Dear Sirs:
You have our approval, in accordance with the attached conditions, to dredge 936 acres of waters for the purpose of
conducting maintenance dredging in the Wanchese Canal, as you described in your revised application received in the
Washington Regional office on July 28, 1999. After reviewing your application, we have decided that this fill is covered
by Genera] Water Quality Certification Number 3112. In addidon, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-DischarQe and Water Supply Watershed regulations. Also this approval will expire when the accompanying =304 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you mus[ nodfy us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed,in the attached certification. This
approval shall expire when the corresponding Na[ionwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Ralei=h,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.

There should be comments and an issuance statement regarding
the Oregon Inlet Waterways Commission project in Dare County.
This project was originally placed on hold for more information
concerning the location and size of the spoil disposal area. George
Woods finally sent the Region revised plats showing that the
disposal areas were outside the 404 line and were of adequate
size. I did include a comment concerning the need for two feet of
freeboard during the dredge process.

8. PROJECT SUNIlVIARY: The applicant proposes to perform maintenance dredging in the Wanchese
Canal. The project dimensions are 13,600 ft. length, 6 ft. average final depth with an average bottom
width of approximately 17 ft. All spoil material will be disposed on highground sites.

The Wanchese Canal is located on the south side of Wanchese Village, Roanoke Island,
Dare County and runs from the Roanoke Sound to the Croatan Sound. The nearest state roads
to the project site are SR 1141, SR 1142, SR 1143, SR 1146, SR 1289 and NC 345. The
Roanoke Sound entrance to the canal is located 1100 ft. south of the end of SR 1141. The
canal runs in a northwesterly direction for approximately 5,000 ft. then west-north-west for
1100 ft. then southwest for 4,(}00 ft. and finally south for 3,500 ft. The canal width varies
from 20 ft. to 80 ft. with the existing water depths varying from 2.5 ft. to 6 ft. with a 3.7 ft.
average water depth. A connecting water depth of 6 ft. is located approximately 400 ft. from
the entrance of the canal on the Roanoke Sound side and 400 ft. from the entrance on the
Croatan Sound side. The bottom composition of the canal varies from mucky to sandy
materials with stumps located in some areas. The entire south shore of the canal is a Juncus
roemanianus marsh with several acres having unlrnown ownership. A majority of the property
on ' the opposite shore has been developed with single family dwellings and small
owner/operator type commercial fishing operations. Virtually no bulkhead structures exist
along the canal and it appears that most of the highground, adjacent to the canal on the
developed side, was created by spoil deposition from the original construction project. CAMA
permits have been issued to adjacent riparian property owners for basins with bulkheading,
docks, and localizeti maintenance excavation of the canal. The vegetation on most of the
upland shoreline consists of loblolly pine, wax myrtle, red bay and yard grasses. The canal is
used extensively by the riparian property owners for access to both sounds. The waters of the
Roanoke and Croatan sounds in this area aze classified as SA by the Division of Environmental
Management and are closed to shellfish taking by the Shellfish Sanitation Branch.
In order to provide continuerl navigation for use by the general public and adjoining
property owners, the applicant proposes to dredge the Wanchese Canal to a uniform depth of 6
ft. The proposal includes the dredging of 13,600 linear ft. of the waterway with an average
top width of 30 ft. and an average bottom width of 17 ft. for the dredging profile.
The proposed bottom width profile ranges from 7 ft. wide to 35 ft. wide predicatetl to
the existing canal width. Approximately 26,000 cu yds of bottom material will be removed
from the waterway by the proposed dredging. Two spoil disposal sites adjacent to the canal
are proposed for use.
Spoil site A is approximately .9 acre and is located at the intersection of SR 1141 and
SR 1142. It is an irregularly shaped site that is roughly divided into two areas. The first azea
is adjacent to the state road and is a sand and gravel parking lot used by the nearby commercial

fishhouses for trailer storage. The second area is a maintained yard of a single family
dwelling. A juncus marsh is adjacent to the property on the south side.
Spoil site B is an approximately 4.25 acre tract wooded with loblolly pine. The disposal
area proposed for site B is approximately 3.6 acres. An earthen berm 8 ft. high is proposed
for both sites. The applicant indicates the combined capacity of the sites for spoil material is
52,303 cu yds.
The proposal will result in approximately 408,000 sq. ft. of Public Trust Area and
Estuarine Waters Areas of Environmental Concern (AECs) being dredged with approximately
26,000 cu yds of bottom material being removed to an upland spoil disposal area.
The creations of spoil site A will result in land disturbing activity of approximately
41,000 sq. ft. and the creation of spoil site B will result in land disturbing activity of
approximately 160,000 sq. ft. for a total of 201,000 sq. ft. (4.6 acres) of land disturbing
activity. Of that amount, approximately 7,5000 sq. ft. are in the Estuarine Shoreline AEC.
Temporary water turbidity will occur during dredging operations. The project does not
propose to increase the width of the canal and no dredging or filling of coastal wetlands AEC
are proposed. A 3 to 1 slope of the proposed dredge shoulder should preclude any marsh
undercutting. Boat traffic may increase due to reliability of water depth. It is anticipated that
any stump removal in the waterway will require the use of a clam shell bucket and barge. No
submerged aquatic vegetation beds were observed at the proposed site.

The Wanchese Canal is located on the south side of Wanchese Village, Roanoke Island,
Dare County and runs from the Roanoke Sound to the Croatan Sound. The nearest state roads
to the project site are SR 1141, SR 1142, SR 1143, SR 1146, SR 1289 and NC 345. The
Roanoke Sound entrance to the canal is located 1100 ft. south of the end of SR 1141. The
canal runs in a northwesterly direction for approximately 5,000 ft. then west-north-west for
1100 ft. then southwest for 4,000 ft. and finally south for 3,500 ft. The canal width varies
from 20 ft. to 80 ft. with the existing water depths varying from 2.5 ft. to 6 ft. with a 3.7 ft.
average water depth. A connecting water depth of 6 ft. is located approximately 400 ft. from
the entrance of the canal on the Roanoke Sound side and 400 ft. from the entrance on the
Croatan Sound side. The bottom composition of the canal varies from mucky to sandy
materials with stumps located in some areas. The entire south shore of the canal is a Juncus
roemanianus marsh with several acres having unknown ownership. A majority of the property
on the opposite shore has been developed with single family dwellings and small
owner/operator type commercial fishing operations. Virtually no bulkhead structures exist
along the canal and it appears that most of the highground, adjacent to the canal on the
developed side, was created by spoil deposition from the original construction project. CAMA
permits have been issued to adjacent riparian property owners for basins with bulkheading,
docks, and localized maintenance excavation of the canal. The vegetation on most of the
upland shoreline consists of loblolly pine, wax myrtle, red bay and yard grasses. The canal is
used extensively by the riparian property owners for access to both sounds. The waters of the
Roanoke and Croatan sounds in this area are classified as SA by the Division of Environmental
Management and are closed to shellfish taking by the Shellfish Sanitation Branch.
In order to provide continued navigation for use by the general public and adjoining
property owners, the applicant proposes to dredge the Wanchese Canal to a uniform depth of 6
ft. The proposal includes the dredging of 13,600 linear ft. of the waterway with an average
top width of 30 ft. and an average bottom width of 17 ft. for the dredging profile.
The proposed bottom width profile ranges from 7 ft. wide to 35 ft. wide predicated to
the existing canal width. Approximately 26,000 cu yds of bottom material will be removed
from the waterway by the proposed dredging. Two spoil disposal sites adjacent to the canal
are proposed for use.
Spoil site A is approximately .9 acre and is located at the intersection of SR 1141 and
SR 1142. It is an irregularly shaped site that is roughly divided into two areas. The first area
is adjacent to the sta.te road and is a sand and gravel parking lot used by the nearby commercial

fishhouses for trailer storage. The second area is a maintained yard of a single family
dwelling. A juncus marsh is adjacent to the property on the south side.
Spoil site B is an approximately 4.25 acre tract wooded with loblolly pine. T'he disposal
area proposed for site B is approximately 3.6 acres. An earthen berm 8 ft. high is proposed
for both sites. T'he applicant indicates the combined capacity of the sites for spoil material is
52,303 cu yds.
The proposal will result in approximately 408,000 sq. ft. of Public Trust Area and
Estuarine Waters Areas of Environmental Concern (AECs) being dredged with approximately
26,000 cu yds of bottom material being removed to an upland spoil disposal area.
The creations of spoil site A will result in land disturbing activity of approximately
41,000 sq. ft. and the creation of spoil site B will result in land disturbing activity of
approximately 160,000 sq. ft. for a total of 201,000 sq. ft. (4.6 acres) of land disturbing
activity. Of that amount, approximately 7,5000 sq. ft. are in the Estuarine Shoreline AEC.
Temporary water turbidity will occur during dredging operations. The project does not
propose to increase the width of the canal and no dredging or filling of coastal wetlands AEC
are proposed. A 3 to 1 slope of the proposed dredge shoulder should preclude any marsh
undercutting. Boat traffic may increase due to reliability of water depth. It is anticipated that
any stump removal in the waterway will require the use of a clam shell bucket and barge. No

other lacger plats are acceptable only if an adequate
