood chippings from the. clearing operations. The remainder' of the cleared area will then be allowed to revegetate naturally. We reviewed these plans with Steve Mitchell At the April 16, 1999 meeting, Mr. Mitchell indicated he was pleased with our efforts in minimizing impacts associated with these greenway, trails. DP_ E 5 " WALNUT CREEK AND ROCKY BRANCH GREENWAYS Project Description The City of Raleigh Parks & Recreation Department proposes to construct 20,400 feet of new greenway trails along Walnut Creek and Rocky Branch in south Raleigh (Figure 1). The project segment herein referred to as the Walnut Creek trail (8,400 feet) extends from Lake Wheeler Road eastward along Walnut Creek to the Bain Water Treatment Plant (WTP) on Fayetteville Street. The Rocky Branch trail (8,100 feet) extends from the corner of Jamaica Drive and South Saunders Street southeastward along Rocky Branch to Fayetteville Street, then splits into a western section and an eastern section. The western section proceeds southward to connect with the Walnut Creek trail near the Bain WTP, and the eastern section proceeds southeastward to Wilmington Street. The Walnut Creek South trail (3,900 feet) begins at Wilmington Street and follows Walnut Creek eastward to Garner Road. The 10 foot wide recreational trail will be constructed using pavement in uplands, boardwalk in wetlands, and boardwalk or bridges at stream crossings. In most areas the trail will be within a protected greenway corridor ranging from 30 to 200 feet wide. Except for trails and utility easements, the City will maintain existing natural vegetation in the remainder of the greenway corridor. Where existing buffers of woody riparian vegetation are present, the edge of the proposed construction corridor will generally be 30 feet or more from the parallel stream bank, in accordance with the Neuse River Riparian Buffer Rule. Much of the Walnut Creek and South Walnut Creek trails are within existing maintained sewer rights-of-way, including some segments less than 30 feet from the parallel stream bank. The periodically mowed portions of these rights-of-way containing herbs, vines, shrubs, and tree seedlings are not subject to the Riparian Buffer Rule. Greenway construction will not affect the larger woody vegetation located between the sewer rights-of-way and the parallel stream banks. Except for stream crossings (see Item 10b below) and sewer rights-of-way, the only areas where woody vegetation within 30 feet of stream banks may be affected are; 1) where the trail enters existing dedicated greenway culverts at Lake Wheeler Road and Hammond Road, 2) beneath two railroad bridges on Walnut Creek (see Item 10b below), and 3) along a 150-foot segment of Rocky Branch south of Jamaica Drive. The paved trail sections will be only ten feet wide and will not accommodate motor vehicles. Consequently, impacts of stormwater runoff and associated pollutants are expected to be negligible. No fill or excavation below normal high water will occur. Impacts to streams at these crossings will be limited to removal of riparian vegetation. The project engineers (Withers & Ravenel), environmental consultants (Robert J. Goldstein & Associates), and City greenway planner (Vic Lebsock) examined each proposed stream crossing to select an alignment that would impact the least woody riparian vegetation. The greenway must pass beneath existing railroad bridges at Walnut Creek station 27 + 60 (Figure 2c) and Walnut Creek South station 85 + 20 (Figure 4b). At the Walnut Creek site, steep embankments beneath the bridge will require excavation of a portion of the embankment of the trail with a cast in place concrete retaining wall. Approximately 80 linear feet of the railroad embankment will be excavated and graded to provide a bench for the paved trail (figures 2c and 5a). A concrete retaining wall will be installed between the embankment and the greenway trail. There will be no net change in stream channel width or cross-sectional area. The existing streambank and railroad embankment is stabilized with riprap beneath the bridge. The existing substratum is sand, silt, and riprap. At the eastern railroad bridge on Walnut Creek south (Figures 4b and 5b), existing concrete railroad abutments constrict the working area for the greenway. A boardwalk trail segment approximately 70 feet long will be supported on pilings placed in the channel adjacent to the north stream bank. Several existing pilings may be used if structural evaluation indicates they are adequate; otherwise new pilings will be needed. The north bank may require minor re-shaping to accommodate the trail. There will be no net change in stream channel width or cross-sectional area unless additional pilings are necessary for support of the trail. Hydraulic analysis by the project engineers indicates that the greenway structure may cause a minimal increase in stream stage during bankfull or higher flow conditions. The existing streambank in this area is not stabilized. The existing substratum is sand and silt. Item 12. Construction corridors 20 feet wide will be cleared. In uplands, the greenway will be a 10-foot wide paved trail on a bed of crushed stone. At twelve wetland crossings and six small stream crossings (Table 1 and Figures 2, 3, and 4), the greenway will be a 10- foot wide boardwalk supported on wooden pilings. Following construction, the portion of the construction corridor not occupied by the finished trail will be allowed to revegetate naturally. Project Description The City of Raleigh proposes to construct 20,400 feet of new greenway trails along Walnut Creek and Rocky Branch in south Raleigh (Figure 1). The project segment herein referred to as the Walnut Creek trail (8,400 feet) extends from Lake Wheeler Road eastward along Walnut Creek to the Bain Water Treatment Plant (WTP) on Fayetteville Street. The Rocky Branch trail (8,100 feet) extends from the corner of Jamaica Drive and South Saunders Street southeastward along Rocky Branch to Fayetteville Street, then splits into a western section and an eastern section. The western section proceeds southward to connect with the Walnut Creek trail near the Bain WTP, and the eastern section proceeds southeastward to Wilmington Street. The Walnut Creek South trail (3,900 feet) begins at Wilmington Street and follows Walnut Creek eastward to Garner Road. The 10 foot wide recreational trail will be constructed using pavement in uplands, boardwalk in wetlands, and boardwalk or bridges at stream crossings. Greenway construction will affect 0.827 acre of wetlands and 12 stream crossings. The project alignment was selected to follow existing utility rights-of-way where practicable and minimize impacts to riparian vegetation and forested wetlands. In most areas the trail will be within a protected greenway corridor ranging from 30 to 200 feet wide. Except for trails and utility easements, the City will maintain existing natural vegetation in the remainder of the greenway corridor.
